Preventing torture in Europe by Christine Bicknell,Malcolm Evans,Rod Morgan Pdf

A comprehensive insight into the valuable work carried out by one of the Council of Europe’s highly influential mechanisms, the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT). Since its inception in 1989, specialist members of the CPT (lawyers, prosecutors, prison experts, doctors, psychiatrists, etc.) have visited thousands of police stations, prisons, immigration detention centres, psychiatric hospitals and other places of detention all over Europe, to monitor the living conditions (hygiene, provision of food and drink, health care, etc.) of those being detained. Following these visits, the CPT issues reports suggesting improvements and laying down standards. The purpose of this book is twofold. In the first part, the authors explain the background and origins of the CPT, its membership and modus operandi, as well as how it interacts with other bodies, such as the UN’s Subcommittee on Prevention of Torture (SPT) and the national preventive mechanisms (NPMs). In the second part, the authors describe the CPT’s key findings and standards in the main situations of deprivation of liberty (police, prison, immigration detention, mental health and social care). In a detailed appendix, the authors provide summaries of the key CPT findings for the 47 states visited by the CPT.

Immigration Detention, Risk and Human Rights by Maria João Guia,Robert Koulish,Valsamis Mitsilegas Pdf

This book offers a brand new point of view on immigration detention, pursuing a multidisciplinary approach and presenting new reflections by internationally respected experts from academic and institutional backgrounds. It offers an in-depth perspective on the immigration framework, together with the evolution of European and international political decisions on the management of immigration. Readers will be introduced to new international decisions on the protection of human rights, together with international measures concerning the detention of immigrants. In recent years, International Law and European Law have converged to develop measures for combatting irregular immigration. Some of them include the criminalization of illegally entering a member state or illegally remaining there after legally entering. Though migration has become a great challenge for policymakers, legislators and society as a whole, we must never forget that migrants should enjoy the same human rights and legal protection as everyone else.

Death in State Custody by E.C.M. Thoonen Pdf

What is expected of State authorities with regard to the obligation to safeguard the life of detainees? What obligations do State authorities have in relation to the investigation into deaths that occur during deprivation of liberty by the State? This book addresses these questions regarding death in State custody in view of the European Convention on Human Rights, in particular the right to life, the prohibition of torture and the right to respect for private life (including the right to self-determination). It also provides an analysis of whether the Dutch legal framework contains safeguards to meet the requirements that follow from the European Convention on Human Rights. Matters that are discussed in detail are the obligation to provide healthcare to detainees and to take protective measures to safeguard the life of detainees. The ethical issues regarding end of life decisions of detainees, like refusal of medical treatment, hunger and/or thirst strike, suicide and euthanasia, and the conflicts that may arise in this regard considering the obligations of State authorities are addressed. This book is a must-have for all those who are involved in the (medical) treatment of detainees and who are confronted with death in State custody.

The Police and International Human Rights Law by Ralf Alleweldt,Guido Fickenscher Pdf

This book provides an updated overview of current international human rights law relating to the police. Around the globe, the police have a special responsibility for the protection of human rights. Police work is governed by national rules and in addition, in today’s world, by the evolving international human rights standards. As a result of the ever-developing case law of international courts and other bodies, the requirements of human rights law on policing have become more and more detailed and complex in recent years. Bringing together a variety of distinguished authors from academia, police forces and other government authorities, the human rights movement, and international organizations, the book discusses topical issues, including the use of deadly force, the prevention of torture, effective investigations, the protection of personal data, and positive obligations of the police.

Prison Law by Mary Rogan Pdf

Prison litigation is becoming increasingly common in Ireland. Prison numbers are at an all-time high and conditions in many Irish prisons have been criticised by international and domestic human rights bodies, such as the Irish Penal Reform Trust and the Inspector of Prisons who have voiced concern about the lack of accountability for decisions taken by prison administrators on issues such as discipline, transfers and release. The rights of prisoners are a key focus of the book. These rights are examined in relation to prison conditions, contact with the outside world, discipline, remission, transfer and release. Prison Law analyses practical issues that prison law practitioners are likely to come up against, such as causes of action, evidential difficulties and time limits. Written from both a domestic and international perspective, the book sets out the position in Irish prisons of particular groups including women, children, foreign prisoners and those from an ethnic minority background and identifies areas in which the treatment of prisoners gives rise to concerns under the Constitution or the European Convention on Human Rights. The most up to date book in this legal area, Prison Law also includes an appendix setting out the fully consolidated Prison Rules 2007-2013.
