Products Liability Law by Mark Geistfeld Pdf

Products Liability Law, Second Edition, by prolific tort scholar Mark Geistfeld, represents the “next generation” of casebooks on products liability. Earlier texts focused on the relative merits of strict liability and negligence, embodied in the apparently competing liability frameworks of the consumer expectations test in the Restatement (Second) of Torts and the risk-utility test in the Restatement (Third) of Torts. The majority of courts, however, have incorporated the risk-utility test into the framework of consumer expectations. By providing balanced coverage of both consumer expectations and the risk-utility test, the casebook keeps pace with ongoing developments in the case law and moves beyond the battles that largely defined products liability in the twentieth century. In addition to teaching students how liability rules protect consumer expectations via comprehensive application of the risk-utility test, this innovative casebook underscores the importance of doctrinal history, the psychology of evaluating product risks, and the role of products liability in the modern regulatory state. Students will learn how courts have applied established doctrines to novel problems ranging from the relevance of scientific evidence in toxic-tort cases to the distribution of defective products on the Amazon online marketplace. To further illustrate this dynamic, the casebook has twenty-nine problems with associated analysis involving the liability issues likely to be raised by the emerging technology of autonomous vehicles. Finally, the casebook reinforces students’ knowledge of fundamental tort principles while developing specialized expertise and a deeper understanding of the torts process. New to the Second Edition: A dozen new main cases updating older case law, providing coverage of new issues not addressed in the First Edition, and/or improving upon the analysis provided by the associated case in the First Edition Retention of the majority of main cases from the first edition, with revisions to the ensuing notes incorporating relevant case law developments A reorganized and updated chapter covering the controversy over the relative merits of the consumer expectations and risk-utility tests Comprehensive discussion of the tort version of the implied warranty—the genesis of the consumer expectations test—and its relation to product malfunctions and the risk-utility test A new chapter addressing the existence of the tort duty and identifying the difference between patent dangers and patent defects Reorganization of the chapter on factual causation, emphasizing the continuity of evidentiary problems running across different types of cases, ranging from the heeding presumption in warning cases, to market-share liability, to proof of both general and specific causation in toxic-tort cases Professors and students will benefit from: Classroom-tested materials taught for over 20 years by an award-winning professor Interesting cases that illustrate both the traditional and contemporary character of products liability litigation; cases are followed by extensive notes Each chapter addressing doctrinal issues concludes with problems on autonomous vehicles. The full set of 29 problems provides students with the necessary background for understanding liability issues posed by this emerging technology. Each problem is followed by the author’s analysis of the associated issues, cross-referenced to the relevant casebook material.

The Right to Equality in European Human Rights Law by Charilaos Nikolaidis Pdf

A right to equality and non-discrimination is widely seen as fundamental in democratic legal systems. But failure to identify the human interest that equality aims to uphold reinforces the argument of those who attack it as morally empty or unsubstantiated and weakens its status as a fundamental human right. This book argues that an understanding of the human interest which equality aims to uphold is feasible within the jurisprudence of the European Court of Human Rights (ECtHR) and the European Court of Justice (ECJ). In comparing the evolution of the prohibition of discrimination in the case-law of both Courts, Charilaos Nikolaidis demonstrates that conceptual convergence within the European Convention on Human Rights (ECHR) and the EU on the issue of equality is not as far as it might appear initially. While the two bodies of equality law are extremely divergent as to the requirements they impose, their interpretation by the international judiciary might be properly analysed under a common light to emphasise the substantive dimension of equality in European Human Rights law. The book will be of great use and interest to scholars and students of human rights, discrimination law, and European politics.

The Unity of the Common Law by Alan Brudner Pdf

In this classic study, Alan Brudner investigates the basic structure of the common law of transactions. For decades, that structure has been the subject of intense debate between formalists, who say that transactional law is a private law for interacting parties, and functionalists, who say that it is a public law serving the collective ends of society. Against both camps, Brudner proposes a synthesis of formalism and functionalism in which private law is modified by a common good without being subservient to it. Drawing on Hegel's legal philosophy, the author exhibits this synthesis in each of transactional law's main divisions: property, contract, unjust enrichment, and tort. Each is a whole composed of private-law and public-law parts that complement each other, and the idea connecting the parts to each other is also latently present in each. Moreover, Brudner argues, a single narrative thread connects the divisions of transactional law to each other. Not a row of disconnected fields, transactional law is rather a story about the realization in law of the agent's claim to be a dignified end-master of its body, its acquisitions, and the shape of its life. Transactional law's divisions are stages in the progress toward that goal, each generating a potential developed by the next. Thus, contract law fulfils what is incompletely realized in property law, negligence law what is germinal in contract law, public insurance what is seminal in negligence law, and transactional law as a whole what is underdeveloped in public insurance. The end point is the limit of what a transactional law can contribute to a life sufficient for dignity. Reconfigured and expanded with a contribution by Jennifer Nadler, The Unity of the Common Law stands out among contemporary theories of private law in that it depicts private law as purposive without being instrumental and as autonomous without being emptily formal.

Starting a Solo Law Firm 2021 Edition by Attorney Robert Schaller Pdf

Attorney Robert Schaller and the Schaller Law Firm offer young lawyers in Starting a Law Firm in 2020-2021 a must-have desk reference book for building a law firm. Lawyers should invest in their future! Young lawyers worked hard in college and again in law school. Now it is time to reap the rewards of the intensive legal training. Earn the profits deserved. Develop pride and earn respect from your peers. Any lawyer who possesses a heartfelt desire to build a respected legal career, along with the vision and drive to succeed, should read and embrace the steps set forth in this book. This book is dedicated to the young lawyers who are unfulfilled working as associates for other lawyers or who recently graduated from law school with the courage to “hang out a shingle” and start their own law firm. This book provides concrete guidance about issues the author wished someone had taught him before he started his own law firm. Some lawyers have the courage to open a solo-practice law firm. Other lawyers start a law firm with one or two other lawyers they know and trust. There is strength in numbers. It is appealing to young lawyers in particular to have a law school classmate or fellow associate nearby for support. Others establish an “affiliation” with an existing firm. Sometimes a lawyer needs another lawyer to brainstorm and bounce ideas around. Deciding whether to start a law firm is a tough decision. You gain the freedom described above, but you lose the security of working for an established firm as an associate. But is that freedom? In the short run, a young lawyer likes the security of knowing a paycheck is coming twice a month. But all private practice lawyers ultimately realize that they “eat what they kill.” Therefore, the early shelter and protection offered by an established firm is lost after a few years when the developing lawyer is required to either leave the firm or develop a pool of clients that generate sufficient profits for the firm to justify the lawyer’s salary. In essence, the lawyer has to develop the lawyer’s own “profit center” or the lawyer’s own “solo firm” within the firm. Either way, the lawyer has to know how to start a practice and thrive. This book will help striving lawyers get on the path to success. Testing Your Entrepreneurial Spirit: Answer the questions below to determine if you have what it takes to start a law firm. Lawyers who want to start their own firm should answer affirmatively to most of the questions below or should partner with another lawyer who answers affirmatively to most questions. 1. Do you have a passion to do something great with your career? 2. Do you want to build a business to create wealth for yourself and not someone else? 3. Can you visualize your definition of success? 4. Do you have the determination and resolve to achieve your definition of success? 5. Are you an independent person? 6. Are you self-confident (despite the humiliation of law school)? 7. Are you ambitious? 8. Are you self-motivated? 9. Are you a self-starter? 10. Are you decisive after studying the pros and cons of an issue? 11. Are you a problem-solver? 12. Do you have effective communication skills? 13. Can you set timetables and stick to them without procrastinating? 14. Do you have a dream to be your own boss? 15. Do you have a passion to help clients? 16. Are you cognizant of your strengths and weaknesses? 17. Do you know when it is time to seek guidance from a more experienced attorney? 18. Are you resilient to temporary setbacks? 19. Are you flexible when a course correction is recognized? 20. Can you view a temporarily setback as an opportunity for improvement? 21. Are you able to convince strangers that you know what you are talking about? 22. Do you have the desire to continuously study a particular substantive area of law? 23. Are you looking to build your future instead of looking for something to do until you can find another job? 24. Do you want to start a law firm by yourself, classmate, colleague, or more senior attorney?
