Sustainable Development in World Investment Law by Marie-Claire Cordonier Segger,Markus W. Gehring,Andrew Paul Newcombe Pdf

Sustainable development, as defined by the World Commission on Environment and Development, is "development that meets the needs of the present without compromising the ability of future generations to meet their own needs." More specifically, sustainable development is a process of change that seeks to improve the collective quality of life by focusing on economically, socially, and environmentally sound projects that are viable in the long-term. Sustainable development requires structural economic change and the foundation of that change is investment. In developing nations with low levels of domestic savings, investment predictably comes from abroad in the form of foreign direct investment. A large and ever expanding number of international investment agreements are in place to govern these transactions. While these accords seek to foster development while mitigating the risk involved in these types investments, many questions remain unresolved. This highly insightful book reflects the contributions of a variety of world renowned experts each of which is designed to provide the reader with valuable perspective on recent developments in investment law negotiations and jurisprudence from a sustainable development law perspective. It offers answers to pertinent questions concerning advancements in investment law, including the negotiation of numerous regional and bilateral agreements as well as the increasing number of disputes resolved in the World Bank's International Centre for the Settlement of Investment Disputes (ICSID), from different developed and developing country perspectives. It lays out future directions for new treaty negotiations and dispute settlement proceedings, as well as ongoing investment promotion efforts, against a background of rapidly evolving international relationships between economic, environment and development law. It focuses on key issues in investment laws which have emerged as priorities in the negotiation of bilateral and regional investment agreements, and have been clarified through recent decisions of the ICSID and other arbitral panel awards.

Integrating Sustainable Development in International Investment Law by Manjiao Chi Pdf

The current international investment law system is insufficiently compatible with sustainable development. To better address sustainable development concerns associated with transnational investment activities, international investment agreements should be made more compatible with sustainable development. Integrating Sustainable Development in International Investment Law presents an important systematic study of the issue of sustainable development in the international investment law system, using conceptual, normative and governance perspectives to explore the challenges and possible solutions for making international investment law more compatible with sustainable development. Chi suggests that to effectively address the sustainable development concerns associated with transnational investment activities, the international investment agreements system should be reformed. Such reform should feature redesigning the provisions of the agreements, improving the structure of international investment agreements, strengthening the function of soft law, engaging non-state actors and enhancing the dispute settlement mechanism. The book is primarily aimed at national and international treaty and policy-makers, lawyers and scholars. It is also suitable for graduate students studying international law and policy-making.

Investing for Sustainable Development? by Just Economics (Firm) Pdf

"How can investors be encouraged to consider more than purely commercial and short-term gains? Various sets of investment principles have emerged in recent years. These principles aim to incorporate social, environmental and governance criteria into investment decisions in order to enhance the benefits and reduce the damaging effects of investment for development. Increasing numbers of organisations are signing up to these principles for reasons that range from improving their reputation to minimising risks and improving long-term investment prospects. Yet their impact on sustainable development remains unproven. Focusing on four major sets of investment principles - the UN Principles for Responsible Investment (PRI), the Equator Principles, the Environmental and Social Principles of the European Investment Bank (EIB), and the OECD Declaration on International Investment and Multinational Enterprises - Investing for sustainable development? takes a first step in assessing the content, take-up, implementation and impact of investment principles. The study finds that the main impact of investment principles on sustainable development so far is mitigation of the worst effects of investments rather than a shift in the underlying basis of decision-making. Investors are generally unwilling to compromise high returns for improved sustainable development outcomes. The authors call for better monitoring and measurement of the impact of investment principles, as well as a better understanding of the broader institutional changes required to support them so the next generation of investment principles can be more ambitious and bring about investment that supports, rather than undermines, sustainable development."--Publisher description.

International Investment for Sustainable Development by Lyuba Zarsky Pdf

International Investment for Sustainable Development critically examines the interface between sustainability, development, and the governance of international investment. It challenges the conventional view that foreign direct investment is a 'miracle drug' for developing countries and exposes serious shortcomings in the current international investment regime. Composed of norms, agreements, treaties and regulations, the emerging investment regime expands the rights of transnational corporations (TNCs) without commensurate rewards for the common good. Drawing on both research and engaged advocacy, the contributors ultimately map out a new way forward, towards the creation and implementation of international investment rules that will promote global sustainability and equity.

Investing in commonly-held resources for inclusive and sustainable development by Gnych, S.,Lawry, S.,McLain, R.,Monterroso, I.,Adhikary, A. Pdf

Key messagesInvestment in commons comes primarily from donors, governments and communities, but private sector investment is increasing.Commons-based investment readiness is conditional on the level of assurance stakeholders have that the obligations of each party will be met. Investment readiness develops over time and in stages, as levels of assurance increase. Each sector has specific roles and responsibilities for mitigating risk.Community rights have fostered investment that recognizes the social character of commons ownership and delivers environmental and social returns, as well as profits. There is a need for additional research on the origins, mechanisms, volume and direction of investment in community-managed resources that can help communities and investors alike better understand their options.

Investment Reinvented by Mariana Bozesan,Karen Wendt,Ernst Ulrich von Weizsäcker Pdf

This book provides empowering examples on how capital can pave the way toward an integrally sustainable future when guided by the equal integration of people, planet, and profit, paired with passion and purpose. The fact that more than 30 percent of all assets under managing are already invested with environmental, governance, and/or social criteria in mind indicates that we are passing the tipping point toward the implementation of both the UN SDG as well as COP21. In the face of the current geo-political crises and climate challenges, the implementation of the 17 Sustainable Development Goals of the United Nations and of the Paris climate accord (COP21) signed in 2015 by 195 states have become an unavoidable must. Yet, investors, business people, politicians, economists, the civil society, and political leaders are daunted by the task at hand. This is the empowering response of holistically thinking impact investors, business leaders, and economists to the call to action formulated by 32 Club of Rome members in their book “Come on: Capitalism, Short-termism and the Destruction of the Planet,” the report to the Club of Rome published by Springer. The book demonstrates through concrete investment case studies that it is not only possible but indeed financially profitable to merge fiduciary responsibility with in-depth considerations for the people and the planet. It combines contributions from practitioners and researchers in the field of sustainable finance, innovation, entrepreneurship, portfolio engineering, wealth management and transformational leadership. It offers valuable insights into redirecting capital toward integral sustainability across all asset classes while also de-risking assets and offering solutions that ensure the parity of profit, people and planet. The authors not only present new research and frameworks, they also engage in reinventing investment and finance in a practical manner. They show how a new commitment that anchors the UN SDG to the core of every business strategy can make it not only globally competitive but also profitable. The book addresses furthermore the highly important topic of transformational leadership in general with a new entrepreneurial mindset and in the financial industry in particular. The new leader must understand and leverage the antecedents, the cross cutting issues, as well as the behavioural aspects and incentives of sustainable finance. The new leader must understand and have the tools at hand to implement SDG economics. Therefore, this book also addresses concepts that have thus far not been connected to finance nor investment and include frameworks such as vertical development, integral theory, spiral dynamics, conscious capitalism, and their role in de-risking investments, enabling sustainable innovation, reinventing due diligence, but also in horizontal and vertical team development.

Crafting Trade and Investment Accords for Sustainable Development by Marie-Claire Cordonier Segger Pdf

International economic law guides and shapes globalization and the future of the world economy, our human societies, and the Earth. The rules which facilitate trade and investment could defend the interests of Hermes, Greek god of commerce and thieves, or learn to draw inspiration from Athena, goddess of justice, wisdom, and crafts. This volume explores how trade and investment agreements could promote more sustainable development, rather than increasing the negative social and environmental impacts of economic growth. States and other actors are attempting to integrate social and environmental considerations into trade and investment policies, towards more sustainable development. Analysing their efforts, this volume offers insights into the ways that commitments to sustainability are being operationalized in the texts of economic treaties themselves. Written by a renowned expert jurist and professor of law, this book examines the measures being debated in the WTO and adopted by States in a selection of innovative and flexible regional and bilateral trade and investment accords. With legal examples spanning decades of experimentation and experience, the book illuminates how States and stakeholders are seeking innovative ways to integrate environmental and social considerations into trade and investment agreements. Introducing a ground-breaking systematic approach, the volume considers how, through this integration, international trade and investment law can contribute to the achievement of the world's Sustainable Development Goals.
