International Law, Vol. 1 by L. Oppenheim Pdf

Excerpt from International Law, Vol. 1: A Treatise; Peace German, Italian, Russian, Swiss, Belgian, Portuguese, American, and spanish-american authors are repre sented. And as a rule I have avoided giving refer ences to articles contained in periodicals. But my readers will find these as well as other references in the books quoted. In any case they will know where to find something on any subject in which they take a special interest. That I have everywhere quoted Phillimore, Twiss, and Hall, and have as regards the detail of many points referred my readers to these classics of international jurisprudence, was a matter of course. I should, however, specially mention that I had to quote Hall's treatise in its fourth edition (i 895) because the editor of the fifth edition has abandoned the section-marks in the divisions of the book. The Development of International Law After the World War (Classic Reprint) by Otfried Nippold Pdf

Excerpt from The Development of International Law After the World War In accordance with its original character, this book offers only a survey of the future problems of international law. In this work I have given merely some directing outlines. I have been obliged to forgo entering upon the individual problems here, since this would have claimed materially more space and also more time. But I also believe that m the present hour it 18 above all necessary to call to mind once more the fundamental tendencies in the development of international law. The problems to be solved for international law in the future are neither simple nor small in number. We may rejoice if, upon the conclusion of peace, we succeed in obtaining an agreement on the basic principles. The future work will, however, take decades. International Law Applied to the Treaty of Peace (Classic Reprint) by Sterling E. Edmunds Pdf

Excerpt from International Law Applied to the Treaty of Peace Only the first half of this prophecy has been fulfilled; in the pursuit of material and illogical objects by the Allied and Associated governments the opportunity to realize the latter half has been postponed to a later time. The sweeping aside of all restraints by the victors must cause something of a shock to those who read the articles of the treaty in the belief that the character of imposed peace has changed. International Law, Some Problems of the War by H. Erle Richards Pdf

Excerpt from International Law, Some Problems of the War: A Lecture Delivered Before the University of Oxford in the Hall of All Souls College on October 30, 1915 There was no Chair of International Law at the time of the Napoleonic Wars or at that of the Crimea, nor can I discover that any lectures were then delivered on the Law of Nations. The mild hostilities of the Boer War, the only occasion on which this country has been a belligerent since the Chair was instituted, raised no questions at all comparable with those that face us to-day. In the present war there are topics to hand in plenty, anxious topics that all demand consideration. An attempt will be made to discuss the greater part of them, more or less in detail, in the course of lectures which it is proposed to deliver during the current year. This afternoon there is no time to do more than to submit to you some observations on particular points of importance. On some of these points it is premature as yet to pronounce a final opinion, and on them my purpose will be attained if I succeed in explaining the main considerations which affect them and in assisting you to form a judgment upon them when the time for judgment comes. Let us turn first to the relations between belligerents neutrals. Here the group of questions that have and aroused the most controversy are those as to the restrictions which a belligerent is entitled to have imposed or to himself impose on trade between neutrals and his enemies. For instance, the right of a belligerent to insist on the prohibition by neutral States of trade in munitions of war with his enemies, or of the raising of a loan in the neutral market by his enemy; the right of a belligerent to stop and seize neutral cargoes destined for the enemy while on the high seas; these are topics of the highest importance, and, with your leave, I will discuss them in the order in which they have been stated. Some Legal Questions of the Peace Conference by Robert Lansing Pdf

Excerpt from Some Legal Questions of the Peace Conference: Address I might expand the list of subjects for consideration suggested by the Treaty of Peace which will invite the' learning and wisdom of those who will, I sincerely hope, be charged with the codification of the principles of international law. Even if I subject myself to the charge of repetition, let me say that I most earnestly advocate the formulation of such a code by an international conference of jurists and publicists. With a definite standard of legal rights sanctioned by the nations the administration of international relations as well as the administration of international justice will become more con sistent and less a prey to expediency and political opportunism. Just War Or Just Peace? by Simon Chesterman Pdf

This book asks whether states have the right to intervene in foreign civil conflicts for humanitarian reasons. The UN Charter prohibits state aggression, but many argue that such a right exists as an exception to this rule. Offering a thorough analysis of this issue, the book puts NATO's action in Kosovo in its proper legal perspective.

International Law, Having Particular Reference to the Laws of War on Land by J. B. Porter Pdf

Excerpt from International Law, Having Particular Reference to the Laws of War on Land: A Course of Twelve Lectures Delivered to the Staff Class of the Army Service Schools In the study of international law, a division has sometimes been made between the natural law and the positive law; the former comprises the law as it ought to be, and the latter the law as it actually is, under present conditions; or I might say the former is the theoretical, altruistic law, and the latter the practical law under which the nations meet.
