Regulating Preventive Justice by Tamara Tulich,Rebecca Ananian-Welsh,Simon Bronitt,Sarah Murray Pdf

Like medicine, law is replete with axioms of prevention. ‘Prevention is better than cure’ has a long pedigree in both fields. 17th century jurist Sir Edward Coke observed that ‘preventing justice excelleth punishing justice’. A century later, Sir William Blackstone similarly stated that ‘preventive justice is ...preferable in all respects to punishing justice’. This book evaluates the feasibility and legitimacy of state attempts to regulate prevention. Though prevention may be desirable as a matter of policy, questions are inevitably raised as to its limits and legitimacy, specifically, how society reconciles the desirability of averting risks of future harm with respect for the rule of law, procedural fairness and human rights. While these are not new questions for legal scholars, they have been brought into sharper relief in policy and academic circles in the wake of the September 11 terrorist attacks. Over the past 15 years, a body of legal scholarship has tracked the intensified preventive focus of anti-terrorism law and policy, observing how this focus has impacted negatively upon traditional legal frameworks. However, preventive law and policy in other contexts, such as environmental protection, mental health, immigration and corruption has not received sustained focus. This book extends that body of scholarship, through use of case studies from these diverse regulatory settings, in order to examine and critique the principles, policies and paradoxes of preventive justice. "Whereas earlier scholars looked upon preventive justice as a source and means of regulation, the powerfully argued contributions to this volume provide forceful reasons to consider whether we would do better talk about regulating preventive justice." Professor Lucia Zedner, Oxford University

TERRORISM: INTERNATIONAL CASE LAW REPORTER 2008 Volume II by Michael Newton Pdf

Terrorism: International Case Law Reporter is an annual collection of the most important cases in security law from around the world. Handpicked and introduced by internationally renowned terrorism scholar Michael Newton and by a distinguished board of experts from around the world, the cases in this series cover topics as diverse as human rights, immigration, freedom of speech, and organizational status. For scholars, students, and practitioners seeking an authoritative and comprehensive resource for research into security law jurisprudence, this unique series serves that specialized purpose like none other on the market. With the 2008 edition of Terrorism: International Case Law Reporter, Oxford introduces detailed headnotes to the series. Professor Michael Newton and his team have provided, for each case, a robust summary and a concise statement of the case's central issues and holding. This edition also adds new topics to the series' purview, including the contentious issue of what legal status enemy combatants possess in U.S. courts and the equally volatile issue of whether agents of a state may be held criminally liable for terrorism when carrying out official duties. General Editor Newton has also added Israel and the Middle East as necessary new regional topics for a series that covers terrorism-related jurisprudence worldwide. Indeed, many of the prominent cases in this year's edition come from non-U.S. courts, including an Argetinian case on state terrorism and crimes against humanity. That case, Velasco, appears in this edition in the only English translation available anywhere.

To achieve competitive advantage in this way managers need a plan. Proactive Law for Managers provides this plan; The Manager's Legal PlanTM. Mellinkoff's Dictionary of American Legal Usage by David Mellinkoff Pdf

This is a dictionary of the language of the law as used in America today. Most of this dictionary is written in ordinary English. Most of the words that lawyers use in writing and talking about the law are the ordinary words that fill the dictionaries of the English language. They have a place in this dictionary when the law gives them a specialized sense; or to emphasize that there is none. Too often an apparent change in sense results not from the law but from bad grammar or redundancy; or from an unsorted host of possible meanings jumbled together and left to the vagaries of interpretation. At the other extreme, individual cases, each walled in by its own distinctive facts and law, may give an immaculately narrowed sense, but neither generalized definition nor standards for the gradation of sense that is the essence of clear usage. A small number of citations to cases of special relevance to word usage are included in this dictionary. The citation count does not measure the indebtedness of this dictionary to old and current sources of American legal usage. The definitions and examples of usage in this dictionary have roots in the law reports of thousands of litigated cases; in law writings formal and informal, profound and trivial; in the talk of lawyers and judges in court and out--the formal and the informal--colloquial and slangy, talk that is precise and talk that is mush; in a long line of dictionaries past and present--law dictionaries, and dictionaries of English and its usage. Drawing from all those sources, the definitions and examples are shaped by more than a half-century of personal immersion in the oral and written language of the law, as law student, practicing lawyer, professor, and writer. And something has been added. This dictionary is designed to sort out the words used in the law, and to identify the different senses in which each is used, and can be used. With cross-reference, it tells how words are related to each other and separated for each other, so that discrimination and choice of usage are possible. Words are grouped together as identical, similar, disparate, departing from or paralleling the usages of ordinary English. Where usage is not uniform, the dictionary comments on what is better, best, and worst. The dictionary concentrates on general legal usage for a profession practicing in the American common law tradition . . . The dictionary does not detail the multitude of other jurisdictional variations, but calls attention to the fact of variation. Although the distinction is often difficult to make, this is a word dictionary, not a short legal encyclopedia. Technicalities in general legal usage are included, but not the intricacies of learning in specialized fields of the law. There is no standard legal pronunciation. Pronunciation is included here when it is unusual, exotic, controversial, or needed to prevent confusion. Pronunciation is rendered in simplified phonetics. American law dictionaries go back to 1839. This one is new and different. --David Mellinkoff, from the Preface

Legal Tech, Smart Contracts and Blockchain by Marcelo Corrales,Mark Fenwick,Helena Haapio Pdf

There is a broad consensus amongst law firms and in-house legal departments that next generation “Legal Tech” – particularly in the form of Blockchain-based technologies and Smart Contracts – will have a profound impact on the future operations of all legal service providers. Legal Tech startups are already revolutionizing the legal industry by increasing the speed and efficiency of traditional legal services or replacing them altogether with new technologies. This on-going process of disruption within the legal profession offers significant opportunities for all business. However, it also poses a number of challenges for practitioners, trade associations, technology vendors, and regulators who often struggle to keep up with the technologies, resulting in a widening regulatory “gap.” Many uncertainties remain regarding the scope, direction, and effects of these new technologies and their integration with existing practices and legacy systems. Adding to the challenges is the growing need for easy-to-use contracting solutions, on the one hand, and for protecting the users of such solutions, on the other. To respond to the challenges and to provide better legal communications, systems, and services Legal Tech scholars and practitioners have found allies in the emerging field of Legal Design. This collection brings together leading scholars and practitioners working on these issues from diverse jurisdictions. The aim is to introduce Blockchain and Smart Contract technologies, and to examine their on-going impact on the legal profession, business and regulators.

Precaution, Environmental Science, and Preventive Public Policy by Joel Tickner Pdf

The "precautionary principle"—the idea that society should guard against potentially harmful activities even if some cause and effect relationships have not been fully established—has often been attacked for being unscientific. However leading scientists studying the issue have begun to make the case that the precautionary principle is in fact science based, and that it creates a need for more rigorous and transparent science in examining complex and uncertain environmental risks.Precaution, Environmental Science, and Preventive Public Policy is the first book to explore the role of science in developing a more precautionary approach to environmental and public health policy. The book brings together leading scientists, legal experts, philosophers, environmental health professionals, and environmentalists to offer a multi-disciplinary perspective on the controversial debate over science and precaution. The book:discusses the critical need for science in promoting sustainabilityoutlines the ethical imperative of a more precautionary science and the philosophical foundations of that new approachconsiders some of the ways in which the current conduct of environmental science works against precautionary policiesexamines how the role and use of science differs across cultures and political systemsprovides the components of an approach to environmental science that more effectively supports precautionary decisionsThe book also offers case studies that consider various types of uncertainty and sets forth a framework for evaluating and addressing uncertainty in decision-making.Contributors include Juan Almendares, Katherine Barrett, Kamaljit Bawa, Finn Bro-Rasmussen, Donald Brown, Theofanis Christoforou, Terry Collins, Barry Commoner, Carl Cranor, Stephen Dovers, David Gee, Elizabeth Guillette, Cato ten Hallers-Tjabbes, James Huff, Matthias Kaiser, Richard Levins, Mary O'Brien, Carolyn Raffensperger, Jerry Ravetz, Vandana Shiva, Boyce Thorne-Miller, Joe Thornton, Reginald Victor, and Alistair Woodward.Precaution, Environmental Science, and Preventive Public Policy presents a broad overview of the role of science in implementing the precautionary principle and makes a compelling case that science should be used not just to study problems but to develop solutions.
