Social Security by Danny Pieters Pdf

Everybody uses the term social security, but definitions vary widely. This unique book may be conceived as a wide-ranging definition, although in fact it emphasizes only part of the concept: that administrative function that grants cash benefits to offset or compensate for such social risks as old age, disability, unemployment, costs of health care, and other instances occasioning the lack of means necessary for a decent existence. In an earlier form (1993), this book proved itself as a much-sought-after introduction to the field, for governments as much as for law students. In this completely revised and updated work, Professor Pieters again offers, this time to a new generation of scholars and policymakers, a common language and structure with which to talk and think about social security. The presentation is both abstract (theory of social security) and concise (structure of social security systems). In taking into account the diversity of ways in which social security has been shaped by priorities of place and time, Dr Pieters delineates the distinct alternatives that can be adhered to in establishing a social security system. He builds a frame in which these various concepts, principles, options, and techniques can be put into perspective. Although this approach hints at a common law of social security, Dr Pieters goes no further in that direction than a brief general survey (in his last chapter) of the possible features of a comparative social security law. Social Security: An Introduction to the Basic Principles is sure to find a welcome among many sectors of the legal and policy communities. Full of insight and information, and eminently readable, the book may be seen in a number of different ways: as a road map explaining the social security systems of various states; as an overview of the various options available for building a social security system; as an exploration of the possibilities of rethinking or reforming an existing system; as the first tentative step toward a scientific discipline of comparative social security law; and much else besides.

Social Security Act by Richard Worth Pdf

The history of the United States is, in large part, the history of its Landmark Legislation. In this series, the authors take the reader behind the scenes to show the drama that led to each bill's being passed and the effect each piece of legislation has had in the development of our country. Each book includes an informative "From Bill to Law" feature, which explains in easy-to-follow fashion how the process of legislation works. Social Security Act tells the story of how workers in America came to be financially protected by government funds in the event of retirement or disability, and the conflicts that have arisen in the seventy years or so since that legislation first passed. Psychosocial Risks in Labour and Social Security Law by Loïc Lerouge Pdf

This book studies a range of legal systems and compares them on their ability to deal with psychosocial risks at work. The book looks at prevention of psychosocial risks from a labor law perspective and at compensation and reparation from a social security law perspective. It pays special attention to the topic of bullying in the work place, which is currently the subject of most legal summons. This book presents the views on the subject from leading national and international experts and provides an in-depth coverage of legal systems used in Southern and Northern European countries, as well as Canada and Japan to deal with this topic. The topic of psychosocial risks at work has received much attention recently, both from the general public, the press, and those working in the legal arena. It is difficult for lawyers to deal with the issue of psychosocial risks at work due to the multifactorial and subjective features involved.

Social Security Law in Poland by Andrzej Marian Świątkowski Pdf

Derived from the renowned multi-volume International Encyclopaedia of Laws, this book describes the social security regime in Poland. It conveys a clear working knowledge of the legal mechanics affecting health care, employment injuries and occupational diseases, incapacity to work, pensions, survivors’ benefits, unemployment benefits and services, and family benefits. The analysis covers the field of application, conditions for entitlement, calculation of benefits, financing, the institutional framework, and relevant law enforcement and controls. Allowances for retirees, employees, public sector workers, the self-employed, and the handicapped are all clearly explained, along with full details of claims, adjudication procedures, and appeals. Succinct yet eminently practical, the book will be a valuable resource for lawyers handling social security matters in Poland. It will be of practical utility to those both in public service and private practice called on to develop and to apply social security law and policy, and of special interest as a contribution to the comparative study of social security systems.

Introduction to European Social Security Law by Frans Pennings Pdf

The social security of the European Union (EU) has become of vital significance for persons living or working in a EU Member State. The creation of the European Economic Area and near accession of the candidate Members (East European countries) has further increased the relevance of this law. This book describes EU social security law, beginning with the rules relevant to migrant workers. Coverage includes Regulations 1408/71 and 574/72 and the case law of the Court of Justice of the EC. The book analyses the contributions of these judgments to the developments of coordination law and to the realisation of the objective of free movement of workers. In this respect the relation of the Regulation and the EC Treaty, which is shown in for instance the Kohll and Decker judgments, is analysed. Special attention is paid to the Proposal for Simplification and Modernisation of Regulation 1408/71. A second main part of EU social security law is the law on equal treatment of men and women. The Court of Justice issued several main decisions, of which the Barber judgment is a wellknown example. Since then, the case law has been further developed and this book helps the reader to understand the present state of affairs. A separate chapter analyses the combat against social exclusion of the EU and the instruments developed for this purpose. This is the completely revised and updated fourth edition of an authoritative book.

The Emergence of Social Security in Canada by Dennis T. Guest Pdf

This book analyzes the major influences shaping the Canadian welfare state. A central trend in Canadian social security over most of the twentieth century has been a shift from a ‘residual’ to an ‘institutional’ concept. The residual approach, which dominated until the Second World War, posited that the causes of poverty and joblessness were to be found within individuals and were best remedied by personal initiative and reliance on the private market. However, the dramatic changes brought about by the Great Depression and the Second World War resulted in the rise of an institutional approach to social security. Poverty and joblessness began to be viewed as the results of systemic failure, and the public began to demand that governments take action to establish front-rank institutions guaranteeing a level of protection against the common risks to livelihood. Thus, the foundations of the Canadian welfare state were established. The Emergence of Social Security in Canada is both an important historical resource and an engrossing tale in its own right, and it will be of great interest to anyone concerned about Canadian social policy.
