The Act of 1888 ex tended this jurisdiction by empowering' the Commission to receive an application from a trader as well. In every possible way the fact was emphasized that the Commission was a court, and therefore no concerned with rate-making. The control of matters pertaining to rates was divided. Powers in regard to conciliation of rate difficulties were given to the Board of Trade. When the provision placing the revision of maxima and of classi fication in the hands of the Board of Trade was under consideration, an amendment to place such revision in the hands of the Commission was negatived. The cases have been arranged as far as possible under the same headings as those used in that book, and the Digest of Scottish Cases on other branches of Railway Law appended to it. English cases on all branches of Railway Law have, however, been included in the present Digest. The last five years have not added much to the public statutory law affecting railways. They have seen the com pletion of the great work of the revision of the rates and charges authorised upon our railway system, which was contemplated by the Railway and Canal Traffic Act of 1888. In 1889-90 the inquiry by the Board of Trade provided for under sect. 24 of that Act was carried out by Lord Balfour of Burleigh and Mr. Courtenay Boyle. In the session of 1891 a Joint-committee of both Houses of Parliament considered the provisional orders embodying the classification and schedules approved by the Board of Trade in the case of nine of the leading English railway companies, and the petitions against them. In 1892 Parliament completed the confirmation of the provisional orders affecting all the railways of the United Kingdom. The new rates and charges came into force on lst January 1893. A basic feature of the modern US administrative state taken for granted by legal scholars but neglected by political scientists and historians is its strong judiciality. Formal, or court-like, adjudication was the primary method of first-order agency policy making during the first half of the twentieth century. Even today, most US administrative agencies hire administrative law judges and other adjudicators conducting hearings using formal procedures autonomously from the agency head. No other industrialized democracy has even come close to experiencing the systematic state judicialization that took place in the United States. Why did the American administrative state become highly judicialized, rather than developing a more efficiency-oriented Weberian bureaucracy? Legal scholars argue that lawyers as a profession imposed the judicial procedures they were the most familiar with on agencies. But this explanation fails to show why the judicialization took place only in the United States at the time it did. Okayama demonstrates that the American institutional combination of common law and the presidential system favored policy implementation through formal procedures by autonomous agencies and that it induced the creation and development of independent regulatory commissions explicitly modeled after courts from the late nineteenth century. These commissions judicialized the state not only through their proliferation but also through the diffusion of their formal procedures to executive agencies over the next half century, which led to a highly fairness-oriented administrative state.
