The International Criminal Court in an Effective Global Justice System by Linda E. Carter,Mark S. Ellis,Charles Chernor Jalloh Pdf

International tribunals need to interface effectively with national jurisdictions, which includes coordination with domestic judicial prosecutions as well as an appreciation for other non-judicial types of transitional justice. In this book, the authors analyze the earlier international tribunals established since the 1990s and the parallel national proceedings for each. In examining the ways in which the ICC can best coordinate with national processes this book considers the ICC’s present interactions with national jurisdictions and the statutory framework of the Rome Statute for interface with national jurisdictions.

Imagining Justice for Syria by Beth Van Schaack Pdf

This book situates the war in Syria within the actual and imagined system of international criminal justice. It explores the legal impediments and diplomatic challenges that have led to the fatal trinity affecting Syria: the massive commission of international crimes that are subject to detailed investigations and documentation but whose perpetrators have enjoyed virtually complete impunity. Given this tragic state of affairs, the book tracks a number of accountability solutions being explored within multilateral initiatives and by civil society actors, including innovations of institutional design; the renewed utility of a range of domestic jurisdictional principles (including the revival of universal jurisdiction in Europe); the emergence of creative investigative and documentation techniques, technologies, and organizations; and the rejection of state consent as a precondition for the exercise of jurisdiction. Engaging both law and policy around international justice, the text offers a set of justice blueprints, within and without the International Criminal Court. It also considers the utility, propriety, and practicality of pursuing a transitional justice program without a genuine political transition. All told, the book attempts to capture results of the creative energy radiating from members of the international community intent on advancing the accountability norm in Syria even in the face of geopolitical blockages within the U.N. Security Council. In so doing, it presents the range of juridical measures-both criminal and civil - that would be available to the international community to respond to the crisis, if only the political will existed.

The Evolution of English Justice by W Mark Ormrod,Anthony Musson Pdf

The importance of the fourteenth century for the development of English law has long been recognised. The shocks and challenges of that period - the murder of the incompetent Edward II, Edward III's ever escalating military demands for the war in France and the unparalleled disaster of the Black Death - gave English society a trauma that found its ultimate expression in Lollardy and the Peasants' Revolt. Out of this ferment came the evolution of a system of justice still substantially recognisable today. This key theme for students of late medieval England has often been made needlessly difficult by the rarefied nature of most books available on the subject. The aim of this book is to present in lucid and approachable terms the main outline of the debate and the different schools of thought, and to suggest the best ways by which students can understand a crucial subject and how this helps illuminate many other aspects of English society during the reigns of Edward II, Edward III and Richard II.

Strategic Litigation and Corporate Complicity in Crimes Under International Law by Kalika Mehta Pdf

This book provides a comprehensive account of how non-state actors rely on international criminal law as a tool in the service of progressive political causes. The argument that international criminal law and its institutions serve as an instrument in the hands of a few powerful states, and that its practice is characterized by double standards and selectivity, has received considerable attention. This book, however, focuses on a practice that is informed by this argument. Its focus is on an alternative practice within international criminal law, where non-state actors navigate what critical scholars call a structurally biased legal system, in order to achieve long-term political objectives. Innovatively, the book combines the concerns expressed by Third World Approaches to International Law with strategic litigation that focuses on the accountability of corporations for their complicity in crimes under international law. Analysing this litigation, the book demonstrates that, while it is crucial to highlight the blind spots of the international criminal legal framework, it is also important to take into account the practice of non-state actors engaged in leveraging its emancipatory potential. This original analysis of the implementation and legitimacy of international criminal law will be of interest to a wide range of scholars and activists working in relevant areas of law, politics, criminology and international relations.

The Palgrave Handbook of Democracy, Governance and Justice in Africa by Aderomola Adeola,Makau W. Mutua Pdf

There is an emerging consensus that what is projected as democratic governance and justice in Africa requires a re-calibration, in particular, in relation to the constitutive demos, human rights, the realisation of commitments at various governance levels and the convergence between these ideations. The post-colonial narrative on democracy has unveiled some crevices in rule of law, political equality, political participation, political culture and freedom of the press. Aside from the fact that these notions are threatened by some existing institutional structures, these notions are increasingly being negotiated across political spaces. Evident in the prevalent narrative is an imperative for Africa to assert its place on the global scene of democratic governance and justice. However, if this will be accomplished, it is important to understand some of the issues that need to be worked through in this transition.

The first room you entered was divided in two by a partition pierced by wicket-windows, the lower portion being solid, the upper consisting of a lattice-work of stout bars. Behind could be seen rows and rows of deed-boxes and bundles of papers ranged on big shelves. In this room M. Moche generally sat, and whenever the outer door opened he would follow suit by throwing open a little window and popping out his head to take stock of the visitor....FROM THE BOOKS.
