Colour-Coded by Constance Backhouse Pdf

Historically Canadians have considered themselves to be more or less free of racial prejudice. Although this conception has been challenged in recent years, it has not been completely dispelled. In Colour-Coded, Constance Backhouse illustrates the tenacious hold that white supremacy had on our legal system in the first half of this century, and underscores the damaging legacy of inequality that continues today. Backhouse presents detailed narratives of six court cases, each giving evidence of blatant racism created and enforced through law. The cases focus on Aboriginal, Inuit, Chinese-Canadian, and African-Canadian individuals, taking us from the criminal prosecution of traditional Aboriginal dance to the trial of members of the 'Ku Klux Klan of Kanada.' From thousands of possibilities, Backhouse has selected studies that constitute central moments in the legal history of race in Canada. Her selection also considers a wide range of legal forums, including administrative rulings by municipal councils, criminal trials before police magistrates, and criminal and civil cases heard by the highest courts in the provinces and by the Supreme Court of Canada. The extensive and detailed documentation presented here leaves no doubt that the Canadian legal system played a dominant role in creating and preserving racial discrimination. A central message of this book is that racism is deeply embedded in Canadian history despite Canada's reputation as a raceless society. Authority in the Modern State by Harold Joseph Laski Pdf

Laski [1893-1950] intended this work to be a sequel to Studies in the Problem of Sovereignty (1917). He argues that sovereignty is best understood as a type of authority, and he supports his case with examples drawn principally from modern French history. After tracing the origins of his subject, Laski considers the significance of Bonald, Lamennais, Royer-Collard and the Syndicalist movement.

Innerworldly Individualism by Adam B. Seligman Pdf

Innerworldly Individualism looks to colonial history, in particular, seventeenth-century New England, to understand the sources of modern nation building. Seligman analyzes how cultural assumptions of collective identity and social authority emerged out of the religious beliefs of the first generation of settlers in New England. He goes on to examine how these assumptions crystallized three generations later into patterns of normative order, forming the foundation of an American consciousness. Seligman uses sociological research grounded in early American history as his laboratory, and does so in a highly original way. Seligman uses Max Weber's paradigm of sociological inquiry to explore how a combination of ideational and structural factors helped to develop modern conceptions of authority and collective identity among New England communities. Seligman addresses a number of significant issues, including social change, the mutual interaction and development of process and structure, and the role of charisma in the forging of a social order. His book profoundly increases our understanding of the ideological and social processes prevalent in early American history as well as their contemporary influence on civil identity. Innerworldly Individualism uniquely intertwines sociological study with cultural history. It uses American history to develop and elucidate problems of broad theoretical significance. Seligman's argument is bolstered by a close examination of concrete detail. His book will be of interest to anthropologists, sociologists, political theorists, and historians of American culture.

Recovering Canada by John Borrows Pdf

Canada is covered by a system of law and governance that largely obscures and ignores the presence of pre-existing Indigenous regimes. Indigenous law, however, has continuing relevance for both Aboriginal peoples and the Canadian state. In his in-depth examination of the continued existence and application of Indigenous legal values, John Borrows suggests how First Nations laws could be applied by Canadian courts, and tempers this by pointing out the many difficulties that would occur if the courts attempted to follow such an approach. By contrasting and comparing Aboriginal stories and Canadian case law, and interweaving political commentary, Borrows argues that there is a better way to constitute Aboriginal / Crown relations in Canada. He suggests that the application of Indigenous legal perspectives to a broad spectrum of issues that confront us as humans will help Canada recover from its colonial past, and help Indigenous people recover their country. Borrows concludes by demonstrating how Indigenous peoples' law could be more fully and consciously integrated with Canadian law to produce a society where two world views can co-exist and a different vision of the Canadian constitution and citizenship can be created.

Colonial Lives of Property by Brenna Bhandar Pdf

In Colonial Lives of Property Brenna Bhandar examines how modern property law contributes to the formation of racial subjects in settler colonies and to the development of racial capitalism. Examining both historical cases and ongoing processes of settler colonialism in Canada, Australia, and Israel and Palestine, Bhandar shows how the colonial appropriation of indigenous lands depends upon ideologies of European racial superiority as well as upon legal narratives that equate civilized life with English concepts of property. In this way, property law legitimates and rationalizes settler colonial practices while it racializes those deemed unfit to own property. The solution to these enduring racial and economic inequities, Bhandar demonstrates, requires developing a new political imaginary of property in which freedom is connected to shared practices of use and community rather than individual possession.
