Although there have been a number of treatises on the nature of judicial review, this volume treats the issue of the results of a statute deemed unconstitutional. "The varying meanings of the process of 'declaring a statute unconstitutional' or unenforceable, the meaning of 'unconstitutionality,' the legal effect of the tainted statute or its defective part, and of the decision branding it, are the subject matter of this scholarly and effective book." Kelsen, Hans. Society and Nature: A Sociological Inquiry. London: K. Kegan Paul, Trench, Trubner & Co., Ltd., [1946]. viii, 391 pp. Reprinted 2000 by The Lawbook Exchange, Ltd. LCCN 99-054869. ISBN 1-58477-064-3. Cloth. $85. * The influential jurist Hans Kelsen [1881-1973] here applies his concept of the distinction between society and nature. He shows how primitive man developed his interpretation of nature, through the laws of retribution and of causality, to a modern concept of nature and society. He holds that the gradual emancipation of the law of causality from the principle of retribution is "the emancipation from a social interpretation of nature. The process shows a relation between social and natural science which is very important from the point of view of intellectual history." (Introduction p. viii) Extensively annotated. Kelsen is known for his theory of pure positive law, as postulated in General Theory of Law and State, which is also available in a reprint edition from The Lawbook Exchange.

Protecting Minority Rights in African Countries by John M. Mbaku Pdf

In this enlightening book, John Mukum Mbaku analyses the main challenges of constitutional design and the construction of governance institutions in Africa today. He argues that the central issues are: providing each country with a constitutional order that is capable of successfully managing sectarian conflict and enhancing peaceful coexistence; protecting the rights of citizens - including those of minorities; minimizing the monopolization of political space by the majority (to the detriment of minorities); and, effectively preventing government impunity. Mbaku offers a comprehensive analysis of various approaches to the management of diversity, and shows how these approaches can inform Africa's struggle to promote peace and good governance. He explores in depth the existence of dysfunctional and anachronistic laws and institutions inherited from the colonial state, and the process through which laws and institutions are formulated or constructed, adopted, and amended. A close look at the constitutional experiences of the American Republic provides important lessons for constitutional design and constitutionalism in Africa. Additionally, comparative politics and comparative constitutional law also provide important lessons for the management of diversity in African countries. Mbaku recommends state reconstruction through constitutional design as a way for each African country to provide itself with laws and institutions that reflect the realities of each country, including the necessary mechanisms and tools for the protection of the rights of minorities. From students and scholars to NGOs, lawyers and policymakers, this unique and judicious book is an essential tool for all those seeking to understand and improve governance and development in Africa.

The Constitutional History of England by Frederic William Maitland Pdf

Originally published: Cambridge: Cambridge University Press, 1908. xxviii, 547 pp. Although Maitland never intended to publish these lectures, they have long been regarded as one of the best introductions to the English Constitution. Delivered in the winter of 1887 and spring of 1888, and edited and published in 1908 by one of Maitland's students, Herbert A.L. Fisher, they cover the period from 1066 to the end of the nineteenth century. Rather than a narrative historical format, they focus on describing the work of the constitution during five distinct moments in English history: 1307, 1509, 1625, 1702 and 1887. They provide an entry to some of the major concepts he later expounded in his seminal work written with Sir Frederick Pollock, The History of English Law. Widely considered the father of modern legal history, FREDERIC WILLIAM MAITLAND 1850-1906] was an English jurist and historian best known for The History of English Law Before the Time of Edward I (1895), written with Sir Frederick Pollock. He was educated at Eton and Cambridge and studied at Lincoln's Inn, London. Maitland was called to the bar in1876 and practiced until 1884, when he became a reader in English law (1884) and professor (1888) at Cambridge. He founded the Selden Society in 1887. Hailed for his original outlook on history, his works had a profound influence on legal scholarship and remain important today.

A Fragment on Government by Jeremy Bentham Pdf

Bentham, Jeremy. A Fragment on Government. Edited with an Introduction by F.C. Montague. Oxford: The Clarendon Press, 1891. xii, 241 pp. Reprinted 2001 by The Lawbook Exchange, Ltd. ISBN 1-58477-166-6. Cloth. $65. * Bentham's first published work, an essay on sovereignty that criticizes Blackstone's Commentaries and attacks contemporary views on politics and law. This edition includes F.C. Montague's scholarly introduction that shows the significance of the Fragment and includes a biography of Bentham [1748-1832] and a discussion of his role in the history of jurisprudence. "The Fragment on Government is primarily a criticism. If it were nothing more, it would have no interest for later generations, which do not regard Blackstone as an authority upon speculative questions of politics or history, and therefore do not need to have Blackstone's theories corrected or disproved. But in criticizing Blackstone's views, Bentham necessarily expounds his own. As Bentham is one of the few English writers of mark upon the theory of political institutions, and as his doctrine forms a link in the chain of English political philosophy, we still read the Fragment of Government in order to see, not how far Blackstone was wrong, but how far Bentham was right.": Introduction 59.
