A Practical Treatise on the Law of Slavery (Classic Reprint) by Jacob D. Wheeler Pdf

Excerpt from A Practical Treatise on the Law of Slavery The court observed that the term mulatto, as used in this state, was vague, and signified, in general, a person of mixed white and negro blood, in whatever proportions it might be mingled. The various distinctions which have obtained in the French and Spanish American colonies has not been adopted in this state. Harper J in delivering the opinion of the court, observed, that it seemed to be an error in the judge's charge to the jury, in stating, that a mulatto was the offspring of parents, one of whom was white, and the other black, and that he was disposed to think, that where the White blood predominated, the disqualifica tion ought not to attach. According to this instruction, we understand, that the child of a quadroon and a mulatto, according to the distinction in Louisiana, must be accounted white. Yet, I suppose, that even in Louisiana such a person would be called a mulatto It is certainly true, as laid down by the presiding judge, that every admixture of African blood with the European, or white, is not to be referred to the degraded class. It would be dan gerous and cruel to subject to this disqualification a person hearing all the features of a white, on account of some remote admixture of negro blood nor has the term mulatto, or person of color, I believe. A Practical Treatise on the Law Relating to the Specific Performance of Contracts (Classic Reprint) by Edmund Chisholm Batten Pdf

Excerpt from A Practical Treatise on the Law Relating to the Specific Performance of Contracts The Common Law of England does not accord in this respect with the rules of natural justice. The party in whose favour an executory agreement is made, is entitled by the Common Law to damages only, in the event of its being unperformed (a). Thus if a man covenant to settle his lands upon his marriage, or to convey them for a valuable con sidera tion; the covenantee, at common law, can only recover damages for the breach of such covenant, and has no remedy there, to enforce the settlement or conveyance of the lands themselves. A Practical Treatise on the Law of Covenants (Classic Reprint) by Thomas Platt Pdf

Excerpt from A Practical Treatise on the Law of Covenants The utility of works expressly devoted to the investigation of particular branches of jurisprudence, has been universally acknowledged; and it is a matter of surprise, that, among the numerous valuable text books already published, the Law of Covenants has not been made the subject of a distinct treatise. With the view of supplying the defect, the Author undertook the heavy responsibility of composing this volume. To collect, analyze, and reduce into order, the mass of confused, and frequently contradictory cases on the subject; to expound their general principles; and to exhibit, in a connected and comprehensive form, the actual state of the Law of Covenants at the present day, was the serious duty he imposed upon himself. With what degree of success his endeavours may have been attended, he is afraid to contemplate. Had he been aware of the difficulties incident to the progress of his labours, he might, perhaps, have abandoned his intention, and have left the task to others more competent to carry it into execution.
