Excerpt from A Treatise of the Law of Descents In pursuing a systematic of study of the Law relative to Real Property, the Author has observed that there is no comprehensive treatise on one branch of the subject which is of the greatest importance; "The Law of Descents" The Essay by Mr. Watkins merely contains observations on some particular points; and was not designed as a General Treatise on this subject, which has not hitherto been sufficiently brought together in one comprehensive view. This consideration has induced the Author to bestow much time and research in endeavouring to arrange every decision to be found in the books, with the observations of elementary writers, under appropriate heads; and he trusts that the following pages may be found of some practical utility. In order to arrive by a systematic method at the immediate subject of the Work, the Introductory Chapter was framed with a view to consider the nature of property in general, - the division of property into its several quantities and qualities of estates, - and concludes by a general statement of the modes of acquiring Real Property, viz. by Purchase or by Descent; the latter being intended as the topic of discourse in the following Work. Likewise, in considering the questions on which the courts are not agreed, the states have been tabulated in alphabetical order, and reference made to the principal and the latest decision in each state where decisions on the question are found.
