A Treatise on the Application of Payments by Debtor to Creditor by George G. Munger Pdf

Excerpt from A Treatise on the Application of Payments by Debtor to Creditor: Being a Complete Compilation of the Law Pertaining to the Rights of Debtor and Creditor Respectively; And Also Giving the Various Rules for the Guidance of the Courts When No Appropriation Has Been Made by the Parties He discovered that not only was there no separate treatise embodying the law in clear and concise form, but even that there was not any systematic and exhaustive col lection of its doctrines and rules anywhere. A chapter, of greater or less length, in some work com prising a wide range of subjects, where none received more than a general treatment; a note in some book of cases displaying more or less industry in collecting the authorities, but without much attempt at method or arrangement, and one or two magazine articles, summed up all that had been written upon the subject. For any further investigation recourse must be had to the digests or to the reports them selves. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. A Treatise on the Law of Private Arrangements With Creditors by George Young Robson Pdf

Excerpt from A Treatise on the Law of Private Arrangements With Creditors: With an Appendix Containing the Deeds of Arrangement Act, 1887, the Bills of Sale Acts, 1878 and 1882, and the Bankruptcy (Discharge and Closure) Act, 1887 Deeds for effecting private arrangements between insolvent debtors and their creditors, with a view to a rateable distribution of the residue of the property of such debtors amongst their creditors towards payment of the debts owing to them, or of a composition in satisfaction thereof, and thus avoiding bankruptcy, have been long in use. Great difficulties, however, formerly existed in effecting such arrangements, owing partly to the fact that an assignment of all a debtor's property for the benefit of his creditors was held to be an act of bankruptcy, and avoidable by assignees in bankruptcy under their title by relation, which formerly extended back to the first act of bank ruptcy committed by the bankrupt, so as to avoid all alienations or dispositions of property made by him after that time; and partly to the fact that an arrangement of this sort bound only those creditors who assented to it, and was liable to be superseded by a dissenting creditor instituting proceedings in bankruptcy against the debtor. A Treatise on Fraudulent Conveyances and Creditors' Bills by Frederick Scott Wait Pdf

Excerpt from A Treatise on Fraudulent Conveyances and Creditors' Bills: With a Discussion of Void and Voidable Acts It is needless to repeat the criticisms advanced in the body of the work upon the tendency manifested in certain authorities to close some of the sources of relief formerly available to complainants. The creditor's power to im prison the debtor or inflict personal punishment upon him, and coerce payment in that way, is practically destroyed; hence, we urge, remedies against property rights and inter ests should be strengthened and perfected. A policy under which a debtor can enjoy a beneficial interest in property 'by such a title that creditors cannot touch it is not to be encouraged or commended.
