Retroactivity and the Common Law by Ben Juratowitch Pdf

This book analyses the common law's approach to retroactivity. The central claim is that when a court considers whether to develop or change a common law rule the retroactive effect of doing so should explicitly be considered and, informed by the common law's approach to statutory construction, presumptively be resisted. As a platform for this claim a definition of 'retroactivity' is established and a review of the history of retroactivity in the common law is provided. It is then argued that certainty, particularly in the form of an ability to rely on the law, and a conception of negative liberty, constitute rationales for a general presumption against retroactivity at a level of abstraction applicable both to the construction of statutes and to developing or changing common law rules. The presumption against retroactivity in the construction of statutes is analysed, and one conclusion reached is that the presumption is a principle of the common law independent of legislative intent. Across private, public and criminal law, the retroactive effect of judicial decisions that develop or change common law rules is then considered in detail. 'Prospective overruling' is examined as a potential means to control the retroactive effect of some judicial decisions, but it is argued that prospective overruling should be regarded as constitutionally impermissible. The book is primarily concerned with English and Australian law, although cases from other common law jurisdictions, particularly Canada and New Zealand, are also discussed. The conclusion is that in statutory construction and the adjudication of common law rules there should be a consistently strong presumption against retroactivity, motivated by the common law's concern for certainty and liberty, and defeasible only to strong reasons. 'Ben Juratowitch not only gives an account of the operation of the presumption, but also teases out the policies which underlie the different rules. This is particularly welcome. Lawyers and judges often seem less than sure-footed when confronted by questions in this field. By giving us an insight into the policies, the author provides a basis for more satisfactory decision-making in the future. ...The author not only discusses the recent cases but examines the question in the light of authority in other Commonwealth jurisdictions and with due regard to the more theoretical literature. This is a valuable contribution to what is an important current debate in the law. Happily, Ben Juratowitch has succeeded in making his study not only useful, but interesting and enjoyable.' From the Foreword by Lord Rodger of Earlsferry

I Don't Need an Acting Class by Milton Justice Pdf

I Don't Need an Acting Class explores critical aspects of the technique of acting, utilizing conversations via email with countless actors. Some are aspiring students, others are seasoned professionals. The conversations document the challenges these diverse actors face as they digest what they have learned in a class or rehearsal while exploring in practical terms how to use their growing technique. Milton Justice first began receiving emails from actors in 2008. In this book, Justice brings together email conversations between teacher and student, along with observations and commentary about acting technique and craft. Not all of the emails in the book are overly thought-out or complete. Quite the contrary, they are meant to capture the feeling of a living, breathing process as it happens. When an actor sends a teacher or director an email with a problem, be it a simple comment or confusion, it is evidence of a creative artist exploring new ground. Many years ago, Stella Adler sent Justice a letter in response to a panicked note he had written to her while lost in the weeds during rehearsals for a new play. She set a tone for him as she succinctly defined the problem and reminded him of its elegant solution. He was overwhelmed by the care she had given him. That letter still hangs over his desk, perfectly demonstrating the power of a written exchange between a teacher and a student.

Sanford Meisner was one of the best known and beloved teachers of acting in the country. This book follows one of his acting classes for fifteen months, beginning with the most rudimentary exercises and ending with affecting and polished scenes from contemporary American plays. The Actor's Art and Craft by William Esper,Damon Dimarco Pdf

William Esper, one of the leading acting teachers of our time, explains and extends Sanford Meisner's legendary technique, offering a clear, concrete, step-by-step approach to becoming a truly creative actor.Esper worked closely with Meisner for seventeen years and has spent decades developing his famous program for actor's training. The result is a rigorous system of exercises that builds a solid foundation of acting skills from the ground up, and that is flexible enough to be applied to any challenge an actor faces, from soap operas to Shakespeare. Co-writer Damon DiMarco, a former student of Esper's, spent over a year observing his mentor teaching first-year acting students. In this book he recreates that experience for us, allowing us to see how the progression of exercises works in practice. The Actor's Art and Craft vividly demonstrates that good training does not constrain actors' instincts—it frees them to create characters with truthful and compelling inner lives.

Acting Power by Robert Cohen Pdf

‘Robert Cohen’s book, Acting Power, follows the tradition of his other book, Acting One, and has been the veritable bible for acting teachers for the last quarter century.’ – David Krasner, Emerson College ‘This book, above all else, is an attempt to explore the qualities of acting power.... to suggest to you, the actor, an approach toward not merely good acting but powerful acting. Great actors display the power to frighten – and the power to seduce – and can shift between the one and the other like a violinist can her notes.’ – From the Preface The first edition of Acting Power was a groundbreaking work of acting theory which applied sociological and psychological principles to actor training. The book went on to influence a generation of theatre and performance studies students and academics, and was translated into five languages. This carefully revised 21st Century Edition (re)considers, in the context of today’s field: questions such as ‘should actors act from the inside or the outside?’ and ‘should the actor live the role or present the role?’; contemporary research into communication theory, cybernetics, and cognitive science; brilliantly illuminating and witty exercises for solo study and classroom use, and a through-line of useful references to classic plays; penetrating observations about the actor’s art by more than 75 distinguished professional actors and directors. Cohen’s elegant and rigorous updates emphasise the continuing relevance of his uniquely integrated and life-affirming approach to this field. The new edition draws on his extraordinarily rich career as teacher, scholar, director, translator and dramaturg. It is a recipe for thrilling theatre in any genre.

This collection offer a series of new essays authored by leading scholars of Latin American and U.S. Latino theater as well as the performance script Mexterminator vs. The Global Predator, written by Guillermo Gomez-Pena. The fourteen essays focus on contemporary Latin American and U.S. Latino plays and performances and challenge the meanings of genre, gender, race, cultural identity, and performance itself in the context of globalization and shifting borders. The concept of trans/acting, a term that connotes negotiation and/or exchange, provides the framework for essays that include such topics as tansculturation, transnationalism, transgender, transgenre, translation, and adaptation. These individual studies of contemporary theater and performance arts are complimented by trans/actor Gomez-Pena's Mexterminator vs. The Global Predator, a striking transgressive script that underscores the performance nature of territorial and symbolic border crossings. Jacqueline Bixler is Alumni Distinguished Professor of Spanish at Virginia Tech. Laurietz Seda is Associate Professor of Spanish at the University of Connecticut-Storrs.

(toward) a phenomenology of acting by Phillip Zarrilli Pdf

In (toward) a phenomenology of acting, Phillip Zarrilli considers acting as a ‘question’ to be explored in the studio and then reflected upon. This book is a vital response to Jerzy Grotowski’s essential question: "How does the actor ‘touch that which is untouchable?’" Phenomenology invites us to listen to "the things themselves", to be attentive to how we sensorially, kinesthetically, and affectively engage with acting as a phenomenon and process. Using detailed first-person accounts of acting across a variety of dramaturgies and performances from Beckett to newly co-created performances to realism, it provides an account of how we ‘do’ or practice phenomenology when training, performing, directing, or teaching. Zarrilli brings a wealth of international and intercultural experience as a director, performer, and teacher to this major new contribution both to the practices of acting and to how we can reflect in depth on those practices. An advanced study for actors, directors, and teachers of acting that is ideal for both the training/rehearsal studio and research, (toward) a phenomenology of acting is an exciting move forward in the philosophical understanding of acting as an embodied practice.
