While water is an increasingly scarce resource, most existing methods to allocate it are neither economically nor environmentally efficient. In these circumstances, water markets offer developed countries a form of regulatory response capable of overcoming many of the shortcomings of current water management. The debate on water markets is, however, a polarized one. This is mostly a result of the misunderstanding of the roles played by governments in water markets. Proponents mistakenly portrayed them as leaving governments, for the most part, out of the picture. Opponents, in turn, understand commodification of water and administration by public agencies as incompatible. Casado Pérez argues that both sides of the debate overlook that water markets require a deeper and more varied governmental intervention than markets for other goods. Drawing on economic theories of regulation based on market failure, she explains the different roles governments should play to ensure a well-functioning water market, and concludes that only the visible hand of governments can ensure the success of water markets. River systems around the world are degraded and are being used unsustainably. Meeting this challenge requires the development of flexible regimes that have the potential to meet essential consumptive needs while restoring environmental flows. This book focuses on how water trading frameworks can be repurposed for environmental water recovery and aims to conceptualise the most appropriate role for law in supporting recovery through these frameworks. The author presents a comprehensive study of the legal frameworks in four jurisdictions: the States of Oregon and Colorado in the western United States; the province of Alberta in Canada; and the Murray-Darling Basin in Australia/Basin State of New South Wales. A close comparative analysis of these four jurisdictions reveals a variety of distinctive regulatory arrangements and collaborations between public and private actors. In all cases, the law has been deployed to steer and coordinate these water governance activities. The book argues that each regime is based on a particular regulatory strategy, with different conceptions of the appropriate roles for, and relationships between, various actors and institutions. Legal frameworks do not have the capacity to rationalise and provide an overarching and absolute solution to the complex environmental and governance issues that arise in the context of environmental water transactions. Rather, the role of law in this context needs to be reconceptualised within the paradigm of regulatory capitalism as establishing and maintaining the limits within which regulatory participants can operate, innovate and collaborate.

This book assesses both the effectiveness and efficiency of implemented Economic Policy Instruments (EPIs) in order to achieve water policy goals and identifies the preconditions under which they outperform alternative (e.g. regulatory) policy instruments and/or can complement them as part of complex policy mixes. The development of a consolidated assessment framework helps clarify (and where possible, quantify) the effectiveness of each EPI on the basis of different criteria. Outcome-oriented criteria describe how the EPIs perform. They include intended and unintended economic and environmental outcomes and the distribution of benefits and costs among the affected parties. These steps consider the application of cost effectiveness and cost benefits analysis, e.g. to assess ex-post performance of the EPI. Process criteria describe the institutional conditions (legislative, political, cultural, etc.) affecting the formation and operation of the EPI studied (particularly relevant for assessing the possible impacts of using economic instruments), the transaction costs involved in implementing and enforcing the instruments and the process of implementation. Case studies from Cyprus, Denmark, France, Germany, Hungary, Italy, the Netherlands, Spain and the United Kingdom, as well as from Australia, Chile, Israel and the USA are presented in this book. A wide variety of EPIs are also covered, including water-pricing schemes (tariffs, environmental taxes, environmental charges or fees, subsidies on products and practices), trading schemes (tradable permits for abstraction and pollution) and cooperation mechanisms.

Most of the world's freshwater resources in the liquid state (i.e. not in glaciers and polar caps) are underground. As the population grows and demand for water rises, reliance on groundwater increases. In many cases the groundwater underlies boundaries, or is part of a hydraulic system that crosses boundaries. In such cases there is always the danger that the 'prisoner's dilemma' will run its course and all parties will compete over who will pump the most water, ultimately destroying the storage potential to the detriment of future generations of all parties reliant on the groundwater. This book explores the options and means for averting this all too realistic scenario by managing these shared groundwater resources. Nowhere is the likelihood of excessive use of groundwater greater than in the water-scarce Middle East, and especially in the Israeli-Palestinian case. Here both sides are heavily reliant on a shared aquifer, the Mountain aquifer. This book is the outcome of a seven-year effort to find ways to manage the Mountain aquifer, perhaps the most important resource shared by Israelis and Palestinians. As part of this cooperative study, four workshops were held in which a selected number of Palestinian, Israeli, and foreign experts were invited. The chapters in this book were originally presented in one of these workshops. To these papers introductory and concluding chapters were added.
