Confiscation in Private International Law by Pieter Adriaanse Pdf

was discussed by the Institut de Droit International at Siena 1 and recently, in 1954, it was the principal item of the meeting of the Netherlands Branch of the International Law Association 2. This study aims at contributing to the not too extensive literature on the subject. 11. BACKGROUND One cannot consider law and justice without considering at the same time the people whom they concern. And people again cannot be imagined without feelings, political and social views, and economic interests. The law could not exist without such a background. The history of various acts of confiscation in the twentieth century proves the enormous importance of the back ground underlying these problems. Russian confiscations are in the light of the Bolshevist doctrine only becoming intelligible of revolution; the M exicanization of the oil industry is in keeping with Mexican social development preceding it; the confiscations which took place in Germany under the Nazi regime must be understood as the outcome of a certain ideology; unfortunately confiscations due to operations in time of war are self-explana tory. A single school of thought governs each one alike: rights of individuals are considered of less and less importance. It was not by chance that the infringement of private property, notably in the great political upheavals, often went hand in hand with a dedining interest in the protection of the individual freedom. Where the state infringes the proprietary rights of individuals, it will even more readily do the same as regards personal freedom.

Principles of the Conflict of Laws National and International by K. Lipstein Pdf

The present volume reproduces with slight changes the course of lectures given at The Hague in 1972 under the title of "The General Principles of Private International Law". The substance of these lec tures has remained unaltered, but a number of insertions serve to cor rected some formal mistakes and misprints, added references to literature, some older, some more recent, without attempting to be exhaustive, and modified and supplemented the former exposition in two respects, where subsequent criticisms called for a review. The first concerns the place of public policy in Public International Law, the second deals with spatially-

Netherlands Yearbook of International Law 2018 by Janne E. Nijman,Wouter G. Werner Pdf

This volume of the Netherlands Yearbook of International Law explores the many faces of populism, and the different manifestations of the relationship between populism and international law. Rather than taking the so-called populist backlash against globalisation, international law and governance at face value, this volume aims to dig deeper and wonders ‘What backlash are we talking about, really?’. While populism is contextual and contingent on the society in which it arises and its relationship with international law and institutions thus has differed likewise, this volume assists in our examination of what we find so dangerous about populism and problematic in its relationship with international law. The Netherlands Yearbook of International Law was first published in 1970. It offers a forum for the publication of scholarly articles in a varying thematic area of public international law./div

Introduction to Dutch Law by Larissa van den Herik,Ewoud Hondius,Wim Voermans Pdf

A standard legal resource since its first edition in 1978, this matchless book has proven itself the ideal overview of Dutch law for foreign lawyers. This Sixth Edition fully updates its systematic description of the legal sources, institutions, and concepts in all major fields of law. Recent developments covered include the progressive implementation of standards set by international conventions, the reorganization of the judiciary, the statute on environmental law, and the (re)codification of private international law. The continuing influence of European law is evident in many fields, perhaps most notably in family law. The various chapters are written by experts - scholars and lawyers - in particular fields, and provide an authoritative overview of each field. The historical sources of Dutch law are discussed, as well as Dutch legal culture, legal philosophy, judicial organization, legal education, and the legal profession. These chapters are followed by introductions to essential issues of private and public law and labour law. The last chapter examines financial law. The only resource of its kind available, this book is unmatched as a thorough guide to further research. It offers practitioners, particularly foreign lawyers, a quick and reliable way into any area of Dutch law that they may be required to research. It will also be of great value to comparatists (especially those studying the influence of European law on national legal systems), scholars, and students. Like previous editions, the Sixth Edition has been prepared under the auspices of the Netherlands Comparative Law Association.

Recueil des Cours:Collected Courses of the Hague Academy of International Law by Academie de Droit International de la Haye Pdf

"In this course devoted to the American approach of the international process of progressive development of private international law, Peter Pfund, Assistant Legal Adviser at the US Department of State, hopes to demystify the international process of unification/harmonization of "private" law at the international level. This study is primarily focused on the process of harmonization as such. Peter Pfund starts his course by a general introduction to the international unification of private international law. He explains in what follows how the United States prepares for and participates in international meetings and conferences, ratifies conventions, and seeks to make the conventions concerning private international law work. Peter Pfund then looks at the role of the United States in intergovernmental negotiations and the success of conventions, at the model laws and rules that are its results, at the major current and future projects, and at the usefulness of the unification/harmonization of private international law. The author then presents the 1980 United Nations Convention on contracts for the international sale of goods as an example of the international and United States domestic processes. Lastly, he analyses the 1993 Hague Intercounty Adoption Convention: problems confronting the United States in its negotiation, and issues that need to be resolved in order to ratify the convention"--Publisher's description.

Global Private International Law by Horatia Muir Watt,,Lucia Bíziková,Agatha Brandão de Oliveira,Diego P. Fernandez Arroyo Pdf

Providing a unique and clearly structured tool, this book presents an authoritative collection of carefully selected global case studies. Some of these are considered global due to their internationally relevant subject matter, whilst others demonstrate the blurring of traditional legal categories in an age of accelerated cross-border movement. The study of the selected cases in their political, cultural, social and economic contexts sheds light on the contemporary transformation of law through its encounter with conflicting forms of normativity and the multiplication of potential fora.
