Exemptions for the Non-performance of Contractual Obligations in CISG Article 79 by Peter J. Mazzacano Pdf

"The premise of this dissertation is that Article 79 of the UN Convention on Contracts for the International Sale of Goods-which concerns exemptions for contractual non-performance due to an ""impediment"" beyond a party's control-should be interpreted autonomously, that is, as an international norm, without reference to domestic legal concepts and principles. To this end, this dissertation considers the application of Article 79 by courts and arbitral tribunals across a number of signatory states. By studying the treatment of Article 79 by the courts and arbitral tribunals of various states, differences in doctrine and case law have been discerned. The extent of conceptual differences towards the doctrine of excuses for nonperformance also helps to determine whether the CISG's goal of uniformity is achievable. This research concludes that there has been a convergence in the treatment of Article 79, and this supports the premise that a legal doctrine-in this case, the excuse for non- performance-germinating in various legal systems, ultimately evolved into an autonomous principle, towards a conceptual goal of uniformity in a body of international commercial law, regardless of its unique development in separate and distinct legal jurisdictions. The Moral Rights of Animals by Mylan Engel,Gary Lynn Comstock Pdf

Edited by Mylan Engel Jr. and Gary Lynn Comstock, this book employs different ethical lenses, including classical deontology, libertarianism, commonsense morality, virtue ethics, utilitarianism, and the capabilities approach, to explore the philosophical basis for the strong animal rights view, which holds that animals have moral rights equal in strength to the rights of humans, while also addressing what are undoubtedly the most serious challenges to the strong animal rights stance, including the challenges posed by rights nihilism, the “kind” argument against animal rights, the problem of predation, and the comparative value of lives. In addition, contributors explore the practical import of animal rights both from a social policy standpoint and from the standpoint of personal ethical decisions concerning what to eat and whether to hunt animals. Unlike other volumes on animal rights, which focus primarily on the legal rights of animals, and unlike other anthologies on animal ethics, which tend to cover a wide variety of topics but only devote a few articles to each topic, this volume focuses exclusively on the question of whether animals have moral rights and the practical import of such rights. The Moral Rights of Animals will be an indispensable resource for scholars, teachers, and students in the fields of animal ethics, applied ethics, ethical theory, and human-animal studies, as well as animal rights advocates and policy makers interested in improving the treatment of animals.

Slavery and the Birth of an African City by Kristin Mann Pdf

As the slave trade entered its last, illegal phase in the 19th century, the town of Lagos on West Africa's Bight of Benin became one of the most important port cities north of the equator. Slavery and the Birth of an African City explores the reasons for Lagos's sudden rise to power. By linking the histories of international slave markets to those of the regional suppliers and slave traders, Kristin Mann shows how the African slave trade forever altered the destiny of the tiny kingdom of Lagos. This magisterial work uncovers the relationship between African slavery and the growth of one of Africa's most vibrant cities.

Antifascisms by David Ward Pdf

This book is an in-depth analysis of three of the most crucial years in twentieth-century Italian history, the years 1943-46. After more than two decades of a Fascist regime and a disastrous war experience during which Italy changed sides, these years saw the laying of the political and cultural foundations for what has since become known as Italy's First Republic. Drawing on texts from the literature, film, journalism, and political debate of the period, Antifascisms offers a thorough survey of the personalities and positions that informed the decisions taken in this crucial phase of modern Italian history.

Sources and Methods in African History by Toyin Falola,Christian Jennings Pdf

An overview of the ongoing methods used to understand African history. Spurred in part by the ongoing re-evaluation of sources and methods in research, African historiography in the past two decades has been characterized by the continued branching and increasing sophistication of methodologies and areas of specialization. The rate of incorporation of new sources and methods into African historical research shows no signs of slowing. This book is both a snapshot of current academic practice and an attempt to sort throughsome of the problems scholars face within this unfolding web of sources and methods. The book is divided into five sections, each of which begins with a short introduction by a distinguished Africanist scholar. The first sectiondeals with archaeological contributions to historical research. The second section examines the methodologies involved in deciphering historically accurate African ethnic identities from the records of the trans-Atlantic slave trade. The third section mines old documentary sources for new historical perspectives. The fourth section deals with the method most often associated with African historians, that of drawing historical data from oral tradition. Thefifth section is devoted to essays that present innovative sources and methods for African historical research. Together, the essays in this cutting-edge volume represent the current state of the art in African historical research. Toyin Falola is the Jacob and Frances Sanger Mossiker Chair in the Humanities and University Distinguished Teaching Professor at the University of Texas at Austin. Christian Jennings is a Doctoral Candidatein History at the University of Texas at Austin.

Human Rights and World Public Order by Myres S. McDougal,Lung-Chu Chen Pdf

In 1980, Professors McDougal, Lasswell, and Chen published the original edition of Human Rights and World Public Order to present a "comprehensive framework of inquiry" from which to approach international human rights law, and international law, and inadequacies therein in the discourse of that time by combining theme, structure, method, and process. As a classic text of the New Haven School of International Law, this book explores human rights and international law in the broadest sense, taking into account social sciences research while embracing all values secured, or consequently fulfilled, or needed to thus be achieved. The book endured as a lasting contribution that reframed human rights within the New Haven School tradition, and as a magnificent work of scholarship freed from the confines of positivism and the static concerns of any one political or historical period. Co-author Lung-chu Chen spearheaded the re-issuance of this venerable title, complete with a contemporary, fresh Introduction to unveil this work to a new generation of scholars, students, and practitioners of international law and human rights. This Introduction surveys the major developments in human rights since 1980, including many doctrines and concepts that have emerged since. It covers contemporary events to provide today's readers with the opportunity to contextualize the chapters and to apply the book's framework to future endeavors.
