An Elected Second Chamber by Great Britain. Ministry of Justice Pdf

This white paper sets out the Government's proposals for a reformed second chamber. It stems from the constructive discussions in a Cross-Party Group on House of Lords Reform, which followed the March 2007 Parliamentary votes on the proposals contained in the February 2007 white paper ("The House of Lords: reform", Cm. 7027, ISBN 9780101702720). The Group reached consensus on a number of key issues, and this paper states where agreement was not reached. The white paper sets the context for decisions on House of Lords reforms and goes on to consider issues around, and options for, electoral systems. The effect of different electoral systems is examined against two scenarios: that the House is either 100 per cent or 80 per cent elected. The paper then looks at the powers of the second chamber. It suggests possible arrangements for any appointed elements, but there are no concrete proposals yet. Finally the white paper addresses other issues around the operation of a reformed second chamber and explores transitional arrangements.

On which basis should the house of lords be reformed by Saskia Mahlstede Pdf

Essay from the year 2005 in the subject Politics - Region: Western Europe, grade: 66% (1,7), University of the West of England, Bristol, language: English, abstract: House of Lords reform has been talked about for over a century, but the subject has been of most recent attention as, in 1999, Tony Blair’s New Labour Party introduced a reform for the Upper Chamber to make it more representative and democratic. But the government only conducted the first stage of this reform, consisting in a merely partial abolition of the hereditary peers. Since then, the composition of the House of Lords is only temporary while proposals for a second reform stage are being discussed for five years now. The aim of this paper is to analyze on which basis the House of Lords should be reformed.

Reform of the House of Lords by Philip Norton Pdf

This book is the only one of its kind, providing a clear and exhaustive analysis of the different approaches to the future of Britain's second chamber. The House of Lords has long been the subject of proposals for reform some successful, others not and calls for the existing membership to be replaced by elected members have been a staple of political debate. The debate has been characterised by heat rather than light, proponents and opponents of change often talking past one another. This work gives shape to the debate, drawing out the role of the House of Lords, previous attempts at reform, and the different approaches to the future of the House. It develops the argument for each and analyses the current state of the debate about the future of the upper house in Britain's political system.

Federalism and Second Chambers by Wilfried Swenden Pdf

The theory of comparative federalism asserts that federations require a second chamber for the representation of regional interests in central law-making. Yet there has been little systematic analysis of the contribution of second chambers in parliamentary federations to this task. The main purpose of this book is to demonstrate to what extent the two strongest parliamentary second chambers, the Australian Senate and the German Bundesrat are linked to the federal structures in which they are embedded. The study analyzes the contribution of the members of these second chambers in advancing interests that are linked to the regional constituents whom they represent or to the collective fiscal or administrative interests of a regional government with whom they are associated. The analysis underscores the largely 'executive' character of intergovernmental relations in parliamentary federations, a feature that corresponds with the composition of the German Bundesrat, but not of the Australian Senate. In the concluding chapter some preliminary observations are made as to whether our findings also generate interesting insights for the larger group of parliamentary second chambers in federal or quasi-federal states, such as the Belgian, Spanish and Canadian Senates, the UK House of Lords and the Indian Raiya Sabha.

The UK's Changing Democracy by Patrick Dunleavy, Alice Park, Ros Taylor Pdf

The UK’s Changing Democracy presents a uniquely democratic perspective on all aspects of UK politics, at the centre in Westminster and Whitehall, and in all the devolved nations. The 2016 referendum vote to leave the EU marked a turning point in the UK’s political system. In the previous two decades, the country had undergone a series of democratic reforms, during which it seemed to evolve into a more typical European liberal democracy. The establishment of a Supreme Court, adoption of the Human Rights Act, Scottish, Welsh and Northern Irish devolution, proportional electoral systems, executive mayors and the growth in multi-party competition all marked profound changes to the British political tradition. Brexit may now bring some of these developments to a juddering halt. The UK’s previous ‘exceptionalism’ from European patterns looks certain to continue indefinitely. ‘Taking back control’ of regulations, trade, immigration and much more is the biggest change in UK governance for half a century. It has already produced enduring crises for the party system, Parliament and the core executive, with uniquely contested governance over critical issues, and a rapidly changing political landscape. Other recent trends are no less fast-moving, such as the revival of two-party dominance in England, the re-creation of some mass membership parties and the disruptive challenges of social media. In this context, an in-depth assessment of the quality of the UK’s democracy is essential. Each of the 2018 Democratic Audit’s 37 short chapters starts with clear criteria for what democracy requires in that part of the nation’s political life and outlines key recent developments before a SWOT analysis (of strengths, weaknesses, opportunities and threats) crystallises the current situation. A small number of core issues are then explored in more depth. Set against the global rise of debased semi-democracies, the book’s approach returns our focus firmly to the big issues around the quality and sustainability of the UK’s liberal democracy.

House of Commons Procedure and Practice by Canada. Parliament. House of Commons,Robert Marleau,Camille Montpetit Pdf

This reference book is primarily a procedural work which examines the many forms, customs, and practices which have been developed and established for the House of Commons since Confederation in 1867. It provides a distinctive Canadian perspective in describing procedure in the House up to the end of the first session of the 36th Parliament in Sept. 1999. The material is presented with full commentary on the historical circumstances which have shaped the current approach to parliamentary business. Key Speaker's rulings and statements are also documented and the considerable body of practice, interpretation, and precedents unique to the Canadian House of Commons is amply illustrated. Chapters of the book cover the following: parliamentary institutions; parliaments and ministries; privileges and immunities; the House and its Members; parliamentary procedure; the physical & administrative setting; the Speaker & other presiding officers; the parliamentary cycle; sittings of the House; the daily program; oral & written questions; the process of debate; rules of order & decorum; the curtailment of debate; special debates; the legislative process; delegated legislation; financial procedures; committees of the whole House; committees; private Members' business; public petitions; private bills practice; and the parliamentary record. Second Chamber by Great Britain. Parliament. House of Commons. Public Administration Select Committee,Anthony Wright Pdf

This report details the response of the Public Administration Select Committee to the Government's proposals for the reform of the House of Lords (contained in the White Paper (Cm. 5291, ISBN 0101529120) published in November 2001). The Committee argues that the White Paper is fundamentally misconceived in its determination to ensure the pre-eminence of the House of Commons, as this is not in any doubt. The real task is to increase the effectiveness of Parliament as a whole (i.e. both chambers) in holding the Government to account for its actions and policies, and this should be the focus of any reforms. The House of Lords should continue to be a revising, scrutinising and deliberative assembly, but its performance of all these functions should be strengthened. Recommendations include: 1) 60 per cent of members should be elected (compared to the 20 per cent proposed by the Government), 20 per cent should be nominated by the political parties and 20 per cent independent members; 2) the size of the second chamber should eventually be reduced to 350 members; and 3) the next step should be the production of a draft Bill for consideration by a joint committee of both Houses as soon as possible.

Reforming the House of Lords by Meg Russell Pdf

'Meg Russell's book is a valuable contribution to the debate on the further stages of House of Lords reform. It is always useful to gain a greater understanding from the experience of other countries.' -Baroness Jay, Leader of the House of Lords'The debate on the future of the House of Lords has so far been insular and backward-looking. Meg Russell provides and overdue and authoritative corrective in showing the lessons to be learnt from second chamber overseas in the balanced, analytical and highly readable manner that the Constitution Unit has made its trademark. She outlines how an independent and distinctive second chamber could form a central part of the developing constitutional settlement, complementing but not threatening the Commons.' -Peter Riddell, The Times'An excellent addition to the comparative literature on bicameralism which will be of great use to those interested in parliaments, parliamentary reform and comparative government generally' -Campbell Sharman, University of Western Australia'excellent new survey' -The Guardian'Ms Russell's thorough book goes straight to the heart of the hardest questions and gives a sober, efficient account of what is to be said on each side... sound, sensible, and well-researched study.' -Michael Fry, Glasgow Herald, 24/2/00'Russell should be thanked for a valuable, laborious and exhaustive study carried out in a fair and honest spirit... provides a thorough professional exercise... shrewd political judgments.' -John Vincent, LRB, 16/3/00The constitution of Britain is changing rapidly, and the House of Lords is next on the agenda for reform. This book provides an international context, using material as yet unpublished in the UK. What can we learn from the appointed Canadian Senate, the elected Australian Senate, the German federal Bundesrat, or our other European neighbours.
