Hutley's Australian Wills Precedents by Charles Rowland,Francis Charles Hutley,Bonnie Allan,Jason Wenning Pdf

Since its first publication in 1970, HUTLEY'S AUSTRALIAN WILLS PRECEDENTS has become the essential reference work on the art of will drafting in Australia. The 7th edition is much more than an 'update' of the previous edition. The whole book has been thoroughly examined and reconsidered. The text, forms and precedents have been revised and in many places rewritten and extended. New cases and statutes have been taken into account and contentious issues critically examined. The precedent for a testamentary discretionary family trust will fill a need. These trusts are very difficult to draft. The trust offered here is a flexible, middle-of-the-road, general vehicle, designed to be adaptable to the needs of clients and practitioners. It allows for income splitting and offers some asset protection. The precedent is considered and explained in the text and is accompanied by a full and detailed explanatory document to be given to clients. The new, detailed, Table of Contents is intended to be a search engine, to complement the conventional index. It is a comprehensive list of all chapter and paragraph headings, occupying many pages; it therefore offers ready access to the matters which a will drafter has to consider. A Compact Disc containing all the precedents and forms in Microsoft Word 2002 format is included.

Uniform Succession Laws by New South Wales. Law Reform Commission Pdf

Among the States and Territories there are numerous significant differences in the law of wills. In intestacy, the rights of a surviving spouse vary greatly from jurisdiction to jurisdiction. In family provision schemes, qualification to apply for provision is far from uniform, as are also the grounds on which the courts in different jurisdictions may order that provision be made. In the administration of deceased estates, there is a lack of uniformity in the law relating to devolution of title and the payment of debts from assets, and uncertainty with respect to interstate recognition of grants of probate. Less significant differences are numerous, particularly in those relatively neglected areas of law reform such as probate and administration. To date, in Australia, State and Territory succession laws have been reformed in a piecemeal manner. The development by the National Committee of model legislation to be used as the basis for reform by individual States and Territories provides an opportunity for the States and Territories to adopt uniform, or at least consistent, laws relating to wills.

Succession: Families, Property and Death, 6th Edition by R Croucher; P Vines Pdf

Succession: Families, Property and Death is designed not only to expound succession law in Australia as it is, including the recognition, if at all, of Aboriginal customary law, but also to consider the law in its national and international setting by considering rules of private international law; to reveal how it has developed by taking an historical focus; to consider the objectives sought to be satisfied by succession law as a basis of understanding and for the evaluation of existing rules; and to consider some comparative approaches to the problems of inheritance. As a teaching tool, it extracts cases at length rather than in small pieces to enable students to develop a sense of the forms of judicial argument which are used in succession law, allowing for a deeper analysis of the judgments than has traditionally been possible. As a practitioner resource, this text also covers comprehensively and critically such bread-and-butter topics of a succession lawyer as formal validity of a will, challenges to that validity, dispensing with formal requirements for a will, rectification, and claims for a family provision order. Features Includes new commentary on: * digital property * Jewish inheritance law * definition of family for succession purposes, including Aboriginal concept of kinship and posthumous children * joint tenancy and the right of survivorship * voluntary assisted dying * Benjamin orders * disputes about disposal of the body * recognition of aboriginal customary law and tradition in distribution on intestacy * determining capacity and dealing with future loss of capacity * electronic signing and witnessing of wills * formal validity rules and dispensing powers * sale of specific gift after death * ademption of gifts * the forfeiture rule * family provision * administration of the estate Related Titles * Dal Pont, Law of Succession, 3rd edition * Dal Pont, Law of Executors and Administrators, 1st edition * De Groot & Nickel, Family Provision in Australia, 6th edition * Mackie & Histed, Principles of Australian Succession Law, 4th edition
