The Law of Liability Insurance, 4th Edition by D Derrington & R S Ashton Pdf

This 4th edition generally follows the structure of earlier editions which has been found to be efficient. After a short history of the subject, it analyses the basic principles of insurance law insofar as it has been found relevant to this form of cover. This is followed by an intensive study of the principle of construction of commercial, particularly insurance, contracts, and of statutory interpretation. Next is a study of the doctrine of utmost good faith, generally but with particular reference to liability insurance, followed by a chapter relating to the proposal, with emphasis on the law relating to Fair Trading. The work then turns to the policy, first a policy of interim insurance, and then to the nature, scope and purpose of a liability insurance policy, with particular attention to detailed issues that generally arise in respect of this form of cover. It is followed by an analysis of conditions and exclusions, both generally and in respect of all the particular clauses usually found in such policies. The work then becomes more specific in its attention to the many particular sub-species of liability insurance, and their specialised terms and conditions. On this foundation, there is then an investigation of the effect of general principles of equity and the like, such as Election, Waiver, estoppel, res judicata and privity of contract. Finally, a chapter is devoted to substantive issues and those of practice and procedure which are abundantly found in litigation between the various parties who are engaged, directly or indirectly, in disputes related to this form of insurance. Topics include such matters as direct action by a claimant against an alleged wrongdoer's insurer, subrogation, and a claim between co-insurers of a common insured for contribution in respect of indemnity provided by one of them. Features The former structure has been somewhat revised for greater convenience to the reader, but the major change from the former edition lies in the updating of case law in respect of important refined detail where that has been the subject of further judicial attention, and the inclusion of commentary on it. This does not involve expansive theoretical discussion, but rather constitutes a focused exegesis with reference to the authority, and a short practical explanation of the more persuasive reasoning involved. "Health Law in Australia is Australia’s leading text in this area. Originally published in 2010, it was the first book to deal with health law on a comprehensive national basis. In this important field that continues to give rise to challenges for society, the book takes a logical, structured approach to explain the breadth of this area of law across all Australian jurisdictions. By covering all the major areas in this diverse field, Health Law in Australia 4th edition enhances the understanding of the discipline as a whole. The book begins by situating health law in its wider context with chapters on medical ethics, human rights and how the health system as a whole is regulated. It then explores the general principles of health law, including chapters on “Negligence”, “Children and Consent to Medical Treatment”, and “Medical Confidentiality and Patient Privacy”. The book goes on to consider beginning-of-life and end-of-life issues, including major reforms to permit voluntary assisted dying across most of Australia, before concluding with chapters on wider areas in health law, such as mental health law, medical research and genetic technologies. The contributing authors are national leaders who are specialists in these areas of health law and who can share with readers the results of their research. Health Law in Australia 4th edition has been written for both legal and health audiences. It is essential reading for undergraduate and postgraduate students, researchers and scholars in the disciplines of law, health and medicine, as well as health and legal practitioners, private health providers, and government departments and bodies in the health area."--Back cover.

Australian Principles of Tort Law by Pamela Stewart,Anita Stuhmcke Pdf

Since 2002 in all Australian jurisdictions legislative reform has transformed the law of torts. It is no longer a body of unified common law but is an area governed by a diverse array of non-uniform statutes in each Australian jurisdiction. Now in its second edition Australian Principles of Tort Law provides both currency and depth of analysis to the ongoing legal issues in relation to tort law reform legislation as the courts throughout Australia interpret and apply the challenging new legislative provisions. The recent cases on the legislation are fascinating and often intricate as judicial reasoning is applied to create an evolving area of law based increasingly upon personal responsibility. Australian Principles of Tort Law makes this complex area of law accessible to students new to the field and provides commentary and analysis useful to those seeking ongoing engagement and understanding in the area of tort law. The work clarifies a conceptually difficult area of law across all Australian jurisdictions. Excellent ranges of cases (geographical and hierarchical) are discussed together with an explanation of the relevance and applicability of the tort law reform legislation. Stewart and Stuhmcke also detail the impact and importance of the work of the Federal Government Review Panel into negligence (now commonly referred to as the 'Ipp Report') and outlines how the Panel illuminates and explains legislative change. This accessible work makes a fascinating and interesting area of law digestible and relevant. It provides essential reading and guidance on tort law and makes a valuable contribution to scholarship in the field. Its clear and comprehensive style makes it an accessible and interesting book for all those interested in tort law.
