Anglo-Norman Studies XXVIII by Chris Lewis Pdf

`A series which is a model of its kind.' EDMUND KING, HISTORY The latest volume in the series concentrates, as always, on the half century before and the century after 1066, with papers which have many interconnections and range across different kinds of history. There is a particular focuson church history, with contributions on an Anglo-Saxon archiepiscopal manual, architecture and liturgy in post-Conquest Lincolnshire, Anglo-Norman cathedral chapters, and twelfth-century views of the tenth-century monastic reform. Other topics considered include social history (the Anglo-Norman family), gender (William of Malmesbury's representation of Bishop Wulfstan of Worcester), and politics (the sheriffs of Northumberland and Cumberland 1170-1185). The volume is completed with articles on Domesday Book and the post-Domesday Evesham Abbey surveys, and a double paper on land tenure and royal patronage. Contributors: STEPHEN BAXTER, JOHN BLAIR, HOWARD CLARKE, TRACEY-ANN COOPER, HUGH DOHERTY, PAUL EVERSON, DAVID STOCKER, KIRSTEN FENTON, VANESSA KING, JOHN MOORE, NICOLA ROBERTSON, DAVID ROFFE

Routledge Library Editions: Historiography by Various Pdf

The greatest problem in historical scholarship, theoretically and practically, is the relation between historians and their subject matter. The past is gone and historians can only study its remnants. On what basis do scholars select certain facts from the mass of data left from the past? How do they explain the interrelationship of the facts they select? What criteria do they use to evaluate their subject? The 35 volumes in this set, originally published between 1926 and 1990 discuss and answer these essential questions faced by historians. The development of historical understanding during the 18th and 19th centuries was one of the most striking features of Western culture. Both historiography and historical thinking advanced as never before. The historial movment of the 19th century was perhaps second only to the scientific revolution of the seventeenth century in transforming Western thought. One consequence was extensive organisation and professionalization of research, which the volumes in this set reflect.

The Historian At Work by John Cannon Pdf

This volume, originally published in 1980 discusses the way in which distinguished historians such as Gibbon, Ranke, Macaulay, De Tocqueville, Marx, Maitland, Bloch, Namier, Wheeler, Butterfield and Braudel have regarded and tackled their discipline. As well as chapters by individual authors who are experts on their chosen historian, there is a substantial introduction by the editor which serves as the basis for a discussion about the problems involved in the writing of history.

Precedent Inflation by Susan W. Brenner Pdf

Precedents are decisions judges have issued in prior cases. In the common law, precedents are used to determine what the outcome of present cases should be, under the doctrine of "stare decisis, "which stipulates that new cases are resolved by applying legal rules developed in the process of deciding past cases. This volume postulates a relationship between the concept of legal precedent and the means that are used to make specific precedents available to the legal profession. The author concentrates specifically on the effect computer databases such as lexis and westlaw will have on the use of precedent in the common law. By tracing the history of law reporting, Professor Brenner demonstrates how the Anglo-American conception of precedent has altered over the past seven hundred years, and that these alterations reflect changes in the means used to distribute precedents. She explains why computers will become the primary means of disseminating precedents and describes the evolution and operation of the two on-line services that provide access to precedents by means of computer terminals and modems. These services--lexis and westlaw-- are operated by private entrepreneurs in the business of providing precedents to the legal profession. Arguing that such services will have a profound effect on the conception and use of precedent, Brenner provides an empirical study of both services to show the effects they have already had, and outlines the conception of precedent that will result from the use of computers as "law reporters." This, she believes, will be a quantitative conception in which judicial decisions will be used in a manner analogous to the use of quantitative data in scientific endeavors. This study, written with a brilliance often reserved for popular writing at its best, is unique in its application of sociology of knowledge principles to the analysis of law reporting in its examination of citations to approximately 25,000 judicial decisions. It will be of special interest to lawyers, sociologists, and policymakers.

Contract - Freedom and Restraint by Richard A. Epstein Pdf

First Published in 2000. Where a well-run society should rest on the continuum between public and private control has been the most contentious and thorny issue of legal and social theory throughout the generations. This series sets out to provide answers to this ongoing dispute contained in the five volumes of material assembled. The collection draws from many disciplines, including economics, law, philosophy and political science. Yet they are all directed to a topic that is worthy of examination from multiple perspectives: Liberty, Property and the Law.
