Collaborative practice is a new method of dispute resolution, used mainly in family law matters. By taking a non-adversarial approach, it challenges the strictly positivist view of the lawyer as ‘zealous advocate’ for the client. As such, it has received much criticism from the established Bar and legal profession. This book provides a doctrinal and empirical analysis of collaborative practice with a view to assessing its place within the dispute resolution continuum and addressing whether this criticism has been justified. It begins by establishing the theoretical underpinnings of conflict and differing approaches to conflict resolution, the impact of the comprehensive law movement and therapeutic jurisprudence. The origins and development of the collaborative process and the framework it provides for a multidisciplinary approach to conflict resolution is outlined. The book addresses the examination of the process undertaken in the lead up to the enactment of the Uniform Collaborative Law Act in 2010; now regarded as a model of best practice. Gaughan) About the Author Lawrence D. Gaughan was the founder and Professional Director of Family Mediation of Greater Washington. He earned a J.D. from the University of Montana (1957) and an LL.M. from the University of Virginia (1964). L.D. Gaughan practiced family law and family mediation in Northern Virginia from 1979 until his death in 2019. He was also a law professor at the University of Virginia, Washington & Lee University and George Mason University law schools. In 1979-80, L.D. Gaughan took a sabbatical from W&L to study family systems with Murray Bowen, M.D., and his staff in the Department of Psychiatry at Georgetown University. He was a member of the Virginia State Bar since 1967. From 1975-1999 he gave the annual keynote lecture on Family Law at the Virginia State Bar Association Conference. As an attorney, L.D. Gaughan consistently received the highest ratings for both legal ability and ethical standards (“AVR PreeminentTM") from Martindale-Hubbell. He was also rated 10 out of 10 by Awo. He was a founding member of the Professional Mediation Board of Standards, a 501(C)(3) board formed to frame and implement standards for professional family mediators, and was certified for collaborative practice. In September 2017, L.D. Gaughan received the Distinguished Mediator of the Year award from the Virginia Mediation Network at its annual conference in Richmond. In 2019, at their convention in Boston, he was posthumously recognized with a lifetime achievement award from the Academy of Professional Family Mediators.

Collaborative family law is a conflict management and dispute resolution process available to spouses and other life partners to assist them with the parenting, financial, and property issues that arise in the aftermath of a separation. It is an alternative to Anglo-American adversarial adjudication. The parties and the lawyers who represent them work together as a team. To become collaborative professionals, lawyers must first attend a collaborative family law training workshop. Trainers inform the participants of the need for them to make a paradigm shift in their orientation toward conflict management and dispute resolution.Transformative learning is an adult learning model comprised of two constituent elements, critical reflection and perspective transformation. It focuses upon the meaning perspectives of learners who participate in adult education and training programs. The assumptions upon which a professional discipline is grounded are fundamental to the ways in which practitioners do their work. If they do not understand why they are doing what they are doing or how they are doing it, it is less likely that the efforts of trainers to foster and induce meaningful and sustainable change will be successful.To explore the nature of the learning experiences of lawyers who receive collaborative family law training, a case study of a two-day workshop was observed. Six of the learners participated in this research. They were interviewed on four occasions over the twelve-month period following their training. The data reveal the pre-training paradigm within which all of these participants practised, the two dimensions of their practice behaviours that required changed for them to make the paradigm shift to become collaborative professionals, the post-training activities of the learners that contributed to their continuing learning, and the nature of the perspective transformation experienced by two of the learners.
