Children and Families Act 2014 by Great Britain Pdf

The Children and Families Act 2014 takes forward a range of Government commitments which are intended to improve services for key groups of vulnerable children (children in the adoption and care systems, those affected by decisions of the family courts and those with special educational needs and disabilities) and to support families in balancing home and work life, particularly when children are very young. It takes forward legislation that has been announced in a range of Government documents over the past 2 years. The Act contains measures intended to remove barriers to adoption; reform the family justice system and the special educational needs system and ensure that services place children and young people at the centre of decision making and support. It contains measures which relate to the welfare of children, including areas such as: child performance; protecting children and young people from tobacco and nicotine addiction; young carers and parent carers; "staying put" arrangements; supporting pupils at school with medical conditions; reform of children's homes; clarifying the Secretary of State's intervention powers; and free school lunches. The Act also contains measures which support wider changes to childcare; introduces a new system of shared parental leave following childbirth or adoption; and extends to all employees the right to request flexible working. Through its reforms to the functions and role of the Children's Commissioner, the Act is intended to ensure that children in England have a strong advocate for their rights.

Adoption and Law by Lisamarie Deblasio Pdf

Using a socio-legal framework, this book explores the experiences that birth mothers face in state sanctioned adoption proceedings in the UK. Featuring personal, in-depth interviews and conversations with 32 birth mothers, the book highlights perspectives and voices that are seldom the focus in leading discourses of professional practice in this area of law. The book also demands that the statutory rights, support and care of birth mothers are recognised and strengthened. This book delivers a comprehensive insight into many aspects and controversies of legal child adoption, including the development and reform of adoption law over history, giving the reader insight into the deep-rooted political and social tensions around the use of adoption. The uniqueness of birth mothers’ subjective stories of adoption contrasts powerfully with the legal theory providing the reader with an intimate paradigm of adoption. The book includes discussion of obiter dicta and authoritative guidance on adoption practice from the Supreme Court and Court of Appeal in Re B (A Child) (Care Proceedings: Appeal) [2013] UKSC 33 and Re B-S (Children) (Adoption: Leave to Oppose) [2013] EWCA Civ 1146. It also considers Court of Appeal’s recent ruling on post adoption contact in Re B (A Child) (Post-Adoption Contact) [2019] EWCA Civ 29, the first case to come before the court since section 9 of the Children and Families Act 2014 amended the Adoption and Children Act 2002, with the new insertion of section 51A and 51B providing for court ordered post adoption contact. This book is ideally suited to undergraduate students, as well as a more multi- disciplinary audience.

The Oxford Handbook of Children and the Law by Anonim Pdf

The Oxford Handbook of Children and the Law presents cutting-edge scholarship on a broad range of topics covering the life course of humans from before birth to adulthood, by leading scholars in law, medicine, social work, sociology, education, and philosophy, and by practitioners in law and medicine. An international collection of authors presents and analyzes the law and science pertaining to reproduction; prenatal life (including fetal exposure to toxic substances and abortion); parentage (including biology-based rights, background checks on birth parents, adoption, the status of gamete donors, and surrogacy); infant development and vulnerability; child maltreatment (including corporal punishment and religious defences to abuse and neglect); child protection policy and systems; foster care; child custody disputes between parents or between parents and other caregivers; schooling (including financing, resegregation, religious expression in public schools, at-risk students, special education, regulation of private schools, and homeschooling); delinquency; minimum-age laws; and child advocacy. Most chapters follow a format wherein they first describe the most debated or dynamic issues in each topical area, then explain in depth the law and/or science pertaining to the author's particular focus, and finally offer arguments and recommendations as to law and policy in that area. The normative component aims to advance discussions and debates in vital areas of contemporary child welfare law and policy. The Handbook is an essential resource for scholars and professionals interested in the intersection of children and the law.
