First published in 1998, this volume responds to child-prostitution being recognised as a major social problem in modern capitalist Taiwan. It is defined, both legally and socially, as a problem of ‘sexual transactions involving children and juveniles’, thus the issue of child maltreatment is submerged under other concerns. However, the main concern of this book is the protection of children from maltreatment, so related socio-legal measures will be examined by this parameter. During the social campaigns against child prostitution, structural problems such as police corruption, male sexual perversion, socio-economic inequality, and the maladjustment of aboriginal people in the modern Taiwanese society are subjugated to increasing criticism. Nevertheless, efforts to encounter any of them have had very limited accomplishment. This book intends to show that the functions of law in the prevention and treatment of the social problem of child prostitution cannot work as intended if those structural problems are not properly tackled. Suggestions are also made to address the need to reconceptualise the problem in the analytical framework of child maltreatment and to recommend the direction for reformation of policy and practice.

This book provides a comparative account of the abolition of concubinage in East Asia, offering a new perspective and revised analysis of the factors leading to – and the debates surrounding – the introduction of a new Marriage Reform Ordinance in Hong Kong in 1971. It uses this law as a platform to examine how the existence of concubinage – long preserved in the name of protecting Chinese traditions and customs — crucially influenced family law reforms, which were in response to a perceived need to create a ‘modern’ marriage system within Hong Kong’s Chinese community after the Second World War. This was, by and large, the result of continued pressure from within Hong Kong and from Britain to bring Hong Kong’s marriage system in line with international marriage treaties. It represented one of the last significant intrusions of colonial law into the private sphere of Hong Kong social life, eliminating Chinese customs which had been previously recognised by the colonial legal system’s family law. This book contextualizes the Hong Kong situation by examining judicial cases interpreting Chinese customs and the Great Qing Code, offering a comprehensive understanding of the Hong Kong situation in relation to the status of concubines in Republican China and other East Asian jurisdictions. This book is about how Chinese men make sense of and practise fatherhood within the context of changing gender conventions and socio-cultural conditions. Liong analyses data from participant observations at a men's centre, focus groups, and in-depth interviews, to assess the subjective experience and identities of Chinese fathers in Hong Kong, from a gender perspective. His findings show that economic provision, education, and marriage are the three "natural" and "normal" domains of paternity. Not being able to fulfil these requirements is a threat to fathers' masculinity, yet is also an opportunity for fathers to reflect upon these accepted conventions. In order to compensate, these men typically develop a closer and more caring relationship with their children, however these fathers still struggle with feelings of inferiority.
