The International Criminal Court by William Schabas Pdf

The International Criminal Court has been operational since mid-2003, following the entry into force of the Rome Statute of the International Criminal Court on 1 July 2002. The Rome Statute is among the most complex international treaties, a combination of public international law, international humanitarian law and criminal law, both international and domestic. The Commentary provides an article-by-article analysis of the Statute. Each of the 128 articles is presented accompanied by a bibliography of academic literature relevant to that provision, an overview of the drafting history of the provision and an analysis of the text. The analytical portion of each chapter draws upon relevant case law from the Court itself, as well as from other international and national criminal tribunals, academic commentary, and the related instruments such as the Elements of Crimes, the Rules of Procedure and Evidence and the Relationship Agreement with the United Nations. Written by a single author, the Commentary avoids duplication and inconsistency, providing a comprehensive presentation to assist those who must understand, interpret and apply the complex provisions of the Rome Statute

Rome Statute of the International Criminal Court by Kai Ambos,Otto Triffterer Pdf

"On 1st July 2008, the Rome Statute of the International Criminal Court entered into force enabling the ICC, as laid down in the Preamble to the Statute, to affirm "that the most serious crimes of concern to the international community as a whole must not go unpunished and that their effective prosecution must be ensured by taking measures at national level and by enhancing international cooperation". In the second edition of their Commentary, Otto Triffterer and a number of eminent legal practitioners and scholars in the field of international criminal law give a detailed article-by-article analysis of both the Statute as well as the "Elements of Crime" and the "Rules of Procedure and Evidence", adopted by the Assembly of States Parties in 2002, and the "Regulations of the Court", adopted by the Judges of the ICC in 2004. The second edition is a substantially revised and significantly amended version of the first edition of 1999, considering the jurisprudence of the International Criminal Tribunal for the former Yugoslavia (ICTY) and the International Criminal Tribunal for Rwanda (ICTR) as well as other international, "semi-international" or national courts and the relevant literature since 1999. The Commentary will be an invaluable aid to all practitioners and scholars dealing with the Rome Statute and the jurisdiction established by its "Complementarity Regime"."--Bloomsbury Publishing.

The International Criminal Court by Young Sok Kim Pdf

This book is intended to analyze and evaluate the Statute of the International Criminal Court which was newly created at the United Nations Diplomatic Conference in Rome, Italy on 17 July 1998 (The Rome Conference or the Conference). The book addresses a host of difficult questions and common questions the new permanent International Criminal Court (The ICC or The Court) can raise and possible answers to those questions. This book also records the legislative histories of each article of the ICC Statute and evaluates legal ramifications of the Statute. Even though the United States Government has argued the Rome Statute violates the law of treaties and is not consistent with international law, the author tries to prove that the Rome Statute does not violate the law of treaties and is consistent with international law. The Rome Statute is invaluable in that it codifies the present international law and international criminal law and procedure. The Statute, which was supported by 120 states in the world, summarize the present treaty law, customary international law and general principles of law, even though some contents of the Statute were watered down by some states. The author participated in the process for the adoption of the Rome Statute as a member of the Korean Delegation to the Rome Diplomatic Conference. Korea submitted a very important proposal on the jurisdiction of the Court, which the author was involved in, and tried to bridge the gaps between the U.S position and various other states' positions. On the basis of his own reservations and experiences at the Rome Conference, the author thinks the Rome Statute has delicate balances among various interests of countries and will be a great weapon for the World to fight with against the most heinous international crimes: genocide, crimes against humanity, war crimes and crimes of aggression. Therefore, this book is an insider's observation and a legislative history of the Rome Statute. However, the views appearing in this book are not those of the Korean Government, but solely those of the author as an international law scholar and a participant in the Rome Conference.Contents: 1. The Rome Statute of the International Criminal Court by Antonio Cassese,Paola Gaeta,John R. W. D. Jones Pdf

The International Criminal Court (ICC) officially came into existence in July 2002 following the 60th ratification of the Rome Statute, heralding a new era for the effective prosecution and punishment of serious violations of international humanitarian law - genocide, war crimes and crimes against humanity. This two volume Commentary takes a thematic look at the whole of international criminal law, appraising the contributions of international tribunals such as the Nuremberg and TokyoTribunals and the ad hoc Tribunals for Yugoslavia and Rwanda, as well as those of national courts. It re-examines the case law developed by these courts and tribunals, establishes to what extent the Rome Statute codifies this body of law or instead departs from it, and makes a critical assessment of the Statute as a viable working tool for international criminal justice. A third volume contains the texts of the Statute, the Rules of Procedure and Evidence and Elements of Crimes. Writtenby an outstanding international team of experts under the general editorship of Antonio Cassese, Paola Gaeta, and John R.W.D. Jones, this timely companion to the burgeoning field of international criminal law will be of interest to international legal scholars, practitioners and judges, and to all those who are interested in the administration of international justice and the workings of international institutions. Antonio Cassese is the Editor of the Journal of International Criminal Justice. To read sample articles from the journal visit: www.jicj.oupjournals.org
