These category-formations everywhere pursue a cogent analytical program, addressing diverse subjects, treated systematically, a single set of questions of definition and analysis. Is Scripture the origin of the Halakhic system, which defines the norms of Judaism? At stake is not the starting point of discrete bits of legal data. At issue is the origin of the comprehensive structure comprised by the Halakhic category-formations, by these topics and no others. Coherent Judaism begins by excavating the theologies within the Torah and tracing their careers through the Jewish Enlightenment of the eighteenth century. Any compelling, contemporary Judaism must cohere as much as possible with traditional Judaism and everything else we believe to be true about our world. The challenge is that over the past two centuries, our understandings of both the Torah and nature have radically changed. Nevertheless, much Jewish wisdom can be translated into a contemporary idiom that both coheres with all that we believe and enriches our lives as individuals and within our communities. Coherent Judaism explains why pre-modern Judaism opted to privilege consensus around Jewish behavior (halakhah) over belief. The stresses of modernity have conspired to reveal the incoherence of that traditional approach. In our post-Darwinian and post-Holocaust world, theology must be able to withstand the challenges of science and history. Traditional Jewish theologies have the resources to meet those challenges. Coherent Judaism concludes by presenting a philosophy of halakhah that is faithful to the covenantal aspiration to live long on the land that the Lord, our God, has given us.
The Rabbis of the first five centuries of the Common Era loom large in the Jewish tradition. Until the modern period, Jews viewed the Rabbinic traditions as the authoritative contents of their covenant with God, and scholars debated the meanings of these ancient Sages words. Even after the eighteenth century, when varied denominations emerged within Judaism, each with its own approach to the tradition, the literary legacy of the talmudic Sages continued to be consulted. In this book, Michael S. Berger analyzes the notion of Rabbinic authority from a philosophical standpoint. He sets out a typology of theories that can be used to understand the authority of these Sages, showing the coherence of each, its strengths and weaknesses, and what aspects of the Rabbinic enterprise it covers. His careful and thorough analysis reveals that owing to the multifaceted character of the Rabbinic enterprise, no single theory is adequate to fully ground Rabbinic authority as traditionally understood. The final section of the book argues that the notion of Rabbinic authority may indeed have been transformed over time, even as it retained the original name. Drawing on the debates about legal hermeneutics between Ronald Dworkin and Stanley Fish, Berger introduces the idea that Rabbinic authority is not a strict consequence of a preexisting theory, but rather is embedded in a form of life that includes text, interpretation, and practices. Rabbinic authority is shown to be a nuanced concept unique to Judaism, in that it is taken to justify those sorts of activities which in turn actually deepen the authority itself. But Scripture, continued in the Mishnah, Tosefta, the two Talmuds, and Midrash, insists that Israelites are individual responsible for what they do, and further that corporate Israel on its own, not only as the sum of individual actions, forms a moral entity subject to judgment. So these are the governing questions: How to sort out these intersecting matters, then, the obligations of the community, the responsibilities of individuals? How does the social teaching of Rabbinic Judaism hold together doctrines of individual obligations to Heaven and mutual responsibilities, on the one side, with all Israel1s commitments and public convictions, on the other? Part 2: Between Israelites Part 2 turns to relationships between Israelites, with particular attention to those that require resolving conflict. Once the law recognizes not only Israelites but the integrity of corporate Israel, how does it regulate relationships within the framework of that corporate community? By regulating relationships the sages will have understood, relationships of competition, contention, and conflict. Those of collaboration, consensus, and cooperation require no regulation on the part of constitutive law; they regulate themselves by their nature: people keep rules. Then at issue are where the corporate community intervenes to protect its interests in relationships between and among individual Israelites, and how it does so. The exposition then follows the laws presentation of those relationships as integral to the larger system of Rabbinic Judaism and its plan for its Israel's public life, hence, once more, the focus on large constructions, category-formations that are integral to the main beams of the Halakhic system and structure.
