Crime and Criminal Justice in Europe and Canada by Louis Knafla Pdf

How is modern-day thinking about crime different from that of previous centuries? What are the similarities and differences in attitudes and systems between the civil and common law societies of Europe and North America? These and other questions were addressed at an international conference on crime and criminal justice at The University of Calgary attended by historians, professors of law, judges, and criminologists. The essays in Part I consider the evolution of criminal law doctrine, and those in Part II analyse the theory and measurement of crime in the past and at present. Parts III and IV examine the courts and prosecution, and Part V assesses the historical roots of the insanity defence and the theory and practice of punishment. The volume will be of interest, across national boundaries, to historians, sociologists, social workers, lawyers, and persons involved in the administration of justice as well as the general reader concerned about civil rights, social values, and justice. The eighteen contributors include F.H. Baker, J.M. Beattie, W.A. Calder, T.C. Curtis, D. Hay, H. Diederiks, A. Lachance, His Honour W.G. Morrow, A. Soman, and S. Verdun-Jones.

The Criminalisation of Youth by Francis Bailleau,Yves Cartuyvels Pdf

Transformations to the criminal justice system in Western societies are often linked with broader social and cultural changes, and this work presents the recent changes in juvenile justice in Canada and nine European countries and the sociopolitical context in which they take place. The study provides a comparison of the sentencing practices of each country, focusing on three dimensions related to the sanction practices: the custodial sanctions, the alternative sanctions, and the extension of the judicial thinking into relative fields such as school, training, and social policies. With clear and thoroughly developed research methods, this analysis illustrates that changes in juvenile justice policies are not specifically the result of differences in crime rates or the evolution of deviant youth behavior, but rather the effect of complex interactions with a variety of social, economical, cultural, and political factors.

EU Criminal Law and Policy by Joanna Beata Banach-Gutierrez,Christopher Harding Pdf

The EU now possesses a clear legal basis for taking action on criminal law matters and steering the policy and practice of Member States in relation to crime and criminal law. However, for what is now an important area of law, there remains a striking absence or uncertainty regarding its theoretical basis, its legitimacy and its conceptual vocabulary. This book offers a review of the significance of EU criminal law and crime policy as a rapidly emerging phenomenon in European law and governance. Bringing together an international set of contributors, the book questions the nature, role and objectives of such 'criminal law', its relationship with other areas of EU policy and law, and the established rules of criminal law and criminal justice at the Member State level. Taking up such subjects as the application of criminal law across national boundaries and in the broader European context, effective enforcement, and the working out of a new European policy, the book helps to structure an increasingly significant subject in law which is still finding its direction. The book will be of great use and interest to researchers and students of EU law, criminal justice, and criminology.

EU Criminal Justice, Financial & Economic Crime by Marc Cools Pdf

This fifth volume of the Governance of Security (GofS) Research Paper series addresses a wide variety of topical issues focusing on European criminal justice and financial and economic crime. The first cluster of articles is concerned with European criminal justice matters particularly relating to EU mutual recognition, such as: conceptualization, unwanted effects in the context of prisoner transfer and sentence execution, impact for cross-border gathering and use of forensic expert evidence, and interrogational fairness standards. A second cluster of articles addresses the subjects of financial and economic crime, ranging from informal economy (among street children) to formal/informal economy (vulnerability of the hotel and catering industry to crime) and white collar crime phenomena like (transnational) environmental crime and corruption. A final cluster groups together a variety of selected topical issues, including juvenile offending and mental disorders, desistance theories, and sexually transmitted infections.

Crime and Criminal Justice Systems in Europe and North America, 1995-2004 by Kauko Aromaa,Markku Heiskanen Pdf

Recent crime and criminal justice system trends in the countries of Europe and North America are reported, based on data in the sixth through the ninth United Nations Surveys on Crime Trends and the Operations of Criminal Justice Systems (CTS). The CTS is the main source of worldwide data on national recorded crime rates and criminal justice system operations. Data for the years 1995-2004 were obtained from official agencies in Canada, the U.S. and more than 30 countries in Europe, and were analyzed by a working group of international experts. The biggest strength of this dataset is that it allows the study of crime and criminal justice systems over a full ten-year period. Two of the major trends across Europe and North America in this period were: (1) On average, the number of criminal justice personnel and the resources of the national criminal justice systems remained stable. (2) The numbers of recorded assaults, robberies, drug-related offenses and frauds increased, while the numbers of thefts, auto thefts and burglary suspects decreased. The following 11 chapters provide extensive analyses of and statistical data on multinational trends: Introduction by Kauko Aromaa; Trends in Criminal Justice System Resources 1995-2004 by Beata Gruszczynska and Ineke Haen Marshall; Trends of Recorded Crime by Kauko Aromaa and Markku Heiskanen; Persons Brought into Initial Contact with the Police by Markku Heiskanen; Prosecution and Courts by Paul Smit; Juvenile Justice and the United Nations Survey on Crime Trends and Criminal Justice Systems by Steven Malby; Trends in Prison Population 1995-2004 by Roy Walmsley; An Empirical Approach to Country Clustering by Paul Smit, Ineke Haen Marshall andMirjam van Gammeren; Measu

EU criminal law is one of the fastest evolving, but also challenging, policy areas and fields of law. This Handbook provides a comprehensive and advanced analysis of EU criminal law as a structurally and constitutionally unique policy area and field of research. With contributions from leading experts, focusing on their respective fields of research, the book is preoccupied with defining cross-border or ‘Euro-crimes’, while allowing Member States to sanction criminal behaviour through mutual cooperation. It contains a web of institutions, agencies and external liaisons, which ensure the protection of EU citizens from serious crime, while protecting the fundamental rights of suspects and criminals. Students and scholars of EU criminal law will benefit from the comprehensive research present in this Handbook. National and EU policy-makers, as well as judges, defence lawyers and human rights lawyers will find the analysis of current legal action, combined with proposed solutions, useful to their work
