Cross-border Law Enforcement by Saskia Hufnagel,Clive Harfield,Simon Bronitt Pdf

This volume explores issues of law enforcement cooperation across borders from a variety of disciplinary perspectives. The borders under examination include both macro-level cooperation between nation-states as well as micro-level cooperation between different Executive agencies within a nation-state. The volume brings together leading academics, public policy makers, legal practitioners and law enforcement officials from Europe, Australia and the Asian-Pacific region, to shed new light on the pressing problems impeding cross-border policing and law enforcement globally and regionally. Problems common to all jurisdictions are discussed and innovative 'best practice' solutions and models are considered.

Policing Across Borders by George Andreopoulos Pdf

Globalization has had a sharp impact on the definition of ‘national security,’ as the interconnectedness of many threats calls for them to be addressed at the national and global level simultaneously. Law enforcement efforts must increasingly include elements of international and transnational communication and cooperation. Police forces in different countries must find common ways to share data and track international crime trends. This timely work analyzes key challenges confronting the law enforcement community, with regards to international crime, particularly illegal trafficking and terrorism. The contributions in this volume are the result of a series of workshops that brought together international law enforcement officials, researchers, and representatives from intergovernmental organizations (IGOs) and non-governmental organizations (NGOs), to examine the need for international police cooperation, the specific challenges this presents, and to propose solutions. This work will be of interest to researchers in law enforcement, criminal justice, crime prevention, and international relations.

Cross-Border Police Collaboration by Sophia Yakhlef Pdf

This book focuses on a border police collaboration project in the Baltic Sea area aiming at fighting cross-border crimes. It deals with the challenges that inherently "suspicious" organizations face when forced to work together. The study offers unique insights into a European border police project, giving the reader a behind the scenes account of how cross-border policing and organized crime in Europe is prevented and solved. Through detailed ethnographic descriptions, the book describes how a trust-based relationship, which is necessary for the exchange of sensitive intelligence information, gradually developed by the participants in and through their joint efforts to protect Europe from external threats and by performing everyday work together. The study presented in this book is of interest to scholars as well as practitioners concerned with migration management, border policing, intelligence analysis, police culture, and the changing nature of policing in an increasingly global and interconnected world. The book includes various sociological features, such as emotion management, emotional labor, hegemonic masculinity, and takes an interactionist perspective on informal interactions such as joking, bantering, and telling stories. It is also of interest to readers engaged in various forms of intra-, inter-organizational, and inter-cultural collaborations.

Policing Cooperation Across Borders by Saskia Hufnagel Pdf

This book provides new insights into police cooperation from a comparative socio-legal perspective. It presents a broad analysis of comparable police cooperation strategies in two systems: the EU and Australia. The evolution of regulatory trends and cooperation models is analysed for both systems and possible transferable strategies identified. Drawing on interviews with practitioners in the EU and Australia this book highlights a number of areas where the EU can be compared to a federal system and addresses the advantages and disadvantages of being a Union or a federation of states with a view to police cooperation practice. Particular topics addressed are the evolution of legal frameworks regulating police cooperation, informal cooperation strategies, Joint Investigation Teams, Europol and regional cooperation. These instruments foster police cooperation, but could be improved with a view to cooperation practice by learning from regulatory techniques and practitioner experiences of the respective other system.

Exchange of Information and Data Protection in Cross-border Criminal Proceedings in Europe by Ángeles Gutiérrez Zarza Pdf

In the past 10 years, the Member States of the European Union (EU) have intensified their exchange of information for the purposes of preventing and combating serious cross-border crime, as manifested in three main aspects. Firstly, there is a need to ensure the practical application of innovative principles (availability, mutual recognition) and concepts (Information Management Strategy, European Information Exchange Model) for tackling criminal organisations and networks that threaten the Internal Security of the EU. Secondly, there has been a gradual consolidation of EU agencies and bodies (Eurojust, Europol) aimed at promoting cooperation and dialogue among law enforcement officials and judicial authorities responsible for preventing and combating drug trafficking, trafficking in human beings, child pornography, and other serious trans-national offences. Thirdly, important EU information systems and databases (Prüm, SIS-II, ECRIS) have been created, enabling law enforcement and judicial authorities to gain access to essential information on criminal phenomena and organisations. Pursuing a practice-orientated approach, this work provides comprehensive coverage of all these measures, as well as the applicable rules governing data quality, data protection and data security. It is especially intended for law enforcement and judicial authorities who need to develop the appropriate expertise for the practical application of the above-mentioned principles. It also offers a solid basis of practical training material for police training centres and judicial schools.

Policing the Borders Within by Ana Aliverti Pdf

Policing the Borders Within offers an in-depth, comprehensive exploration of the everyday working of inland border controls in Britain, informed by extensive empirical material viewed through the lens of wide-ranging interdisciplinary debates. In particular, this book examines afresh the relationship between policing, borders, and social order, in terms of migration policing. By charting this new landscape of everyday contemporary policing, this book's main goal is to advance understanding of novel forms of law enforcement in a global age. These new forms of collaboration direct attention to the way in which frontline enforcement agents, through their everyday work, not only enforce the border, but recreate it. As the book argues, the emphasis on borders and migration controls and the growing importance of it within inland policing is a symptom of the new demands and challenges facing the state in exercising authority in a fast-moving, interconnected world, and its attempt to offer a semblance of order. Such challenges result in practice of random, capricious, informal, and arbitrary operation of power, which relies on non-rational elements to solve policing problems. Through an ethnography of the worlds of police and immigration officers, this book dissects the ethical, political, legal, and social dilemmas, and explores the tensions and contradictions of maintaining order in a deeply unequal globalized world. The new impetus to police migration is an insightful entry point to understand law enforcement in a global age.

Border Frictions by Karine Côté-Boucher Pdf

How did Canadian border officers come to think of themselves as a "police of the border"? This book tells the story of the shift to law enforcement in Canadian border control. From the 1990s onward, it traces the transformation of a customs organization into a border-policing agency. Border Frictions investigates how considerable political efforts and state resources have made bordering a matter of security and trade facilitation best managed with surveillance technologies. Based on interviews with border officers, ethnographic work carried out in the vicinity of land border ports of entry and policy analysis, this book illuminates features seldom reviewed by critical border scholars. These include the fraught circulation of data, the role of unions in shaping the border policy agenda, the significance of professional socialization in the making of distinct generations of security workers and evidence of the masculinization of bordering. In a time when surveillance technologies track the mobilities of goods and people and push their control beyond and inside geopolitical borderlines, Côté-Boucher unpacks how we came to accept the idea that it is vital to deploy coercive bordering tactics at the land border. Written in a clear and engaging style, this book will appeal to students and scholars in criminology, sociology, social theory, politics, and geography and appeal to those interested in learning about the everyday reality of policing the border.

One Country, Two Systems by Kam C. Wong Pdf

The legal issues evoked by cross-border crime in Hong Kong and China are sparse and what does exist is mostly in Chinese. This book provides the first systematic, comprehensive, and in-depth analysis of how Chinese, British, Hong Kong, and international law were applied in the Big Spender case. Kam C. Wong outlines the respective positions of various parties to the dispute. Part of the case's fascination involves competing interests, and that political clout counted for more than legal theory.Big Spender may be little known outside Hong Kong and China, but he made history there. It was the first time a Hong Kong legal resident had been prosecuted, tried, and ultimately executed in China for acts largely perpetrated in Hong Kong. The case tested the limits of the one-country, two-systems approach under which Hong Kong and China coexist. It also forced politicians, government officials, and the public in both Hong Kong and China to come to terms with the legal and policy issues related to cross-border crime.Wong sees the Big Spender case as making clear the dire need for both sides to find workable solutions to concurrent jurisdiction, police cooperation, and judicial assistance. Until there is an acceptable arrangement governing the rendition of offenders between Hong Kong and mainland China, the one- country, two-systems formula cannot be stabilized. This is a case study in large-scale terms.
