Mothers on Trial by Phyllis Chesler Pdf

Updated and revised with seven new chapters, a new introduction, and a new resources section, this landmark book is invaluable for women facing a custody battle. It was the first to break the myth that mothers receive preferential treatment over fathers in custody disputes. Although mothers generally retain custody when fathers choose not to fight for it, fathers who seek custody often win—not because the mother is unfit or the father has been the primary caregiver but because, as Phyllis Chesler argues, women are held to a much higher standard of parenting. Incorporating findings from years of research, hundreds of interviews, and international surveys about child-custody arrangements, Chesler argues for new guidelines to resolve custody disputes and to prevent the continued oppression of mothers in custody situations. This book provides a philosophical and psychological perspective as well as practical advice from one of the country’s leading matrimonial lawyers. Both an indictment of a discriminatory system and a call to action over motherhood under siege, Mothers on Trial is essential reading for anyone concerned either personally or professionally with custody rights and the well-being of the children involved.

Custody Battles by Gregory Ashe Pdf

Some parents would die for their children. Others will do a whole lot worse. Emery Hazard and his husband, John-Henry Somerset, are settling into their new normal—at home, with the latest addition to their family, and at work, as Somers adapts to his new role and Hazard manages his expanding agency. The only thing Hazard is worried about is getting through dinner with his in-laws. When his father-in-law requests that Hazard and Somers join him for a weekend deer hunting, it sounds simple enough: spend a night camping, give their foster son a chance to spend time with his friend, and—possibly—prevent a parental kidnapping. But nothing is ever as simple as it sounds. At deer camp, Hazard and Somers find themselves drawn into a toxic family feud between parents battling for custody. After the husband is shot and killed deep in the forest, detectives from the Sheriff’s Department are convinced that the killer is a local extremist—a member of the neo-Nazi Ozark Volunteers. Hazard and Somers, though, aren’t so sure, and as they probe deeper into the killing, they find that many people had a reason to want the victim dead, and the killing itself might not be what it seems. Then a drive-by shooting almost claims the lives of Hazard, Somers, and the victim’s wife. The killer’s work isn’t done, and Hazard and Somers must race to find the truth before the killer strikes again.

The 10 Stupidest Mistakes Men Make When Facing Divorce by Joseph Cordell Pdf

The Knowledge Every Man Needs for a Successful Divorce Each year 500,000 men will face divorce, and most of them make at least one crucial—and often irreversible—mistake. These errors might seem minor, such as moving out while things get sorted out, or thinking of “temporary” orders as being truly temporary. But when they get to court, these men discover they have put themselves in a terrible position. They may have to give up their house, pay impossibly high alimony, or even lose custody. You could be one of these men. But you don’t have to be. Joseph Cordell, the founder of the nation’s largest law firm focusing on men’s divorce and the creator of the Dads Divorce website, has seen the consequences of the mistakes men make. Drawing upon the huge number of cases that Cordell & Cordell has handled, this book identifies the 10 most common mistakes that end up hurting men in divorce. Cordell demystifies the divorce process, explains what judges consider in making their final decisions, and lays out a road map for positive actions men can take to achieve the best possible outcome. No man should face divorce without this book.

Parental Alienation Syndrome in Court Referred Custody Cases by Janelle Burrill Pdf

This dissertation summarizes the research of 30 court referred, custody dispute cases assessing the behaviors of the parents and their children to determine the presence or absence of Parental Alienation Syndrome (PAS). The criteria to determine the parent and their children's behaviors is Dr. Gardner's definition of Parental Alienation Syndrome. The parents were placed in three categories (mild, moderate or severe) based on their symptoms and behaviors. Their children (59) were then categorized into three groups (mild, moderate, severe). This investigation seeks to determine additional information regarding the presence or absence of PAS. Reluctance by the courts and mental health community to accept the validity of PAS probably contributes to the perpetuation of the disruption of parent-child relations in custody disputes. Findings and Conclusions: It appears the data from this study corroborates observations and definitions of Parental Alienation Syndrome. The data from this study indicates that the parents in the mild PAS category have children who exhibit fewer negative behaviors toward the alienated parents whereas children whose parents are in the severe category exhibit more negative behaviors towards the alienated parents. This study found that the more negative behaviors a child exhibits towards an alienated parent, the more severe their parent's symptoms and behaviors. Consequently, there is more severe alienation from the alienated parent and the more disruption to that parent-child relation. PAS is a distinctive form of child abuse generally found in intractable custody disputes. Download 1st chapter & ByteSizeSystems Reader FREE - and buy ByteSize b-book for $5.00.

Relocation Issues in Child Custody Cases by Philip M. Stahl,Leslie M. Drozd Pdf

Find out how evaluators, mediators, and judges deal with the issues of relocation in divorced families In the past, the relocation of a parent or child in custody cases was rarely a problem for divorced families—there was little conflict and little need for court intervention. But with the growth of shared custody, more fathers involved in parenting after divorce, and an increase in litigation between conflicted parents, relocation has become a complex issue that’s difficult for evaluators, judges, and public policymakers to resolve. Relocation Issues in Child Custody Cases offers a firsthand look at how evaluators investigate, predict, and make recommendations; how judges reach decisions based on those recommendations; and how individual states deal with relocation cases. Relocation Issues in Child Custody Cases examines how evaluators, mediators, and judges can best facilitate an environment where a child has an ongoing relationship with two parents, regardless of where each parent lives. This unique book looks at how the landscape in relocation cases has changed since the California Supreme Court’s landmark 2004 ruling in the LaMusga move-away case, examining relevant topics, including individual state statutes on relocation; a survey of courts in the United States; the functions of an evaluator; how a judge analyzes data before reaching a decision; parental conflict; domestic violence; change of circumstances; primary residence; and the process of developing parenting plans. Relocation Issues in Child Custody Cases examines: whether negative outcomes of parental relocation after divorce were a result of pre-existing conflict and domestic violence whether the “best interests of the child” is an acceptable standard in relocation cases investigative models for evaluators “for the move” and “against the move” biases—and how to reduce them a format for analyzing evidence in relocation cases the risks and benefits of presumptions in family law matters and much more Relocation Issues in Child Custody Cases is an essential resource for evaluators, mediators, judges, caseworkers, child psychologists, family therapists, and child advocates.
