In July 2012, the House agreed to allow debates on Government e-petitions to take place on Mondays in Westminster Hall, on a trial basis during the current session. Three debates have taken place during the session, with a fourth scheduled on the day of publication of this report (22 April 2013). The Government's e-petitions website continues to be popular, and a dedicated slot in Westminster Hall on Monday afternoon provides a clear end-point for the process. The Procedure Committee agrees with the Backbench Business Committee that the trial has been successful and recommends that the temporary changes to the Standing Orders be made permanent.

Whilst the Government's initiative of e-petitions is welcome in principle, there have been some practical problems with its operation. In this report two areas which need urgent attention have been addressed, the time for debate and public understanding of the process.The Committee recommends that a dedicated time slot be created for debates on subjects that are raised by e-petitions and propose that this is an extra sitting in Westminster Hall between 4.30 and 7.30 pm on a Monday. This would only take place if the Backbench Business Committee had scheduled a debate on the subject of an e-petition. This change would be experimental and its effectiveness be reviewed after one year.Many of the problems experienced by the Backbench Business Committee and by petitioners have arisen from a failure on the part of the Government to adequately explain the process to petitioners. The Committee recommends that the information on the Government's website should be made clearer and more accurate. When a petition has been signed by 100,000 people, the lead petitioner should be advised to find an MP who is willing to apply to the Backbench Business Committee for time for debate

The public will be able to petition the House of Commons electronically for the first time, under proposals published by the House of Commons Procedure Committee today. It concludes that: Commons select committees are more effective, and election of select committee chairs and members by MPs in a secret ballot, instead of being appointed by the whips, as recommended by Wright, have brought greater transparency and democracy; the Backbench Business Committee, another suggestion of Wright, has been a success, giving backbenchers the chance to decide the subjects of debates covering about a quarter of the House's time; another key Wright recommendation - a House Business Committee which would give backbenchers an influence on the rest of the House's agenda - can be and should be introduced without delay. The Coalition Agreement said in 2010 that the Committee would be established by the third year of this Parliament; the House's petitions procedure is failing to meet public expectations. There is too much confusion between the roles of Government and Parliament. The Committee argues that there is still a case for the establishment of a petitions committee and recommends that officials work up a detailed and costed proposition which could then be put to the House for its endorsement

Finally the Committee has proposed some technical changes; that the Chairman of Ways and Means have overall responsibility for all sittings in Westminster Hall; that the Chair have the power to suspend a sitting and report disorderly conduct to the House; and that unused provisions of the standing order governing business in Westminster Hall be repealed

In October 2010 the Committee in response to a report by its predecessor committee began a trial exercise in monitoring unsatisfactory and late answers to written Parliamentary questions. With just over 50 complaints from Members in response to the exercise of which half were followed up. This resulted in answers for Members on a number of occasions in circumstances where they would otherwise have found difficult or impossible to follow up on an inadequate response. The exercise will now come to an end and be put on a more permanent footing.In consideration of a memorandum from the Leader of the House providing statistics on the time taken to respond to WPQs in 2010-12, the committee has sought explanations from Ministers in charge of poorly performing departments for the level of performance in the memorandum and what steps are being taken to improve these levels. The Department for Education had a particularly poor performance and evidence was taken from the Parliamentary Under Secretary and a senior official in the Department which the Committee found unsatisfactory with and so a follow up session with the Permanent Secretary and Secretary of State was undertaken. The Committee will continue its interest in the answering performance of this Department and hold it to further account should its performance not improve markedly.

Public Petitions and Early Day Motions (EDMs) are both processes that are used by Members of Parliament to bring to the attention of the House of Commons the concerns of particular groups of the population. EDMS are frequently drafted by groups or organizations outside the House and then tabled by Members as demonstrations of support for them. Both procedures allow the public to engage with Parliament, either directly, by signing a Petition, or indirectly, by urging their Member of Parliament to add his or her name to an EDM. This report examines the current procedures that govern them, whether they are appropriate and effective and how well they meet the demands which Members wish to make of them. For Public Petitions the Committee recommends: a requirement on the Government to respond formally to all petitions within two months of their presentation; publication of the texts of petitions and responses to them in Hansard; easier access to petitions on the parliamentary website and opportunities for debates on petitions in Westminster Hall. For Early Day Motions, the Committee recommends the continuation of the present arrangements for the printing of EDMs, but there should be further consideration of e-tabling and that the Modernisation Committee should consider the introduction of a separate procedure to allow substantive motions tabled by backbenchers to be debated.
