The European Convention on Human Rights and its Case Law in Relation to the Deportation of Aliens by Arnold Ackerer Pdf

Seminar paper from the year 2004 in the subject Law - European and International Law, Intellectual Properties, grade: A, Hiroshima University (International Law), course: Internationales Recht, language: English, abstract: To learn from the atrocities committed during the Second World War and to avoid their reoccurrence was the declared aim of all nations after the WW II was over and the Axis powers had been defeated. Once and for all it had become clear that the protection of human rights could not be regarded as any nation’s internal affairs. In Europe, Nazi-Germany served as a deterring case how a national regime could impose progressively worse treatments (from discriminations to genocide) on certain minorities, if no outside control provided an ultimate safeguard. The aim of the international law treaties signed inside Europe after WWII was to provide exactly such a safeguard and to integrate defeating and defeated countries into binding cooperation. One such cooperation took the form of the European Communities (most prominently the EC), another one the form of the Council of Europe (the organization drafting and controlling the European Convention on Human Rights (henceforth: convention)). In this paper using the issue of deportation of aliens I want to provide an overview on the position of a typical European country like Austria in regard to the obligation derived from the convention institution’s case law. ⇒ What is “deportation”? (Merriam-Webster’s Dictionary of Law). The removal from a country of an alien whose presence is illegal or detrimental to the public welfare. NOT: Exclusion: refusal of entry into a country by the immigration officials. NOT: Extradition: the surrender of an accused usually under the provisions of a treaty or statute by one sovereign (state or nation) to another that has jurisdiction to try the accused and that has demanded his or her return. Which aliens enjoy welcome varies with different nations, the four problem categories below, however, serve as a general outline for understanding “unwanted immigration”. i.) illegal aliens discovered on a nation’s territory ii.) legal long-term aliens becoming illegal iii.) legal aliens committing misdemeanors iv.) 2nd generation immigrants (or later) committing misdemeanors

Impossible Subjects by Mae M. Ngai Pdf

This book traces the origins of the "illegal alien" in American law and society, explaining why and how illegal migration became the central problem in U.S. immigration policy—a process that profoundly shaped ideas and practices about citizenship, race, and state authority in the twentieth century. Mae Ngai offers a close reading of the legal regime of restriction that commenced in the 1920s—its statutory architecture, judicial genealogies, administrative enforcement, differential treatment of European and non-European migrants, and long-term effects. She shows that immigration restriction, particularly national-origin and numerical quotas, remapped America both by creating new categories of racial difference and by emphasizing as never before the nation's contiguous land borders and their patrol. The Refugee in the Post-War World by Jacques Vernant Pdf

First published in 1953, The Refugee in the Post-War World presents a comprehensive survey on the global refugee situation after the Second World War. Chapter I and II of Part I attempt a definition of what is meant by a refugee and states the problems to which the refugees give rise for the receiving countries and the international community; chapter III contains a brief account of the work of the international bodies concerned with refugees from the First World War onwards; and chapter IV tells the story of the various ethnic and national groups of refugees after the Second World War. The other parts give an analysis of the refugees’ situation in the different countries. The latter are classified in two ways: according to their place on the map and to their capacity to absorb refugees. Each chapter describing the refugee position in a particular country is divided further into three sections: an introduction intended to afford a bird's eye view of the general refugee problem in that country; a second section setting forth the main legislative provisions applicable to aliens and, more specially to refugees; and the third which gives an account of the refugees’ economic and social conditions. This is an important historical reference work for scholars and researchers of refugee studies, international relations, political studies, and immigration studies.

The Deportation Regime by Nicholas De Genova,Nathalie Peutz Pdf

This important collection examines deportation as an increasingly global mechanism of state control. Anthropologists, historians, legal scholars, and sociologists consider not only the physical expulsion of noncitizens but also the social discipline and labor subordination resulting from deportability, the threat of forced removal. They explore practices and experiences of deportation in regional and national settings from the U.S.-Mexico border to Israel, and from Somalia to Switzerland. They also address broader questions, including the ontological significance of freedom of movement; the historical antecedents of deportation, such as banishment and exile; and the development, entrenchment, and consequences of organizing sovereign power and framing individual rights by territory. Whether investigating the power that individual and corporate sponsors have over the fate of foreign laborers in Bahrain, the implications of Germany’s temporary suspension of deportation orders for pregnant and ill migrants, or the significance of the detention camp, the contributors reveal how deportation reflects and reproduces notions about public health, racial purity, and class privilege. They also provide insight into how deportation and deportability are experienced by individuals, including Arabs, South Asians, and Muslims in the United States. One contributor looks at asylum claims in light of an unusual anti-deportation campaign mounted by Algerian refugees in Montreal; others analyze the European Union as an entity specifically dedicated to governing mobility inside and across its official borders. The Deportation Regime addresses urgent issues related to human rights, international migration, and the extensive security measures implemented by nation-states since September 11, 2001.
