Témoin de l'ampleur du phénomène, la Cour européenne des droits de l'homme est régulièrement saisie du cas de personnes qui, au nom de leur conscience, refusent d'accomplir le service militaire, de prêter serment sur la Bible, de siéger dans un jury, de collaborer à un avortement, de faire vacciner leurs enfants, etc. Une clarification de la notion d'objection de conscience s'impose donc, non pas pour étendre son champ d'application au point de la rendre indéfendable, mais au contraire pour mieux le définir afin qu'elle puisse être garantie dans une juste mesure. Dans une société qui a renoncé, au moins partiellement, à la conviction publique qu'il existe un bien objectif, se refuser à accomplir ce travail de réflexion reviendrait à renoncer à la rationalité de la justice et à se résigner à l'arbitraire.
