Compensation for Environmental Damage Under International Law by Jason Rudall Pdf

Inspired by recent litigation, this book identifies and critically appraises the manifold and varied approaches to calculating compensation for damage caused to the environment. It examines a wide range of practice on compensation – in general and specifically for environmental damage – from that of international courts and tribunals, as well as international commissions and regimes, to municipal approaches and other disciplines such as economics and philosophy. Compensation for Environmental Damage Under International Law synthesises these approaches with a view to identifying their blind spots, bringing clarity to an area where there exists broad discrepancy, and charting best practices that appropriately balance the manifold interests at stake. In particular, it is argued that best practice methodologies should ensure compensation serves to fully repair the environment, reflect the emerging ecosystems approach and any implications environmental damage may have for climate change, as well as take into account relevant equitable considerations. This book is essential reading for academics, practitioners and students working in the field of environmental law.

Environmental impacts are increasing due to human activities. The overuse of the benefits nature provides us is the direct result of our failure to put a price on these benefits. One way of addressing this is to require environmental compensation. The purpose of the study is to provide Nordic Council of Ministers and national decision-makers with an overview of key conditions for increased, flexible and cost-effective application of compensation. The study shows that for a relatively small cost society can make a significant investment in the provision of biodiversity and ecosystem services by requiring compensation. The study outlines three main recommendations on how to increase the use of environmental compensation: 1. Stimulate supply of, and demand for, compensation 2. Clarify and supplement guidelines and legal framework 3. Strengthen Nordic cooperation on compensation

Compensation for Environmental Damages Under International Law by Tarcísio Hardman Reis Pdf

At present there is no clear model under international law with which to determine compensation for environmental damage. After showing that no existing standard of compensation defined by the theory and practice of international law is adequate to cover all cases involving environmental damages - and that such a broad standard or set of standards may in fact be ultimately unachievable - the author of this important book develops a 'fair compensation' regime from an analysis of existing international dispute adjudication mechanisms, and presents this model as the best possible current approach to the conciliation of international responsibility and environmental interests.

Anthropogenic Environmental Hazards by Pankaj Pathak,Rajiv Ranjan Srivastava,Sadia Ilyas Pdf

This book delves into the anthropogenic activities responsible for environmental hazards, their compensation, and potential mitigation strategies. It sheds light on the major contributors to the climate change issues aggravated by non-sustainable practices for the overexploitation of natural resources. Critical topics such as high emissions in primary mining, the recovery of energy-critical metals by urban mining, solid waste management, and forest conservation are explored, offering insights into the urgent challenges we face. Amidst the rapid demand for resources and the expansion of human habitats, the book emphasizes the need for new approaches to natural resource management and introspection of our actions. Experts in the field discuss existing anthropogenic environmental hazards in detail, alongside environmental compensation, and effective mitigation approaches. The book begins with a chapter dedicated to risk assessment in primary mining activities for precious metals, proposing potential routes for mitigation. Chapter 2 focuses on assessing and mitigating the environmental footprints of energy-critical metals used in permanent magnets. In Chapter 3, a case study examines sustainable resource utilization through end-of-life room air conditioner recycling. Additional chapters provide critical insights into: The environmental impacts of e-waste and government policies for responsible management Hazards associated with industrial effluents and corresponding mitigation strategies The role of roadside plants in phytoremediation of heavy metal pollution Sustainable utilization of anthropogenic coal fly ash through mechanical and chemical activation Environmental damages resulting from the mismanagement of municipal solid waste Environmental problems and remediation strategies for anthropogenic biomass waste Challenges in sustainable municipal solid waste management and suggestions for environmental risk mitigation The book concludes with a chapter discussing collaborative governance and non-monetary compensation mechanisms for sustainable forest management. Given its breadth, this book serves as an indispensable resource for researchers, policymakers, and environmental professionals seeking sustainable approaches to tackle pressing environmental challenges.

An Eco-Compensation Policy Framework for the People's Republic of China by Qingfeng Zhang,Tun Lin Pdf

Economic growth has multiplied the environmental challenges faced by the People's Republic of China but has also created opportunities, by increasing available funding for environmental management and conservation. At the nexus of these countervailing trends, policy makers have been experimenting with new approaches to environmental management under the broad heading of "eco-compensation". Many of these are market-based, particularly payments for ecosystem services; an emerging policy debate is regarding the extent to which beneficiaries should pay, and the providers should be compensated, for the provision of natural resources and environmental services to promote sustainable, balanced growth. This paper synthesizes the findings of the International Conference on Payments for Ecological Services convened in Ningxia Hui Autonomous Region in September 2009 to support eco-compensation programs in the country.

Environmental Damage in International and Comparative Law by Michael Bowman,Alan E. Boyle Pdf

This study considers the problems of defining and valuing "environmental damage" from the perspective of international and comparative law. The need for a broad and systematic evaluation of this issue is illustrated by the number of topics presently on the international law-making agenda to which it is relevant, including the UN Compensation Commission's decisions on compensation for environmental losses suffered by Kuwait in the Gulf War, nuclear and oil pollution liability regimes, the development of an environmental liability protocol to the Antarctic Treaty and other agreements on bio-safety and genetically modified organisms. It is thus an important element in contemporary efforts to strengthen legal remedies for environmental harm which does not necessarily come within traditional categories of legally protected personal or property rights.

Toward a National Eco-compensation Regulation in the People's Republic of China by Asian Development Bank Pdf

The Asian Development Bank and the National Development and Reform Commission of the People's Republic of China (PRC) undertook a study on eco-compensation regulations development in the country, on which this publication is based. The study examined the PRC's theory, practice, and legislation governing eco-compensation in selected ecological areas to map out the scope and content of a national eco-compensation regulation. Pursuit of its higher agenda of ecological civilization and development of its national eco-compensation regulation will require the PRC to capture the diversity that subnational projects have tapped, integrate its experience with eco-compensation at all levels of government into a coherent national regulatory framework, and harmonize this framework with existing laws and other legal instruments.

Harm to the Environment by Peter Wetterstein Pdf

In international and comparative environmental law the notion of environmental damage is gaining increasing interest. The question of compensating environmental damage challenges traditional rules and concepts of tort law. This book addresses two key issues: 1) the right to and extent of damages for environmental impairment and 2) the methods for conducting natural resource damage assessments. The strong and diverse contributions to this volume of essays, contributed by an internationallyknown team of experts, underline the view that prevention should be the focus of effort to protect the environment. Such an approach is needed because of the limited possibilities offered by the law for adequate and effective compensation in the case of environmental damage. With limited exceptions most countries have adopted a cautious approach to the issue of compensation but new developments on the civil liability front have approved reasonable restoration costs as a basic measure for recoverable damages. It also appears that the methods for evaluating environmental damage developed so far have been artificial and arbitrary. This and many other issues are discussed in detail and implications and consequences for the future spelled out.

Gulf War Reparations and the UN Compensation Commission by Cymie Payne,Peter Sand Pdf

In Gulf War Reparations and the UN Compensation Commission: Environmental Liability, experts who held leadership positions and worked directly with the UNCC draw on their experience with the institution and provide a comprehensive view of the United Nations Compensation Comission and its work in the aftermath of the Gulf War. In this volume, the first of two on the UNCC's work, the authors explain that the United Nations Security Council established the ad hoc compensation commission to address reparations as a component of the ceasefire following Iraq's 1990-91 invasion and occupation of Kuwait. The authors also describe how the work of the United Nations Compensation Commission addressed important questions of state responsibility, environmental liability, mass claims processing, international law, and dispute settlement institutions in the post-armed conflict context. Readers will also learn that the scope and the scale of the UNCC was extraordinary, since almost 2.7 million claims from 80-plus countries were submitted to the Commission (which awarded in excess of $55 billion and has paid out more than half of that total), and that this led to the development of innovative procedural, institutional and managerial approaches in handling mass, environmental, and corporate claims at a scale that is unparalleled. Additionally, the books note that the Commission also contributed to the evolution of international jurisprudence in these areas.
