Essays in Legal History by Paul Vinogradoff, Sir Pdf

Excerpt from Essays in Legal History: Read Before the International Congress of Historical Studies, Held in London in 1913 The collection Of papers in this volume consists Of the communi cations made to the Section Of Legal History (via) of the Inter national Congress of Historical Studies held in London in April 191 3. All the papers read in the Section have been kindly contributed by their authors for this publication. In some cases, where the communications actually read were in the nature of extracts from longer treatises, the papers have been reproduced here in exzemo. The papers of Geheimrath O. Von Gierke and Dr. A. Lappo Danilevskij were read at General Meetings of the Congress, but were written for the Section of Legal History, and naturally take a place in its transactions. The essays in the present volume are presented in a different order from that in which they followed each other at the Congress, as it was desirable to group them some what more systematically. On several occasions some discussion followed the reading of the papers, but it proved unnecessary to publish the minutes Of such discussions, as most Of the principal points were afterwards embodied in the revised texts Of the communications. Essays in Jurisprudence and Legal History by John William Salmond Pdf

Excerpt from Essays in Jurisprudence and Legal History § I. One fact is evidence of another when it in any degree renders the evidence of that other probable. The quality by virtue of which it has such an effect may be called its probative force, and evidence may be defined as any fact possessing probative force. Such force may be of any degree of intensity. Where it is great enough to form a rational basis for an inference, the evidence possessing it constitutes Proof. An essential requisite for the discovery of truth is the correct measurement of probative force. Now in this matter judicial action differs strikingly from the other departments of action and inquiry. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Select Essays in an Anglo-American Legal History, Vol. 1 of 3 (Classic Reprint) by James Fitzjames Stephen Pdf

Excerpt from Select Essays in an Anglo-American Legal History, Vol. 1 of 3 By the year 900 Roman jurisprudence had reached its zenith. Papinian was slain in Ulpian in 998 3 Ul pian's pupil Modestinus may be accounted the last of the great lawyers.4 All too soon they became classical; their successors were looking backwards, not forwards. Of the work that had been done it were folly here to speak; but the law of a little town had become ecumenical law, law alike for cultured Greece and for wild Britain. And yet, though it had assimilated new matter and new ideas, it had always preserved its tough identity. In the year 900 six centuries and a half of definite legal history, if we measure only from the Twelve Tables, were consciously summed up in the living and growing body of the law. Legal Essays (Classic Reprint) by James Bradley Thayer Pdf

Excerpt from Legal Essays I am fully aware how far my work, even in merely collecting what has already been published, must fall short of what would have come from my father's hand. And I have also had some painful doubts whether he would approve of publishing some of the articles at all in their present form without his revision. But it has seemed to me on the whole that with an explanation, which I have undertaken in each instance to give, of the date and circumstances under which they were written, their publication is justified. I have made no changes in the articles except in the ease of clerical errors and the like, which Professor Thayer had corrected in his own copy. All notes which I have added are enclosed in square brackets. Most of the matter so added, and all which shows the result of study or research, is taken from memoranda of Professor Thayer's on the margin of his copies or in his collections of cases. Apices Juris and Other Legal Essays, in Prose and Verse (Classic Reprint) by Charles Morse Pdf

Excerpt from Apices Juris and Other Legal Essays, in Prose and Verse This book is not a very large one, but it bulks in one respect, namely, variety of contents. In glancing over it the author is afirighted at the spectre of heterogeneity that arises from its pages. But, on the other hand, the book extends itself wholly within the domain of the literature of the law; and it may well be that this very diversity will prove its fortune at the hands of the profession in the mass. There is an attempt to provide matter fittingly serious for him who thinks the hard science of the law has no light some side; while there is a fair portion for those who hold to the view that waters from the fountain of Justice may be improved, upon occasion, by the process of aeration. Hence it is hoped that the tide upon which this entirely new departure in Canadian legalliterature is launched will not turn out to be that of sullen Lethe, ' but the sort which, taken at the flood, leads on to more than dreams of royalty cheques and pleasant demands for new editions. The author avails himself of this opportunity to confess his obligations to the publishers of the Ameri can Law Review, the Green Bag, the Canadian Law T z'mes and the Canada Law Journal for their cour teous permission to reprint here several of their articles protected by copyright. Elements of Right and of the Law by George Hugh Smith Pdf

Excerpt from Elements of Right and of the Law: To Which Is Added a Historical and Critical Essay Upon the Several Theories of Jurisprudence IN submitting this little work upon jurisprudence to the public, the author is conscious that the sub j ect is one not likely to attract at first sight either the professional or the general reader; as the latter will probably regard it as belonging exclusively to the province of the former; while the former will be apt to consider any work on general principles as nu worthy the attention of the practical law yer. It will not be out of place, therefore, to explain at some length the object and scope of the work, with a view of showing that the subject at least is one pre eminently worthy of the attention of all intelligent readers. The subject is expressed in the title of the work, and will be readily understood by reference to the table of contents. The first book treats of the nature of rights, and of their several kinds, and of the princi ples by which they are determined; and the second of the nature and general principles of the law, and of its relation to right; the remaining book consists of a historical and critical review of the several theories of jurisprudence. The Doctrine of Judicial Review, Its Legal and Historical Basis, and Other Essays (Classic Reprint) by Edward Samuel Corwin Pdf

Excerpt from The Doctrine of Judicial Review, Its Legal and Historical Basis, and Other Essays In the preparation of another volume, not yet published, I have encountered a number of questions involving controversies important to the student of American Constitutional History, an extended consideration of which however in those pages I felt to be out place. The following studies present my conclusions with regard to these questions, and the grounds of them. In the principal essay, I have endeavored to present judicial review as the outcome of a view of legislative power which arose in consequence of the astonishing abuse of their powers by the early State legislatures but which was first appreciated for its full worth by the Convention that framed the Constitution of the United States. Incidentally I have, I trust, laid to rest that most inconclusive "explanation" of judicial review which dwells on the idea that a legislative measure contrary to the constitution is not law and never was. The alleged explanation totally ignores the crucial question, which is, Why is it the judicial view of the constitution that legislative measures have to conform to? The article on the Dred Scott Decision treats of the most dramatic episode in the history of judicial review, though one that is by no means the best illustrative of the spirit of the institution. Essays in Jurisprudence and Ethics (Classic Reprint) by Frederick Pollock Pdf

Excerpt from Essays in Jurisprudence and Ethics The substance of the following Essays has appeared in divers journals and reviews in the course of the last seven years. My first duty is to return my best thanks to the proprietors and editors of those publica tions for the consent they have freely given to the present reproduction. Some additions and rearrange ments have been made, and a few passages have been worked in from articles on kindred subjects which for one or another reason did not seem worth reprinting separately. No unity of design will be expected in a work thus composed of occasional pieces; but I hope that so much unity of purpose and ideas may nevertheless be found in it as will give it a certain measure of coherence. The essays fall into two divisions, in the first of which legal topics predominate, in the second ethical. In' the first it has been my aim to consider legal ideas and institutions as affected by or affecting the wider interests of history, politics, and practical legislation. In the second I have endeavoured to bring to a better defined issue certain points of ethi cal discussion by the help of distinctions founded on familiar legal conceptions, and by specifically applying those conceptions and distinctions to admitted facts. The History of the Doctrine of Consideration in English Law by Edward Jenks Pdf

Excerpt from The History of the Doctrine of Consideration in English Law: Being the Yorke Prize Essay for the Year 1891 The Common Law will probably be manifest to any one who takes the trouble to read his essay but he would deem himself wanting in gratitude did he not here make a formal and personal acknowledgment of it. The only other thing which it seems necessary to say is, that the rules of the University on the subject of the Yorke Prize compel the publication of the successful essay in a permanent form.
