Two ofthe most important notions concerning the rights of people with mental illness are among the most neglected: the first is that human rights and duties are complementary and that both must be considered in constructing a framework for mental health care. The second is that we must strive for equity and not only for equality in developing mental health programs. The first ofthese notions is complex. It refers to the duties ofpeople with mental illness and to the duties ofthose who surround them. Mental illness does not liberate the person who has it from civic obligations. The most basic ofthese is to give support to others and to refuse to harm them Their carers, society and the patient's self-respect all gain through their recognition, even though the fulfilment of these obligations might be difficult or impossible in certain periods ofillness. The duty of those surrounding the patients is to recognise and respect their existence and to make the necessary arrangements to respond to their needs, protect their rights and compensate for their temporary or permanent inability to fulfil their civic duties. A society's social capital is the public good that results from the mutual supportofmembers ofa society: iffor one reason or another, some or all members ofa society fail to offer such support the social capital will diminish and the society will cease to be civic.

This publication is the second volume of Thematic Human Rights Guides published under the auspices of the Raoul Wallenberg Institute of Human Rights and Humanitarian Law. The aim of the Guides, as the title implies, is to facilitate the use of international human rights standards by their systematic presentation. Rather than reproducing full texts of various instruments, substantive standards are grouped according to subject-matter in order to enable users to quickly and easily locate the topic they may be looking for. A detailed index, with references to the many international instruments which address the same issue, reinforces this thematic approach. The choice of human rights and health for the second volume in this series highlights the aim of the Guides: to map out the entire range of human rights and fundamental freedoms as they relate to a specific topic. The sheer size of this volume illustrates the number and variety of human rights standards relevant for health. Many of these standards have been generated by organizations dealing with health rather than human rights, and quite a few are found under medical ethics rather than human rights. Subsuming medical ethics under international human rights law is a novel development, pioneered by the Council of Europe. Ethical medical practice and treatment in psychiatry are based on the concept of first do no harm. However, this cannot, and does not, apply to forensic cases where there is no doctor–patient relationship and the forensic psychiatrist may indeed cause harm to the examinee. In this book, Robert Sadoff analyzes the ethical issues affecting forensic psychiatric practice, especially those promulgated by the American Academy of Psychiatry and the Law. The EUROHIS project has focused on the comparability of health surveys and has uncovered some problems that arise when aiming to compare data from different countries. Similar problems of cross-cultural comparability also arise when comparing data from other sources, such as health registers, and are just as complex and difficult to tackle. One of the main advantages of health surveys, however, is the relatively low cost and time involved in adapting them according to the needs of health policy-makers. This work shows that the output from the EUROHIS project provides common instruments for the measurement of eight health indicators. The development of these instruments has required careful consideration of relevant common concepts and how these should be defined and operationalized.
