The end of the eighteenth century was a transformational period for the Muslim communities of the Russian Empire and their relationship with the tsarist state. Though they had been under Russian rule since the sixteenth century, it was at this time that they were incorporated into the imperial bureaucracy, most significantly through the founding of an official hierarchy for the Islamic religious scholars in 1788. The introduction of a state-backed structure for Muslim religious institutions altered Islamic religious authority and, in turn, religious discourse. One of the major figures to emerge from this new context was Abu Nasr Qursawi (1776-1812). A controversial figure who was condemned for heresy in Bukhara in 1808, Qursawi put forward a sweeping reform of the Islamic scholarly tradition. Focusing on taqlid, the principle of conformity to established doctrine, Qursawi argued that its overuse had weakened scholarship in the areas of Islamic law (fiqh) and theology (kalam) and undermined scholars' ability to serve as religious guides. In Preserving Islamic Tradition, Nathan Spannaus presents the first detailed analysis of Qursawi's reformist project, both in its contours and broad historical setting. Spannaus shows how state control of Muslim institutions impacted religious discourse, but also how it altered the entire religious environment into the twentieth century. Addressing issues of modernity, secularity, tradition, and intellectual history, Preserving Islamic Tradition demonstrates how the interaction with a European imperial state transformed the Islamic tradition, both directly and indirectly, and elicited new forms of religious thought and discourse.

Since September 11, 2001 much has been written about 'Islamist terrorism,' arguing that it is a perversion that has 'hijacked Islam' in the service of social, political and economic grievances. However, such accounts cannot explain why other people that can lay claim to similar or more serious grievances have not developed such devastating religious terrorist ideologies. Moreover, many of the terrorists themselves have attested to their own religious motivation and their belief that they acted in accordance with the precepts of Islam. In Warrant for Terror Shmuel Bar examines fatwas—legal opinions declaring whether a given act under Islam is obligatory, permitted, or forbidden. Fatwas serve as a major instrument by which religious leaders impel believers to engage in acts of jihad. Bar argues that fatwas, particularly those that come from the Arab world, should not be dismissed as a cynical use of religious terminology in political propaganda. Many terrorists testify that they were motivated to act by them. Indeed, this book shows that Islamic law plays a central role in determining for believers the practical meaning of the duty to jihad. Bar examines the underlying religious, legal, and moral logic of fatwas and the depth of their influence, particularly in contrast to alternative moderate Islamic interpretations. He explores the wide scope of issues that fatwas deal with, covering almost all facets of Islamic 'law of war': the justification for declaring jihad; the territory in which the jihad should be fought; whether women and children may participate in jihad; the legality of killing women, children and other non-combatants; the justification for killing hostages and mutilating their bodies; and the permissibility of diverse tactics and weapons, including suicide attacks and even nuclear weapons and other weapons of mass destruction. Warrant for Terror also delves into the contradictions between the radical and the mainstream narratives and the sources of the weakness of the latter in the face of the former. In the conclusion, the author raises a number of provocative questions relating to the 'religious policy' of the West in the face of the threat of Islamic extremism. ABSTRACT Since September 11-2001, Western scholars classified the study of Islamic Jihad as one of the most important disciplines to be examined. They began to review the relevant original sources of Islam in depth. Many efforts were made by those scholars to understand The Quran, holy book of all Muslims, looking for evidence that might support existing links between Islamic Jihad and the contemporary terroristic activities, if any. On the other hand, Muslim scholars and politicians have condemned all patterns of the contemporary terrorism, and have repeatedly confirmed the fact that Islam is a religion of peace, mercy and justice. Muslim scholars routinely provide positive evidence from The Quran and other Islamic sources to support the quality of Islamic teachings and guidelines. However, Muslim scholars and politicians have never attempted to comment or thoroughly elaborate such evidence or Quranic verses related to Jihad and fighting for the Cause of Allah as pointed-out by non-Muslim scholars. The dilemma facing Muslim scholars and politicians is not only to assure the quality of Islamic teachings, or to quote Quranic verses, which are not readily visible in most of the Islamic communities of today. The real dilemma is to provide satisfactory explanations and a uniform concept of Jihad or fighting for the Cause of Allah based on such variable sources. The challenge facing Muslim Scholars is adopting a common understanding on Jihad and Fighting for the Cause of Allah. It is urgent to determine whether Jihad or Fighting for the Cause of Allah is defensive or offensive, and to what extent. Whom are the targets of Jihad and fighting for the Cause of Allah? How and who is responsible in managing Jihad and Fighting Affares? What is the responsibility of the Islamic countries in combating Jihad and Fighting for the Cause of Allah, as far as they are obliged by the international laws? Does Jihad and Fighting for the Cause of Allah constitute a threat to International peace and security? This study provides an outline for the concept of Jihad and Fighting for the Cause of Allah from the perspective of the Muslim scholars and non-Muslim scholars. The intention of this study is inviting, or even provoking Muslim scholars to provide well established defense and come together with a uniform response that might create a favorable environment for all Muslims first, and for the human being second. This study is an attempt to: • Enhance the adoption of a uniform understanding of Islamic Jihad and Fighting for the Cause of Allah and enforce such understanding among the Muslims first • Provide a unanimously acceptable explanation of the Quranic verses related to Jihad and Fighting for the Cause of Allah. • Underline available Quranic and Sunna evidence that might nullify any allegations against Jihad and Fighting non-Muslims in the context of the contemporary thinking of western scholars. • Finally, to determine how far Islamic Jihad and Fighting for the Cause of Allah is a religious worshipping, and does not constitute any form of threat or terror for non-Muslims. By highlighting the controversial opinions of Muslim and non-Muslim scholars, this study may provide grounds to distinguish between Islamic Jihad and contemporary terroristic activities and political violence.

The Islamic term "fatwa" became known in the West after Ayatollah Khomeini's death sentence in 1989 on Salman Rushdie, the author of 'The Satanic Verses'. Mehdi Mozaffari reviews the history of the fatwa from its origins and its evolution to the present day. He looks at the general use of fatwa in relation to Islamic rules and traces the evolution of shi'ite Islam from a pacifist and quietist movement into a militant force.
