The Second Amendment and Gun Control Laws as a Subject of Debate by Lisa Schreinemacher Pdf

Seminar paper from the year 2019 in the subject American Studies - Culture and Applied Geography, grade: 1,7, University of Bonn, language: English, abstract: This study is concerned with the historical development of the Second Amendment and how it is interpreted today. In doing so, John Vile's "A Companion to the United States Constitution and its Amendments" and Adam Winkler's "Gun Fight" have been consulted to provide background information on the history of the Second Amendment. Due to the fact that this term paper also deals with current statistics on gun control laws, it also relied on online research and online publications. Firstly, there will be a chapter that deals with the original intent of the founding fathers, who framed the Second Amendment to the United States Constitution. It will provide an historical overview of the creation of the Second Amendment and what led to its inclusion into the Bill of Rights. It further tries to explain the founder's interpretation of the Second Amendment with regards to the militia. The third chapter will focus on the question of how the National Rifle Association was able to rewrite the Second Amendment in order to gain more profit and get support for gun rights. The chapter will present the approach taken by the NRA that resulted in a new interpretation of the Second Amendment and established the perception of an individual right to possess firearms within American society. It will take into account the Supreme Court cases of "United States v. Miller" of 1939 and "District of Columbia v. Heller" of 2008, that ultimately guaranteed an individual's right to own firearms without any connection to a militia. Another chapter will focus on gun control laws and provide a comparison between the United States and other developed countries. Furthermore, this chapter will give an insight into the perception of the Second Amendment within American society and discusses current gun control policies. Finally, the last paragraph of this term paper will be a conclusion, which sums up the results achieved and gives an outlook for future research on the Second Amendment and gun control laws.

Whose Right Is It? The Second Amendment and the Fight Over Guns by Hana Bajramovic Pdf

Discover the truth about the Second Amendment, the NRA, and the United States’ centuries-long fight over guns in this first-of-its-kind book for middle grade readers. "A compelling, clear analysis of one of our country’s oldest dilemmas: how to balance gun rights with public safety. It tells the full and true story of the Second Amendment, and points to a way to bring sanity to our gun laws. A remarkable primer for all ages." —Michael Waldman, author of The Second Amendment: A Biography For the majority of the United States’ history, the right to own a gun belonged to a “well regulated militia.” That changed in 2008 with the historic District of Columbia v. Heller case, which ruled that the Second Amendment protected an individual’s right. In the years since, the debate over gun legislation has reached a crescendo. And the issue grows ever relevant to children across America, with an estimated three million exposed to shootings every year. From metal detectors to see-through backpacks to shooting drills, kids face daily reminders of the threat of guns. Hana Bajramovic's Whose Right Is It? The Second Amendment and the Fight Over Guns reveals how a once obscure amendment became the focus of daily heated debate. Filled with historical photos and informative graphics, the book will show young readers how gun legislation has always been a part of American history and how money, power, and systemic racism have long dictated our ability to own guns. A Junior Library Guild Selection "Hana Bajramovic provides readers with a compelling overview on the history of guns in the United States and the changing, conflicting interpretations of the Second Amendment certain to stimulate conversation and thinking on the part of future generations." —Award-winning author Doreen Rappaport

Stopping Power by Joseph Neil Schulman,J. Neil Shulman Pdf

Did you know that every 13 seconds one of America's 70 million gun owners uses a firearm in defense against a criminal? That American women use handguns 416 times a day in defense against rapists, which is a dozen times more often than rapists use a gun? That a gun kept in the home for protection is 216 times as likely to be used in defense against a criminal than it is to cause the death of an innocent victim in that household? These are just a few of the surprises this book has in store for anyone whose belief in gun control is based on TV news or popular magazines. Award-winning novelist, screenwriter, and journalist, J. Neil Schulman, challenges the misinformation that pundits ranging from network anchors to ill-informed doctors are promoting about guns. Especially for the reader who doesn't own a gun and has never even considered buying one, Stopping Power should be an eye-opener.

Guns across America by Robert Spitzer Pdf

In vast swathes of America, the sacredness of the Second Amendment has become a political third rail, never to be questioned. Gun rights supporters wear tri-cornered hats, wave the stars and stripes, and ask what would have happened if the revolutionaries had been unarmed when the British were coming. They have had great success in conflating unfettered gun ownership with the Founding Fathers, the Constitution, and all things American, even in an era of repeated mass shootings. Yet the all-too-familiar narrative of America's gun past, echoed in the Supreme Court's Heller gun rights decision, is not only mythologized, but historically wrong. As Robert J. Spitzer demonstrates in Guns across America, gun ownership is as old as the nation, but so is gun regulation. Drawing on a vast new dataset of early gun laws reflecting every imaginable type of regulation, Spitzer reveals that firearms were actually more strictly regulated in the country's first three centuries than in recent years. The first "gun grabbers" were not 1960's Chablis-drinking liberals, but seventeenth century rum-guzzling pioneers, and their legacy continued through strict gun regulations in the 1920s and beyond. Spitzer examines interpretations of the Second Amendment, the assault weapons controversy, modern "stand your ground" laws, and the so-called "right of rebellion" to show that they play out in America's contemporary political landscape in ways that bear little resemblance to our imagined past. And as gun rights proponents seek to roll back gun laws and press as many guns into as many hands as possible, warning that gun rights are endangered, they sidestep the central question: are stricter gun laws incompatible with robust gun rights? Spitzer answers this question by examining New York State's tough gun laws, where his political analysis is complemented by his own quest for a concealed carry handgun permit and construction of a legal AR-15 assault weapon. Not only can gun rights and rules coexist, but they have throughout American history. Guns across America reveals the long-hidden truth: that gun regulations are in fact as American as apple pie
