The recent growth in corporate self-regulation of labour, environmental and financial practices has attracted the attention of scholars who have detailed the number and content of self-regulatory efforts in various sectors. Missing so far, however, has been an analysis of the effectiveness and impact of self-regulation. Does self-regulation actually work and under what conditions is it most likely to be effective? The answer to this question is particularly important for developing countries where corporate self-regulation is often seen as substitute for weak governance structures. The chapters in this volume evaluate the effectiveness of self-regulation compared to other forms of global regulation. Across sectors and states, corporate self-regulation works best when those who are regulated have a voice in deciding the content of codes and standards and when some mechanism of compliance exists at the level of the state. Unfortunately, opportunities for voice and state capacity for regulation are often lacking in developing countries. With the globalisation of markets, the phenomenon of market failure has also been globalised. There is a growing clamour - particularly from the main beneficiaries of globalization - that rules need to be established to govern the international economy, with a specific focus on questions such as copyright violations, trade sanctions and protections for foreign investment. Those who perceive they are disadvantaged by globalization demand other legal protections in relation to employment, cultural traditions and the environment.
The changes following more than two decades of economic reforms and globalization of the Indian economy – at state, corporate sector, and consumer level – raise interesting questions on the ways in which the stakeholders will continue to engage on the world stage, politically, socially and economically. One key feature of global trade over this period has been the growing importance of not only product standards but, importantly, labor, environmental, food safety and social standards. Being essentially a non-tariff barrier,standards have often become critical to market access and essential to sustained competitiveness. This has a clear impact on the manner in which both global and Indian business is conducted now and in the future. It also underlines the need for a new area of enquiry that addresses the following questions: How are the Indian public and private actors – the state, domestic firms, local consumers and society – influencing and being influenced by such standards? Do standards really matter in an overwhelmingly informal production sphere, with consumers deeply segmented on the basis of a highly skewed distribution of income and with the rural population becoming further marginalized?
