Out of the first series of public lectures titled (Re) membering Kenya organised by the Volume editors together with Twaweza Communications and supported by the Goethe Institut Kenya, The Ford Foundation and the Institute for International Education, and whose key outcome was the publication of Remembering Kenya Vol.1 (2010) grew a second round of lecture series. The second series took cognisance of the fact that the problems that bedevil Kenya as a nation go far beyond questions of culture and identity that Volume 1 dealt with. Thus, the second presentations revolved mainly around issues of economics, governance and power. The awareness of the role and/or lack of equity and social justice in causing Kenyas persistent problems informed all these presentations. Issues of how to bring marginalised groups into the mainstream were discussed. This Volume, in part, arises from the second presentations. The authors of chapters attempt to provide answers to the question: what entails (re)membering in post-conflict Kenya? From their work, it is clear that there is a lot to (re)member in Kenya, and many ways in which to reconfigure project Kenya. (Re)membering is re-thinking and re organising our ways of doing things. It entails a juggling of priorities; between peace and reconciliation, peace and justice, and seeking justice and reconciliation without undermining peace, all of which are arduous exercises. Reconciling misconceptions about places, issues and people is part of this reconstitution too. New pathways require being embraced, past mistakes (individual and collective) acknowledged and giving earnest meaning to the vow never again! Yet, as observed in this Volume, Kenyans must be vigilant against individuals and groups that have often resisted change. There are also material constraints to the achievement of the various economic activities that come with reconfiguring the Kenyan nation. Worse still there exist certain cultural underpinnings that continue to have a debilitating effect on efforts to forge a sustainable peace after conflict. These aspects require deep reflection and honest work. In part, the contributors to this Volume suggest how it can be done. There is a hint in these chapters that we need to find new organizing spaces and principles on which a new Kenya can move forward. Equally, debating the very meanings of social justice and reconciliation against the background of potential conflict should be a project of this endeavor. Questioning and identifying where impunity begun is key to this process. In doing so, we begin liberating ourselves from Kenyan societys deep-rooted impunity. Successful woodfuel value chain governance is dependent on the existence of known policies that are implemented, rules and regulations that are enforced and complied with by value chain actors and institutions with capacity to regulate and render support. Kenya has formulated policies nd enacted legislation for guiding, managing and supporting woodfuel value chains. These policies and legal frameworks have evolved over the years, integrating provisions for sustainable production, distribution and use of woodfuel. However, even with well-developed policies and legislative frameworks, charcoal value chains are inadequately governed, beset by illegality, weak institutional arrangements, overlapping mandates and limited coordination and cooperation. Nonetheless, charcoal value chains have remained resilient despite the bans and moratoria throughout the decades and likely to continue in the foreseeable future. Limited knowledge, lack of incentives for sustainable production and limited support for organized efforts to manage woodfuel resources are contributing to low compliance with rules and regulations. Therefore, the development and implementation of interventions coupled with appropriate investments to incentivize and catalyze sustainable woodfuel production and trade cannot be over emphasized.

There is vast literature on groups as a useful mechanism for rural development, especially for women. However, for group participation to fulfil on potential benefits to women, gender-specific constraints must be addressed. This study examines how to promote gender-inclusive governance of mixed-sex self-help groups in the African context, analysing twenty mixed-sex focus group discussions with 190 group members in rural western Kenya. Emphasizing group member perceptions and beliefs about participation and governance, we undertake an empirical assessment of institutional factors that explain and facilitate effective participation of female members. We find that group-member endowments impact the group’s interpretation in terms of their understanding of gender issues and political processes, and that the pro-gender intentions behind governance structures are more important than the structures themselves. Furthermore, groups in this context serve as a distinct parallel institution to that of the home that enable them to push the boundaries of community gender norms.

Data were collected from members of the student community utilizing a structured self-administered questionnaire and from purposively selected key informants and focus group discussants drawn from Kenyatta University (representing the public sector) and the United States International University (representing the private sector). The guiding argument for the study was that shared governance, one of the principles of good governance, is critical in enabling the universities to deliver their visions and the missions effectively. The results revealed that while in principle, Kenyan universities have embraced democratic governance in which all stakeholders, including students, have a role to play, in practice they continue to violate the core principles of good governance, particularly shared governance. Specifically, students, who are major stakeholders in university education, are largely excluded from significant structures of governance thereby limiting their influence and participation. Although their representation is mainly provided via student self-governance organs (unions, associations and/or councils), their effectiveness is undermined considerably by the lack of trust and confidencec of the student body and the unending manipulation by top university administrators and external political actors. Student active involvement in decision making is mainly confined to lower levels such as the school/faculty and departmental/programme. The authors call for a paradigm shift in the involvement of students in the governance of universities in ways that discourage the current culture of tokenism and political correctness that characterizes public and private universities in Kenya.

Kenya is one of about 42 African countries which have enacted framework environmental laws. 14 January 2000 was the Date of Commencement of the Environment Management and Co-ordination Act (EMCA) after its adoption in December 1999 and receipt of Presidential Assent on 6 January 2000. From that date, all sectoral laws were expected to be reviewed or amended to ensure consistency with the requirements of EMCA. Under Section 148 of EMCA: "Any written law, in force immediately before the coming into force of this Act, relating to the management of the environment shall have effect subject to modification as may be necessary to give effect to this Act, and where the provisions of any such law conflict with any provisions of this Act, the provisions of this Act shall prevail". This book is an appraisal of the extent to which this provision has been implemented. It critically analyses environmental law in Kenya with a view to identifying the convergences and divergences between select sectoral laws and EMCA. The ultimate objective is to support internal harmonization of the corpus of environmental law in Kenya.
