Essays in Honor of Professor Stephen T. Zamora by Alfonso Lopez de la Osa Escribano,James W. Skelton, Jr. Pdf

One of Stephen T. Zamora’s former students entered law school with little idea about his future direction. He was fortunate to have a class on contracts with Zamora, Sten Gustafson writes, because “after that first year with him, my path became clear.” The professor made a topic intriguing that could easily be esoteric and tedious, and “opened my eyes to a career path that I could not have imagined otherwise.” This collection of 19 academic essays honors the memory of Dr. Stephen T. Zamora, the Leonard B. Rosenberg Professor of Law at the University of Houston Law Center, who died unexpectedly in 2016. An international authority in the field, Zamora’s areas of expertise were international trade and investments, international banking, conflicts of laws, international economic relations, Mexican law and US-Mexico relations. In addition, he was the driving force behind the establishment of the Center for U.S. and Mexican Law, the only one of its kind at a US law school. Written by colleagues and friends, the scholarly articles included in this volume reflect Zamora’s commitment to Mexican law, education and the promotion of US-Mexico cooperation. Topics such as regulating lawyers and legal education, environmental issues and dispute settlement are covered, and articles include “Economic Sovereignty and Oil and Gas Law,” “What Should Immigration Law Become?” and “Freer Trade between the United States and the European Union?” Through this collection, Zamora’s contemporaries aim to expand his legacy and continue his life-long work as an educator, attorney and uniter of peoples.

Self-Determination and Humanitarian Secession in International Law of a Globalized World by Juan Francisco Escudero Espinosa Pdf

This book addresses questions in connection with the international legal regime on demands for secession, which have arisen in various States. More specifically, it examines the unilateral declarations of independence by Kosovo in 2008, and by Crimea and its subsequent annexation by the Russian Federation in 2014. The work investigates the two cases so as to shed light on the international legal regime affecting entities that are smaller than a sovereign State. It analyzes the relevant principles of international law, the intention being to determine their scope and review them in light of the most recent practice and developments in international law. In turn, the book examines and explains the events of relevance for international law that occurred in the changing situations in Kosovo and Crimea. On the basis of these legal considerations, it explores how the international community can respond when faced with situations that may violate international law, together with the effectiveness of various measures. It also discusses whether certain situations might be legitimate as a concept could now be emerging that secession may be justified in specific circumstances, such as serious and widespread violations of basic human rights.

The Doctrines of US Security Policy by Heiko Meiertöns Pdf

The practise of outlining principles for the conduct of US security policy in so-called doctrines is a characteristic feature of US foreign policy. From an international lawyer's point of view two aspects of these doctrines are of particular interest. First, to what degree are the criteria for the use of force, as laid down in these doctrines, consistent with the limitations for the use of force in international law? Second, which law-creating effects do these doctrines have? Furthermore, the legal nature of these doctrines remains uncertain. These matters are examined, beginning with the Monroe Doctrine of 1823 and taking into account the Stimson Doctrine of 1932, the doctrines of the Cold-War period and the Bush Doctrine of 2002. The Bush Doctrine in particular has generated controversies concerning its compatibility with Article 51 of the UN Charter, due to its principle of preventive self-defence.

Post-Soviet Conflict Potentials by Cindy Wittke Pdf

Instead of resurrecting old images and nourishing new narratives about a ‘New Cold War’, Post-Soviet Conflict Potentials features politically and legally oriented critical investigations into conflict potentials and dynamics in the post-Soviet region and beyond. Contributions coming from the disciplinary perspectives of international relations, international law, and comparative political science are linked to investigations dealing with international, transnational, regional and local levels of the dynamics between conflict and cooperation in the region. Despite the diversity of perspectives, the authors of this volume take a shared critical view on an alleged ‘New Cold War’ as their point of departure, observing that contemporary post-Soviet conflict potentials are produced through various discursive practices ranging from intentional choices of belligerent language to unintentional misinterpretations. The chapters in this volume seek to shed light on conflict potentials from different angles as well as on processes that increase or decrease the probability of political and violent conflicts in the post-Soviet region. Together, the authors offer individual and shared outside-the-box approaches to the study of conflict dynamics and potentials in the post-Soviet space. The book draws connections to conflict potentials on the cross-regional and global levels, providing varied perspectives on what can be learned in and from the post-Soviet region. The chapters in this book were originally published as a special issue of Europe-Asia Studies.

The EU-NATO Relationship by Martin Reichard Pdf

The EU-NATO relationship continues to develop at a time of significant change for both organizations. Post 9/11, NATO embarked on a fundamental transformation, recasting itself as an organization with global strategic reach and interest, focused less on Europe than ever before. At the same time, the EU is also becoming a more global political actor. Consequently, there is growing evidence that over time the EU will take the primary place in providing military security in Europe. This volume combines political and legal methods to provide a comprehensive analysis of the current and likely future relationship between the EU and NATO. The work will be of interest to all those interested in the development of these two major organizations and international security more generally, whether from a political or legal perspective.

Problematising Intelligence Studies by Hager Ben Jaffel,Sebastian Larsson Pdf

This book offers a new research agenda for intelligence studies in contemporary times. In contrast to Intelligence Studies (IS), whose aim has largely been to improve the performance of national security services and assist in policy making, this book takes the investigation of the new professionals and everyday practices of intelligence as the immediate point of departure. Starting from the observation that intelligence today is increasingly about counter-terrorism, crime control, surveillance, and other security-related issues, this book adopts a transdisciplinary approach for studying the shifting logics of intelligence, how it has come to involve an expanding number of empirical sites, such as the police, local community, prison and the Internet, as well as a corresponding multiplicity of new actors in these domains. Shifting the focus away from traditional spies and Anglo-American intelligence services, this book addresses the transformations of contemporary intelligence through empirically detailed and theoretically innovative analyses, making a key contribution to existing scholarship. This book will be of much interest to students of intelligence studies, critical security studies, foreign policy, and International Relations.

Practice and Policies of Modern Peace Support Operations under International Law by Geert-Jan Knoops,Roberta Arnold Pdf

Confronted with the practical legal aspects of Peace Support Operations (PSO) in their daily work, the two authors realized that there was an urgent need for the international community of military and civilian lawyers, law enforcement agencies, policy makers, legal advisers and military commanders dealing with these types of missions to have a guidebook analyzing, questioning and providing some solutions to the practical legal aspects intrinsic in them and which are often known only to those who have been serving in the field. It was therefore decided to create a tool to record and diffuse the know-how acquired by those who have been directly confronted with these issues, in the field and at headquarters. Among the cutting-edge topics practitioners explore in Peace Support Operations & Their Legal Implications are human trafficking and illegal immigration in theatres of PSO such as the Balkans, arrest and detention of suspects of serious breaches of the laws of war, the relationship and role sharing of civilian law enforcement agencies and peacekeepers, the use of non-lethal and other weapons (e.g. riot control agents), criminal liability for breaches of international law and Rules Of Engagement. Contributions of a more strategic nature deal further with the complexities of Status of Forces Agreements and Memoranda of Understanding, the extraterritorial applicability of human rights obligations, the application of the law of occupation to peacekeeping forces, their new role and the relative problems in peace-building. The main objective of this guidebook is to provide the basis for further discussion, suggesting what should be done next, and to constitute a problem-solving tool for those deployed in the field, often secluded from the external world and confronted with difficulties to be solved immediately, under the pressure of time. The idea is to show them the path undertaken by others who have been confronted with similar problems and to share the knowledge and fight the power. Human Rights by Christian Tomuschat Pdf

Human Rights between Idealism and Realism presents human rights in action, focusing on their effectiveness as legal tools designed to benefit human beings. By combining conceptual analysis with an emphasis on procedures and mechanisms of implementation, this volume provides a multidimensional overview of human rights. After examining briefly the history of human rights, the author analyses the intellectual framework that forms the basis of their legitimacy. In particular, he covers the concept of universality and the widely used model that classifies human rights into clusters of different 'generations'. The volume then moves on to analyse of the activities of the political institutions of the United Nations, the expert bodies established by the relevant treaties, and the international tribunals specifically entrusted at the regional level with protecting human rights. The author explains how and why ithe classical array of politically inspired informal devices has been enriched by the addition of international criminal procedures and by endeavours to introduce civil suits against alleged individual violators of human rights. Finally, the volume is rounded off by a consideration of the importance of humanitarian law as an instrument for the protection of human life and dignity and an exploration of the future of human rights.

Nagorno-Karabakh by T. J. Petrowski Pdf

The Azerbaijani attack on the de facto independent Republic of Artsakh (formerly the Nagorno-Karabakh Republic) in September 2020 shattered the illusion that this conflict is “frozen.” The forty-four-day war in 2020 was the bloodiest outbreak of violence over the separatist region since the conflict began in the late 1980s and threatened to embroil Turkey and Russia in a dangerous proxy war in the volatile South Caucasus. Despite the publication of several works on the conflict since the 1990s, many aspects of the conflict remain poorly understood or distorted in Western scholarship due to US-NATO political influence. Are the origins of the conflict found in Soviet nationalities policy and Joseph Stalin’s divide-and-rule methods? Do the Armenians in Artsakh have a right to self-determination as enshrined in treaty and customary international law? What role do Russia and Turkey have in the conflict? Did Kosovo’s 2008 declaration of independence establish a precedent for Artsakh and other separatist states such as Abkhazia and South Ossetia? By breaking with the dominant US-NATO political paradigm, this book strives to answer these and many other questions to provide a long overdue reassessment of the Armenian-Azerbaijani Conflict.
