The Diplomatic System of the European Union by Michael Smith,Stephan Keukeleire,Sophie Vanhoonacker Pdf

Over the past five years, the EU has established a new system of diplomacy centred on the European External Action Service (EEAS) and the High Representative for Foreign Affairs and Security Policy. This new system reflects a process of evolution in a changing context, and has been faced by major challenges since its inception. This book examines the diplomatic system of the EU, locating it within the broader study of diplomacy and the European integration project. The volume is structured around the interrelated themes of institutional change and the evolving practices of EU diplomacy. It tracks the development of the EU’s system of diplomacy, with particular reference to the implementation of the Lisbon Treaty, the establishment of the EEAS and the emerging practices of EU strategic and structural diplomacy. Bringing together contributions from leading experts in the field, this book provides an original approach to the development and operation of the EU’s diplomatic system. This book will be of interest to students and scholars of European Union international relations, European Union politics and diplomacy.

The European External Action Service and National Foreign Ministries by Rosa Balfour,Caterina Carta,Kristi Raik Pdf

Based on extensive empirical work by a cross-European group of researchers, this book assesses the impact of the creation of the European External Action Service (EEAS) on the national foreign policy-making processes and institutions of the EU member states. As such, the contributions cover both the involvement of the national diplomatic and foreign policy actors in shaping the outlook of the EEAS and its mission, as well as the changes (or not) it has produced for those actors of the member states. The analysis draws in theoretical frameworks from Europeanization and socialization, but also from intergovernmental frameworks of policy-making within the European Union. An introduction by the editors outlines the issues and trends examined in the book and establishes the theoretical and methodological framework. Split into 2 sections, Part I: EEAS and national diplomacies as part of global and European structures has contributions by Richard Whitman, Rosa Balfour, Christian Lequesne, Caterina Carta and Simon Duke. Part II: National diplomacies shaping and being shaped by the EEAS is covered by Daniel Fiott, Fabien Terpan, Cornelius Adebahr, Andrea Frontini, Ignacio Molina and Alicia Sorroza, Laura C. Ferreira-Pereira, Alena Vysotskaya G. Vieira and Louise van Schaik, Grzegorz Gromadzki, Mark Rhinard, Jakob Lewander and Sara Norrevik, Sabina Kajnc Lange, Ruby Gropas and George Tzogopoulos, Vit Beneš and Kristi Raik. This book is much needed, especially in an era when the EU is trying to pull its weight in the international sphere (e.g. Syria, Iran, the Arab Spring, Chinese relations and emerging powers) but also at a time when the EU is trying to recalibrate its institutional structure in light of the current financial predicaments and questions on the democratic legitimacy of the European project.

Research Handbook on the EU’s Common Foreign and Security Policy by Steven Blockmans,Panos Koutrakos Pdf

In times of rapid change and unpredictability the European Union’s role in the world is sorely tested. How successfully the EU meets challenges such as war, terrorism and climate change, and how effectively the Union taps into opportunities like mobility and technological progress depends to a great extent on the ability of the EU’s institutions and member states to adopt and implement a comprehensive and integrated approach to external action. This Research Handbook examines the law, policy and practice of the EU’s Common Foreign and Security Policy, including the Common Security and Defence, and gauges its interactions with the other external policies of the Union (including trade, development, energy), as well as the evolving political and economic challenges that face the European Union.

This book was originally published as a special issue of the Journal of European Integration.

EU Financial Framework from 2014 by Great Britain: Parliament: House of Lords: European Union Committee Pdf

The EU Multiannual Financial Framework (MFF) will shape what the EU achieves in the second half of this decade. This report is set against the themes of the EU's "Europe 2020 strategy": smart, sustainable and inclusive growth. The report includes three principal recommendations: Common Agricultural Policy must be reformed; the EU's budget must not grow in real terms; the EU must spend its money more carefully. The Common Agricultural Policy must be reformed to release resources for other priorities, including research. One third of the EU's budget still goes on agricultural subsidies. Overall funding must be reduced. And the CAP must shift resources behind rural development (pillar two) from production (pillar one). The Committee calls for an end to trade-distorting subsidies, and a focus on today's challenges: global food security, biodiversity and climate change. The Committee found proposals for new EU revenue streams or taxes (own resources) to be an 'unfortunate distraction' on which it will be impossible to reach agreement. It also recommends that the Financial Framework be for five years, not seven as at present, so that it has more flexibility to respond to changing events - such as recent events in North Africa - and economic circumstances, like the financial crisis. EU mismanagement of large scale projects is unacceptable. And the EU's regional development funds should go to where they are most needed: the EU's poorest countries. And the EU should not spend at all where EU spending adds no value compared with spending at national or regional level.

Foreign Relations Law by Campbell McLachlan Pdf

What legal principles govern the external exercise of the public power of states within common law legal systems? Foreign Relations Law tackles three fundamental issues: the distribution of the foreign relations power between the organs of government; the impact of the foreign relations power on individual rights; and the treatment of the foreign state within the municipal legal system. Focusing on the four Anglo-Commonwealth states (the United Kingdom, Australia, Canada and New Zealand), McLachlan examines the interaction between public international law and national law and demonstrates that the prime function of foreign relations law is not to exclude foreign affairs from legal regulation, but to allocate jurisdiction and determine applicable law in cases involving the external exercise of the public power of states: between the organs of the state; amongst the national legal systems of different states; and between the national and the international legal systems.

Common Law Constitutional Rights by Mark Elliott,Kirsty Hughes Pdf

There is a developing body of legal reasoning in the United Kingdom Supreme Court in which members of the senior judiciary have asserted the primary role of common law constitutional rights and critiqued legal arguments based first and foremost on the Human Rights Act 1998. Their calls for a shift in legal reasoning have created a sense amongst both scholars and the judiciary that something significant is happening. Yet despite renewed academic and judicial interest we have limited insight into what common law constitutional rights we have, how they work and what they offer. This book is the first collection of its kind to systematically explore both the content and role of individual common law constitutional rights alongside the constitutional significance and broader implications of these developments. It therefore contributes not only to our understanding of what the common law might be capable of offering in terms of the protection of rights, but also to our understanding of the nature of the constitutional order of which such rights are an integral part.

Accountability, Parliamentarism and Transparency in the EU by Adam Cygan Pdf

It was a great pleasure to find such a rich analysis of the role of national parliaments in the EU. What I particularly like - and what proves to be particularly fruitful is the combination of perspectives; the EU law and national constitutional perspective including a comparative dimension, the perspective that explains the role of national parliaments in the EU from past to present (and even near future) and last but not least, the perspective of the interaction between the legal frameworks and the political reality. There is every reason to congratulate Adam Cygan wholeheartedly on this book. Ton Van Den Brink, Europa Instituut Utrecht, The Netherlands One of the most outstanding specialists on the role of national parliaments in the EU has produced another impressive book about this dynamic topic. It provides an illuminating overview of current practices, it sharply analyses the legal status quo, and it brings theoretical depth to the topic in multiple perspectives. Olaf Tans, Amsterdam University College, The Netherlands This accessible and detailed book takes an interdisciplinary approach in exploring the position of national parliaments in the EU polity and in particular their position within the EU governance framework. Adam Cygan analyses the impact of subsidiarity monitoring upon national parliaments and to what extent this provides new opportunities for national parliaments to be engaged in, and exert influence over, the EU legislative process. While the post-Lisbon position of national parliaments may have improved, this book questions whether national parliaments can really be considered as central actors in EU affairs. The author also queries whether subsidiarity monitoring has the capacity to create a collective bloc of horizontal actors which exert effective accountability over the EU legislative process. Accountability, Parliamentarism and Transparency in the EU will strongly appeal to academics, parliamentarians/parliamentary officials working in EU affairs, as well as EU civil servants.
