This publication contains the proceedings of an OECD workshop on illegal, unreported and unregulated (IUU) fishing, held in April 2004 in Paris. Naval Constabulary Operations and Fisheries Governance by Sean A. G. Andrews Pdf

This book offers an analysis of naval constabulary operations, in particular Australian fisheries patrols, and challenges the widely accepted Anglo-American school of maritime thought. In the Indo-Pacific, fisheries and the activities of fishing boats are of increasing strategic importance in Australia’s region – Australia’s Four Oceans. Issues of overfishing, population growth and climate change are placing growing pressure on fish as a resource, and in doing so are making fisheries more significant, and significant on a strategic as opposed to simply an economic or environmental level. When, combined with the growing use of fishing vessels as para-naval forces, it is clear that the activities of fishing vessels, whether fishing or not fishing, are matters of considerable strategic relevance. This book illuminates contemporary seapower challenges, explains and defines maritime security and examines and refines existing theory to advance a set of new or refined concepts to help frame the on-water activities of constabulary operations -- reducing the possibility of on-water miscalculation between states. This book will be of much interest to students and scholars of naval studies and sea power, maritime strategy, maritime security and International Relations.

Looking South by Lorne K. Kriwoken,Julia Jabour,Alan D. Hemmings Pdf

Australia has a long, rich and significant history in Antarctic affairs. Since 1933 Australia has asserted a claim to 42 per cent of the continent as the Australian Antarctic Territory. Australia was an original signatory to the 1959 Antarctic Treaty and has subsequently played an active role in international governance of Antarctica under the Antarctic Treaty System (ATS). Almost half a century after the adoption of the Antarctic Treaty, and in the first decade of the 21st century, Antarctica is better known but is still not completely understood to science. It has been designated a natural reserve devoted to peace and science and whilst some matters, such as mining, have been put on hold, other issues present both continuing and new challenges. These challenges include the implications for Antarctica of global climate change, and indeed the continent's role in the generation of the world's weather; the environmental, political and ethical implications of increasing human activity in the region; and the goals of maintaining or developing the most appropriate governance mechanisms given the complex legal circumstances. There had been no contemporary analysis of Australia's involvement in Antarctic matters until 1984 when "Australia's Antarctic Policy Options", edited by Professor Stuart Harris, brought together a diverse and intellectually powerful array of Australians focussed on Antarctic law, policy and the social sciences. This volume provided a benchmark by which to measure the tenor of Australia's Antarctic agenda and as such has been of great assistance to the development of Looking South. Consequently, 20 years on Looking South explores how the issues identified have developed, what significant new issues have emerged and how Antarctica is placed in the current political Australian agenda.

Law of the Sea, Environmental Law and Settlement of Disputes by Tafsir Malick Ndiaye,Rüdiger Wolfrum,Chie Kojima Pdf

This volume covers a variety of topics in the fields of the law of the sea and the protection of the environment. The particular focus of the volume is on the role and function of judicial, quasi-judicial and administrative institutions in the prevention and settlement of disputes in both of these areas. This includes an overview and insightful analysis of the cases of the International Tribunal for the Law of the Sea during its first decade. Further substantive issues range from the allocation of shared marine resources, maritime boundary delimitation and issues of maritime security to the prevention of marine pollution as well as a coverage of the compliance and enforcement mechanisms of international environmental law. The views from both scholars' and practitioners' perspectives presented in this volume will offer readers a number of outstanding intellectual synergies to reflect on the development of international law. It can provide both scholars and policy-makers alike with new insights on how to address pressing problems in international law, including ideas for improved institutional design. The work has been compiled in honour of Thomas A. Mensah and comprises 59 essays from leading scholars and practitioners in international law.
