Recoverability of Pure Economic Loss Arising from Ship-source Oil Pollution by Yuna Huang Pdf

This book focuses on liability and compensation for negligently caused pure economic loss as a general question in tort law and specifically as a question in maritime tort law, especially in cases of oil pollution damage. A substantial part of this study is dedicated to the examination of the legal status of pure economic loss caused by ship-source oil pollution incidents, the outer margins of recoverable losses as well as compensation practice, from both an international and a national perspective. The compensation practices of the IOPC Funds have been analysed carefully for this purpose.

The New Accountability by Michael Mason Pdf

The growth of pollution that crosses national borders represents a significant threat to human health and ecological sustainability. Various international agreements exist between countries to reduce risks to their populations, however there is often a mismatch between national territories of state responsibility and transboundary hazards. All too often, state priorities do not correspond to the priorities of the people affected by pollution, who often have little recourse against major polluters, particularly transnational corporations operating across national boundaries. Drawing on case studies, The New Accountability provides a fresh understanding of democratic accountability for transboundary and global harm and argues that environmental responsibility should be established in open public discussions about harm and risk. Most critically it makes the case that, regardless of nationality, affected parties should be able to demand that polluters and harm producers be held accountable for their actions and if necessary provide reparations.

International Law and Pollution by Daniel Barstow Magraw Pdf

The topic of the essays in this book, the threat posed to our environment by various sources and types of pollution, is a matter of serious and growing concern. The contributors are leading international experts from a variety of legal systems and backgrounds and include Andronico Adede, Ian Brownlie, Pierre-Marie Dupuy, Johan Lammers, and Paul Szasz. International Law and Pollution provides an overview of international legal principles and institutional efforts relevant to pollution and then focuses on two particularly acute problems: nuclear pollution and acid rain. A variety of substantive issues must be confronted in order to deal with the full range of international pollution, and various institutional approaches must be utilized in the prevention, cleanup, and compensation efforts. For example, pollution from nuclear accidents results from a single event, whereas acid rain is a product of chronic emissions; the legal and policy concerns differ accordingly. In the overview, Daniel Barstow Magraw discusses fundamental concepts of international pollution, analytic distinctions among types of pollution, paradigmatic responses to pollution, and the relationship among environmental protection, economic development, and human rights. Other authors examine the existing and evolving principles of customary international law relevant to pollution, the U.N. International Law Commission's work on international liability and international watercourses, and a practitioner's perspective. The chapters on nuclear pollution analyze the conventional regimes and customary principles applicable to this field (including the Chernobyl disaster) and the determination and measurement of damages. Finally, the chapters on acid precipitation summarize the scientific background of the problem and present the multilayered European efforts to control acid rain as well as the Canada-United States acid rain controversy. International Law and Pollution will be of interest to scholars and students of environmental law and international law.

Manual on Oil Pollution by International Maritime Organization Pdf

Manual on Oil Pollution - Section V - Administrative Aspects of Oil Pollution Response, 2009 Edition. The Marine Environment Protection Committee (MEPC), at its thirty-third session, agreed that a new section V of the IMO Manual on Oil Pollution, dealing with administrative aspects and, in particular, with the roles and functions of entities which could be involved in an oil pollution emergency and its aftermath, should be developed. The present text is a revision of the first edition of the Manual, published in 1998, taking into account changes and new information on the topic since the original version. This section of the Manual on Oil Pollution is intended to provide the reader, in particular on scene commanders, lead agencies and others involved in the management of oil pollution response, with an appreciation of the various interests involved in an oil pollution emergency and its aftermath, as well as a general review of the international legal regimes governing limitation of liability and compensation for oil pollution damage. This section is not intended to provide an authorized or definitive commentary on the legal relationships between the various entities involved in an oil pollution emergency or an interpretation of relevant international conventions. The reference section includes sources of more comprehensive information on these subjects, and the reader is encouraged to make use of them if more detailed information is required.
