The United States spearheaded the creation of many international organizations and treaties after World War II and maintains a strong record of compliance across several issue areas, yet it also refuses to ratify major international conventions like the UN Convention on the Law of the Sea and the Convention on the Elimination of All Forms of Discrimination Against Women. Why does the U.S. often seem to support international law in one way while neglecting or even violating it in another? The United States and International Law: Paradoxes of Support across Contemporary Issues analyzes the seemingly inconsistent U.S. relationship with international law by identifying five types of state support for international law: leadership, consent, internalization, compliance, and enforcement. Each follows different logics and entails unique costs and incentives. Accordingly, the fact that a state engages in one form of support does not presuppose that it will do so across the board. This volume examines how and why the U.S. has engaged in each form of support across twelve issue areas that are central to 20th- and 21st-century U.S. foreign policy: conquest, world courts, war, nuclear proliferation, trade, human rights, war crimes, torture, targeted killing, maritime law, the environment, and cybersecurity. In addition to offering rich substantive discussions of U.S. foreign policy, their findings reveal patterns across the U.S. relationship with international law that shed light on behavior that often seems paradoxical at best, hypocritical at worst. Excerpt from International Law Topics and Discussions The Navy Department, as has been the practice in recent years, assembled at the Naval War College on June 1, 1905, a conference of officers, a majority of whom were of high rank and long experience, to occupy four months in the discussion of the battle tactics and strategy of the fleet, and of those unsettled questions of international law which at times have seemed to threaten universal war. The topics considered in this volume are of vital interest, and it is desirable to make clear the manner in which the work was performed. They were formulated before the opening of the conference by the lecturer, Mr. George Grafton Wilson, professor in Brown University, in consultation with the president and staff of the War College. The officers were divided into committees when the conference assembled, and at stated intervals the committees submitted reports upon the several topics; the reports were then fully and freely discussed in a general conference participated in by the lecturer, the president and staff of the college, and all the officers in attendance. The conclusions published are those accepted in the general conference and may be fairly held to be without bias, since it is evident that in the future the United States may be affected either as neutral or as belligerent, and since the topics do not relate to questions pending. The field is wide and the time limited, but the work is justified, if besides increasing our knowledge it has contributed in any degree to the formulation of agreements tending to avert or ameliorate war. In its forty-fourth session the General Assembly of the United Nations proclaimed the 1990s as the Decade of International Law . One of the main purposes of the decade is the promotion of effective means for peaceful international dispute settlement, and, especially, strenghtening the role of & respect for the International Court of Justice, the principal judicial organ of the United Nations. The editors of this book contribute to this aim by bringing together a variety of opinions by international legal experts on peaceful dispute settlement. The subject is approached from different angles, ranging from the role of the International Law Commission & the Non-Aligned Movement to human rights & space law disputes, in order to identify areas of international law where room exists for further development of existing means for peaceful settlement of international disputes. A general conclusion which can be drawn from this survey is that the focus of attention should not be aimed primarily at strenghtening the role of the International Court of Justice, e.g. by amending some of its rules or by trying to increase its political acceptability through diplomatic efforts. Instead, the focus should be on small scale improvements within specific areas of international law with an emphasis on the relation between dispute settlement & supervision. Furthermore, it seems essential for a real improvement to give non-governmental organisations or private persons a greater role in upholding the rule of international law, whether in domestic courts or in international fora. I have not amplified it at all because I can see no value in any work occupying an intermediate position between an essay intended to excite interest in the subject and to indicate what might be done and an elaborate work on International Law such as I may hope to write some day but for which much time and labour would be required. At the same time I have revised the essay and made some alterations in it.
