Customary International Humanitarian Law by Jean-Marie Henckaerts,Carolin Alvermann,Comité international de la Croix-Rouge Pdf

Customary International Humanitarian Law, Volume I: Rules is a comprehensive analysis of the customary rules of international humanitarian law applicable in international and non-international armed conflicts. In the absence of ratifications of important treaties in this area, this is clearly a publication of major importance, carried out at the express request of the international community. In so doing, this study identifies the common core of international humanitarian law binding on all parties to all armed conflicts. Comment Don:RWI.

India and International Law, Volume 2 by Bimal N. Patel Pdf

India and International Law, volume 2 examines India’s policy and practical approach to modern and emerging subjects such as energy, investment, sports, banking, biotechnology, taxation, water courses, feminism, air law and role of India in UN reforms. The most discussed interlinked issues of civilian nuclear energy and nuclear weapons are analysed in two separate chapters. This volume also examines legal challenges and offers possible solutions in the area of private international law, which hopefully would serve the purposes of relevant policy-makers, judiciary, common men and women and 2.5 million Non-Resident Indians (NRIs).India and International Law, volume 2 will enable the readers to realize the sheer magnitude of legal challenges faced by India, hence, one way forward is to consider some of the suggestions offered by the authors. It is hoped that these two volumes will provide a useful framework for similar studies and will remain a must source of consultation for those who are interested in India’s state practice on international law.

Select Proceedings of the European Society of International Law, Volume 2, 2008 by Hélène Ruiz Fabri,Ruediger Wolfrum,Jana Gogolin Pdf

This book continues the series Select Proceedings of the European Society of International Law, containing the proceedings of the Third Biennial Conference organised by ESIL and the Max Planck Institute for Comparative Public Law and International Law in 2008. The conference was entitled 'International Law in a Heterogeneous World', reflecting an idea which is central to the ESIL philosophy. Heterogeneity is considered one of the pillars upon which Europe's contribution to international law is built and the subject was considered in a number of panels, including such diverse topics as migration, the history of international law, the rules on warfare and international environmental law.

Commentaries Upon International Law by Robert Phillimore Pdf

Excerpt from Commentaries Upon International Law, Vol. 2 Since the publication, last year, of the Second Edition of the First Volume of these Commentaries two new Treaties have become part of positive International Law. To both of them England has been a contracting party; and both are of grave importance to the commonwealth of States, as to their immediate consequences and as to the principles which they contain. The consideration of them belongs more properly to the former volume; but in the circumstances it appears to me expedient to draw attention to the general character of them here, and to place the Treaties themselves at length in the Appendix to this volume. The first Treaty relates to the navigation of the Black Sea, altering with respect to this subject the conditions of the Treaty of 1856. International Law: Volume 2, The Law of Peace, Part 1, International Law in General by E. Lauterpacht Pdf

The first volume of the collected papers of Sir Hersch Lauterpacht contained three general works. The second volume begins a systematic coverage of the rest of his work presented roughly in accordance with a plan Lauterpacht himself drew up for a possible textbook. The book contains papers falling within the introductory section, dealing with International Law in general, though materials later included in separately published works have normally been excluded. Three papers - 'On Realism, Especially in International Relations', 'Professor Carr on International Morality' and 'International Law after the Second World War' - have not been published before and one, The Reality of the Law of Nations', has only had very limited circulation. The whole work continues the carefully organized presentation of the work of a very distinguished international lawyer.

International Law, Vol. 2 by L. Oppenheim Pdf

Excerpt from International Law, Vol. 2: A Treatise; War and Neutrality Oppenheim's work upon the revision of this volume was unfinished when he died; but most of the material had already been collected, and many passages rewritten. He intended, as he once told me, to introduce the events of the war when they illustrated, extended, or challenged general principles hitherto accepted. But for the history of the war he would have relied on his friend Garner's I nter national Law and the World War, which he had already read in manuscript. By kindly lending me the proofs of that book (since published), Professor Garner has enabled me to make frequent references to it according to the author's plan. The Limits of International Law by Jack L. Goldsmith,Eric A. Posner Pdf

International law is much debated and discussed, but poorly understood. Does international law matter, or do states regularly violate it with impunity? If international law is of no importance, then why do states devote so much energy to negotiating treaties and providing legal defenses for their actions? In turn, if international law does matter, why does it reflect the interests of powerful states, why does it change so often, and why are violations of international law usually not punished? In this book, Jack Goldsmith and Eric Posner argue that international law matters but that it is less powerful and less significant than public officials, legal experts, and the media believe. International law, they contend, is simply a product of states pursuing their interests on the international stage. It does not pull states towards compliance contrary to their interests, and the possibilities for what it can achieve are limited. It follows that many global problems are simply unsolvable. The book has important implications for debates about the role of international law in the foreign policy of the United States and other nations. The authors see international law as an instrument for advancing national policy, but one that is precarious and delicate, constantly changing in unpredictable ways based on non-legal changes in international politics. They believe that efforts to replace international politics with international law rest on unjustified optimism about international law's past accomplishments and present capacities.
