Customary International Humanitarian Law by Jean-Marie Henckaerts,Carolin Alvermann,Comité international de la Croix-Rouge Pdf

Customary International Humanitarian Law, Volume I: Rules is a comprehensive analysis of the customary rules of international humanitarian law applicable in international and non-international armed conflicts. In the absence of ratifications of important treaties in this area, this is clearly a publication of major importance, carried out at the express request of the international community. In so doing, this study identifies the common core of international humanitarian law binding on all parties to all armed conflicts. Comment Don:RWI.

Law of Evidence in Nigeria by Uchenna Ortuanya Pdf

The Evidence Act, 2011, repealed the old Evidence Act. In doing so, the new Act introduced some changes in the Law of Evidence. Ever since, there has been an urgent need for scholastic guidance, in the proper approach to the interpretation of the provisions embodying those changes. This is particularly so, as the courts have been issuing contradictory interpretations of these provisions. In his new book, Law of Evidence in Nigeria: Practice and Procedure, the veteran author and urbane man of letters, Professor Simon Uchenna Ortuanya, masterfully plumbs the intention of the draft's persons of the Act. The result is a five-hundred-and-forty-page treatise of redoubtable erudition. The succinct titles of the different chapters are quite captivating just as the logical presentations of ideas are very illuminating. The book bears the imprints of the erudite author's versatility in the Law of Evidence - a course he has taught, admirably, in two public universities years.

Budgeting for the Military Sector in Africa by Wuyi Omitoogun,Eboe Hutchful Pdf

In this comprehensive study, 15 African experts describe and analyse the military budgetary processes and degree of parliamentary oversight and control in nine countries of Africa, spanning across all the continent's sub-regions. Each case study addresses a wide range of questions, such as the roles of the ministries of finance, budget offices, audit departments and external actors in the military budgetary processes, the extent of compliance with standard public expenditure management procedures, and how well official military expenditure figures reflect the true economic resources devoted to military activities in these countries.

Islamic Criminal Law in Northern Nigeria by Gunnar J. Weimann Pdf

Annotation. In 2000 and 2001, twelve northern states of the Federal Republic of Nigeria introduced Islamic criminal law as one of a number of measures aiming at "reintroducing the shari'a." Immediately after its adoption, defendants were sentenced to death by stoning or to amputation of the hand. Apart from a few well publicised trials, however, the number and nature of cases tried under Islamic criminal law are little known. Based on a sample of trials, the present thesis discusses the introduction of Islamic criminal law and the evolution of judicial practice within the regions historical, cultural, political and religious context. The introduction of Islamic criminal law was initiated by politicians and supported by Muslim reform groups, but its potential effects were soon mitigated on higher judicial levels and aspects of the law were contained by local administrators. Nigeria During the Abacha Years (1993-1998) by Daniel C. Bach,Yann Lebeau,‘Kunle Amuwo Pdf

The autocratic regime of Sani Abacha (1993-1998) stands out as a watershed in the history of independent Nigeria. Nigeria’s darkest years since the civil war resulted from his unrestrained personal rule; very close to the features associated with warlordism. Nepotism, corruption, violation of human rights, procrastination over the implementation of a democratic transition, and the exploitation of ethnic, cultural or religious identities, also resulted in the accumulation of harshly repressed frustrations. In this book, some distinguished scholars, journalists and civil society activists examine this process of democratic recession, and its institutional, sociological, federal and international ramifications. Most of the contributions were originally presented at a seminar organized by the Centre d’Etude d’Afrique Noire (CEAN) in Bordeaux.

Impeachment in a Global Context by Chris Monaghan,Matthew Flinders,Aziz Z. Huq Pdf

This volume considers the use of impeachment within a global context. The book brings together leading scholars and experts to give an insight into significant periods in the development of impeachment and its modern comparative use. Divided into five parts, the opening chapter introduces the topic and underlines its significance in terms of understanding the relationship and inter-dependence among politics, governance and the law. It also offers a novel conceptual framework that facilitates the global mapping of impeachment processes. Part I presents a thematic approach that explores the topic of impeachment through the lenses of democracy, human rights and the rule of law. With these themes in mind, Part II focuses on those parts of the world where impeachment is generally recognised as a core constitutional process including the United States, South Korea, Brazil and other countries in South America. Part III continues with the process of constitutional mapping by moving to a focus on those countries where impeachment is arguably an important but largely secondary or peripheral process. This includes chapters on Denmark, Iceland, Sri Lanka and the Philippines and flows through into Part IV’s focus on areas of the world where impeachment matters and may even be increasing in terms of visibility but, for a number of reasons, arguably exists within a satellite status in terms of constitutional processes and safeguards. The fifth and final section steps back in an attempt to assess impeachment processes from a broad comparative perspective. The collection presents the definitive text on impeachment for students and scholars with an interest in comparative public law, politics and constitutional studies.
