Our article demonstrates the needs for and benefits of in- house judicial-based applied research centers and shows how such centers provide judicial policymakers with information about current judicial operations. This information informs judicial policymakers shaping judicial administration and, by shaping judicial administration in response to current judicial operations, strengthens judicial independence. We analyze and apply the experience of the federal judiciary's own in-house research and education agency, The Federal Judicial Center, to explore establishing and maintaining research centers. We then use two cases studies - the first involving the Twombly and Iqbal rulings and the second involving the Israeli Judiciary - to illustrate our discussion. We urge all judiciaries to develop an internal research component to enable judicial policymakers to better improve judicial administration and, thereby, strengthen judicial independence.

Since the 9/11 attacks, international organizations have become actively engaged in devising counterterrorism strategies and frameworks. This monograph examines the role UN organs can play in implementing the law of State responsibility in global security contexts, using transnational terrorism as its principal case study. The institutional mechanisms utilized by the UN in implementing State responsibility are assessed in detail, shedding light on how the ICJ, the General Assembly and the Security Council contribute to the implementation of State responsibility in the context of global security. By acknowledging the Security Council's role as a post-9/11 legislator, this book argues that the Council can play an important and sometimes determinant role in implementing a State's legal responsibility for failing to prevent terrorism, both inside and outside the Chapter VII framework. Featuring a discussion of the more controversial consequences flowing from State responsibility, this monograph also explores the prospect of injured States adopting forcible measures against responsible States for their failures to prevent terrorism. The book investigates whether self-defence and other forcible reactions, envisaged both inside and outside the Council, can be reconciled with State responsibility principles.

However, apart from the advantages the internet offers, it also hides numerous dangers for both people and nations. Cyberspace has a dark side, including terrorism, bullying, and other types of violence. Cyberwarfare is a kind of virtual war that causes the same destruction that a physical war would also do. A hybrid threat is an umbrella term encompassing a wide variety of existing adverse circumstances and actions, such as terrorism, migration, piracy, corruption, ethnic conflict, etc., and is not exclusively a tool of asymmetric or non-state actors, but can be applied by state and non-state actors alike. ‘Cyberconflict’ and ‘cyberwar’ serve as examples of the use of new technologies within the scope of hybrid threats. Cyberwar basically refers to a sustained computer-based cyberattack by a state against the information technology (IT) infrastructure of a target state. On the other hand, cybersecurity is a major factor that shapes productivity and efficiency of the modern industry in both technical and economic terms. The book discusses and analyses current posture of cyberterrorism, cyberwarfare, and hybrid threats—sector-specific cyberattacks that have the form of cyberterrorism and represents the recent actions that members of the European Union (EU), the United States, and other nations have taken in order to strengthen their systems against such attacks. There has never been a higher risk of a major catastrophe as a result of the rise in offensive cyberactivity, particularly the possibility of cyber–physical strikes against critical services.
