Blindfold of Justice by Minka Scott-Friedman Pdf

In the late forties and early fifties, Beverly Hills was a small, conservative community with safe, tree lined streets, and was famous for movie stars and one lawyer - the fabled Jerry Geisler. This book is a fictionalized, but authentic, inside view of the workings of his office, and his world, seen through the eyes of his associate counsel. Everything is there, including allies and adversaries in the L.A.P.D., the Press, and the L.A. County District Attorneys office. In those days, criminal cases were defended on the merits, not by invoking intellectually dishonest technicalities concerning police procedure. It was an honest, rockem, sockem, intellectual battle, and may the smartest, or luckiest, lawyer win. Here we have a rising star in a prestigious Beverly Hills law firm defending a wealthy playboy accused of the brutal slaying of his estranged wife. His adversary is a brilliant young prosecutor who wants the D.A.s job, and will stop at nothing to get it. The resolution of this conflict involves forensic pathology, psychology, incest, drugs, and lots of dirty tricks by the police and both attorneys. To top it all off, the final courtroom scene takes place in a unique and unexpected venue.

The Concept of Ideals in Legal Theory by Sanne Taekema Pdf

Talk about law often includes reference to ideals of justice, equality or freedom. But what do we refer to when we speak about ideals in the context of law? This book explores the concept of ideals by combining an investigation of different theories of ideals with a discussion of the role of ideals in law. A comparison of the theories of Gustav Radbruch and Philip Selznick leads up to a pragmatist theory of legal ideals, which provides an interesting new position in the debate about values in law between legal positivists and natural law thinkers. Attention for law's central ideals enables us to understand law's autonomous character, while at the same time tracing its connection to societal values. Essential reading for anyone interested in the role of values or ideals in law.

From Ancient Myth to Modern Healing by Pamela Donleavy,Ann Shearer Pdf

This book is about the energy personified by the classical Greek goddess Themis, who brought her divine and natural 'right order' to gods and humans, and who still presides over law courts as the figure of Justice. In many Western countries today, the growing dis-ease in minds and bodies of individuals is often echoed in whole communities. Rather than coming together, they seem to split apart in anger and distress. But themis energy is equally powerful, and can work to bring together and to heal. From the battle of the Titans and Olympians to the oracle at Delphi and the banquet of the gods, the stories of the goddess weave through these chapters to illuminate how themis energy is at work today. The authors explore psychological healing in individuals and relate this to new research in neurocardiology on the subtle interactions of body and mind. They show how the international movement for restorative justice is drawing on the same healing tools to benefit victims and offenders alike. And they evoke the extraordinary story of the South African Truth and Reconciliation Commission, which shows the world how themis energy can help transform a ravaged society. This book deepens understanding of the psychological urge towards healing and wholeness which is as much a part of human beings as the urge to destroy. It offers exciting new insights into Jung's unique approach to the relationship between individual and collective psychology. It will appeal to psychologists who work with individuals and groups, to lawyers and others concerned with the failure of current criminal justice systems, and to people involved in religious, political and other groups that seek to build communities which can encompass and even celebrate diversity rather than rejecting it in fear.

English Revenge Drama by Linda Woodbridge Pdf

Vengeance permeates English Renaissance drama - for example, it crops up in all but two of Shakespeare's plays. This book explores why a supposedly forgiving Christian culture should have relished such bloodthirsty, vengeful plays. A clue lies in the plays' passion for fairness, a preoccupation suggesting widespread resentment of systemic unfairness - legal, economic, political and social. Revengers' precise equivalents - the father of two beheaded sons obliges his enemy to eat her two sons' heads - are vigilante versions of Elizabethan law, where penalties suit the crimes: thieves' hands were cut off, scolds' tongues bridled. The revengers' language of 'paying' hints at the operation of revenge in the service of economic redress. Revenge makes contact with resistance theory, justifying overthrow of tyrants, and some revengers challenge the fundamental inequity of social class. Woodbridge demonstrates how, for all their sensationalism, their macabre comedy and outlandish gore, Renaissance revenge plays do some serious cultural work.

The Eyes of Justice by José María González García Pdf

Should Justice be blind or should she instead be capable of seeing everything, even the human heart? Jose M. Gonzalez Garcia examines how the iconography of Justice evolved over the course of history. Providing an overview of depictions of Justice in various ages and places, the book mainly focuses on "The Blindfold Dispute" that began to develop during Renaissance. While at first the blindfold was perceived as unjust, precisely because it denied Justice the ability to see everything, it transformed just a few years later into a positive symbol of the equality of all individuals before the law. And other depictions were added: supplementary eyes, transparent blindfolds, the double face of Janus, the returns of Astraea and the "Eye of the Law". The book also analyses important historic moments in which the crisis of the Law went along with a search for new forms of representing the gaze of Justice, as reflections on the art of Durer, Klimt and Kafka as well as recent developments in political philosophy show.

Law as Performance by Julie Stone Peters Pdf

Tirades against legal theatrics are nearly as old as law itself, and yet so is the age-old claim that law must not merely be done: it must be "seen to be done." Law as Performance traces the history of legal performance and spectatorship through the early modern period. Viewing law as the product not merely of edicts or doctrines but of expressive action, it investigates the performances that literally created law: in civic arenas, courtrooms, judges' chambers, marketplaces, scaffolds, and streets. It examines the legal codes, learned treatises, trial reports, lawyers' manuals, execution narratives, rhetoric books, images (and more) that confronted these performances, praising their virtues or denouncing their evils. In so doing, it recovers a long, rich, and largely overlooked tradition of jurisprudential thought about law as a performance practice. This tradition not only generated an elaborate poetics and politics of legal performance. It provided western jurisprudence with a set of constitutive norms that, in working to distinguish law from theatrics, defined the very nature of law. In the crucial opposition between law and theatre, law stood for cool deliberation, by-the-book rules, and sovereign discipline. Theatre stood for deceptive artifice, entertainment, histrionics, melodrama. And yet legal performance, even at its most theatrical, also appeared fundamental to law's realization: a central mechanism for shaping legal subjects, key to persuasion, essential to deterrence, indispensable to law's power, --as it still does today.

Genesis Quest by Barry Verdi Pdf

Are the stories in Genesis fact, myth, legend, the word of God, philosophy, or something else? Through time, what people think or remember about Genesis has become a mixture of fact and fable. For example, if you were to ask someone what fruit Adam and Eve were tempted by, most people might say, "An apple." If you were to ask what color the apple was, most people might state that they think the fruit was red. Are these actual facts? No, people are simply using artistic imagination. The stories in Genesis are multifaceted oral traditions about the human family that originated long before the established interpretations, dogmas, and doctrines of our contemporary world. One thing the stories do indicate is that we are all genetically connected regardless of our outward appearance, yet we are divided due to multiple factors related to our situation in life and personal beliefs. The Genesis Quest examines ancient roots of human thinking to strip away veneers of progressive interpretations and reveal the evolution of a philosophy - six principles of the human spirit looking for the soul of our communal life: God/creation, good and evil, sharing, mercy, saving life, and communicating, These principles are intended to help us understand what it means to be human.

Blinding as a Solution to Bias by Christopher T Robertson,Aaron S Kesselheim Pdf

What information should jurors have during court proceedings to render a just decision? Should politicians know who is donating money to their campaigns? Will scientists draw biased conclusions about drug efficacy when they know more about the patient or study population? The potential for bias in decision-making by physicians, lawyers, politicians, and scientists has been recognized for hundreds of years and drawn attention from media and scholars seeking to understand the role that conflicts of interests and other psychological processes play. However, commonly proposed solutions to biased decision-making, such as transparency (disclosing conflicts) or exclusion (avoiding conflicts) do not directly solve the underlying problem of bias and may have unintended consequences. Robertson and Kesselheim bring together a renowned group of interdisciplinary scholars to consider another way to reduce the risk of biased decision-making: blinding. What are the advantages and limitations of blinding? How can we quantify the biases in unblinded research? Can we develop new ways to blind decision-makers? What are the ethical problems with withholding information from decision-makers in the course of blinding? How can blinding be adapted to legal and scientific procedures and in institutions not previously open to this approach? Fundamentally, these sorts of questions—about who needs to know what—open new doors of inquiry for the design of scientific research studies, regulatory institutions, and courts. The volume surveys the theory, practice, and future of blinding, drawing upon leading authors with a diverse range of methodologies and areas of expertise, including forensic sciences, medicine, law, philosophy, economics, psychology, sociology, and statistics. Introduces readers to the primary policy issue this book seeks to address: biased decision-making. Provides a focus on blinding as a solution to bias, which has applicability in many domains. Traces the development of blinding as a solution to bias, and explores the different ways blinding has been employed. Includes case studies to explore particular uses of blinding for statisticians, radiologists, and fingerprint examiners, and whether the jurors and judges who rely upon them will value and understand blinding.

Constitutional Rights and Constitutional Design by Paul Yowell Pdf

The decisions courts make in constitutional rights cases pervade our political life and touch on our most basic interests and values. The spread of judicial review of legislation around the world means that courts are increasingly called on to settle matters of moral and political controversy, including assisted suicide, data privacy, anti-terrorism measures, marriage, and abortion. But doubts regarding the institutional capacities of courts for deciding such questions are growing. Judges now regularly review social science research to assess whether a law will effectively achieve its aim, and at what cost to other interests. They cite studies and statistical information from psychology, sociology, medicine, and other disciplines in which they are rarely trained. This empirical reasoning proceeds alongside open-ended moral reasoning, with judges employing terms such as equality, liberty, and autonomy, then determining what these require in concrete circumstances. This book shows that courts were not designed for this kind of moral and empirical reasoning. It argues that in comparison to legislatures, the institutional capacities of courts are deficient. Legislatures are better equipped than courts for deliberating and decision-making in regard to the kinds of factual and moral issues that arise in constitutional rights cases. The book concludes by considering the implications of comparative institutional capacity for constitutional design. Is a system of judicial review of legislation something that constitutional framers should choose to adopt? If so, in what form? For countries with systems of judicial review, practical proposals are made to remedy deficiencies in the institutional capacities of courts.
