Copyright by Barry B. Sookman,Steven Mason Pdf

"Copyright law grants exclusive rights for limited terms to the authors of musical, literary, dramatic and artistic works. With the shift towards an information economy and the rapid development of digital technologies, copyright is fast becoming one of the most dynamic, critical and controversial areas of Canadian law and policy. This casebook presents extracts from the leading cases from both Canadian and international jurisprudence to illustrate the legal concepts, doctrinal evolution and current approaches to copyright issues. The revised second edition reflects the important case law and statutory amendments that have taken place over the past five years, including the Supreme Court of Canada's so-called "copyright pentalogy" and the newly enacted Copyright Modernization Act."--pub. desc.

Copyright Law by Sheldon W. Halpern Pdf

To access the 2014-2015 Supplement click here. Copyright Law is unique among copyright casebooks in that it is tightly and coherently structured, intelligently distilled, and clearly contextualized. Halpern's casebook explores the complex and sometimes counterintuitive issues surrounding protection of intellectual creativity under US copyright law by ensuring that both student and professor always maintain an understanding of how doctrinal elements relate to the whole. Thus, the book is perfect for those students who have struggled with dense notes and opaque explanations, professors who have labored through cumbersome and poorly ordered texts, and for new teachers who need a concise and clear pedagogic template complete with both substantive doctrine and highly instructive cases. Simply put, Copyright Law is a refreshing primer on the title topic, and a welcome alternative to less coherent texts. The second edition expands upon the first and brings the material up-to-date while retaining its eminently teachable structure. "...a great primer for all things copyright...an excellent overview of the topic. The table of contents reads like a class outline you would 'borrow' from the smart guy sitting up front." -- Legal Information Alert, on the first edition

Copyright, Communication and Culture by Carys J. Craig Pdf

In this provocative book, Carys Craig challenges the assumptions of possessive individualism embedded in modern day copyright law, arguing that the dominant conception of copyright as private property fails to adequately reflect the realities of cultural creativity. Employing both theoretical argument and doctrinal analysis, including the novel use of feminist theory, the author explores how the assumptions of modern copyright result in law that frequently restricts the kinds of expressive activities it ought to encourage. In contrast, Carys Craig proposes a relational theory of copyright based on a dialogic account of authorship, and guided by the public interest in a vibrant, participatory culture. Through a critical examination of the doctrines of originality and fair dealing, as well as the relationship between copyright and freedom of expression, she explores how this relational theory of copyright law could further the public purposes of the copyright system and the social values it embodies. This unique and insightful study will be of great interest to students and scholars of intellectual property, communications, cultural studies, feminist theory and the arts and humanities.

Digital Copyright by Jessica Litman Pdf

I completed the original manuscript of Digital Copyright in 2000, two years after Congress enacted the Digital Millennium Copyright Act. The 1976 Copyright Act was itself 24 years old, and beginning to show its age. The Internet, in contrast, was still new and shiny and scary, especially for legacy entertainment and information businesses and the copyright lawyers who represented them.Seventeen years later, the Internet has become an essential feature of all of our lives and the copyright laws designed to tame it seem elderly and barnacle-encrusted. Remarkably, the legislative process that has made sensible copyright law reform all but impossible has stayed largely unchanged. Congress and the Copyright Office have recently launched what is billed as a comprehensive reexamination of copyright law with the goal of overhauling the law for the 21st century. It seems likely that these efforts will hew to the patterns of earlier copyright revision. Perhaps we stick with the tried and true approach to making copyright laws, even though it results in bad laws, because the process works so well for so many of the participants. Members of Congress can rely on affected industries to come up with broadly acceptable compromises, and to take on much of the burden of pressuring other interested groups to swallow them. Meanwhile, Senators and Representatives can continue to collect generous campaign contributions. The Copyright Office can be the center of attention as it plays a crucial role in managing the multilateral negotiations and interpreting their results to Congress. Copyright lobbyists and trade organizations can collect hefty fees from their members, in return for supplying them with laws that will give them competitive advantages against the next new thing, whatever it is. Because the laws that emerge from this process don't work very well, meanwhile, everyone can look forward to another round.Although the book is ancient in Internet time, people seem to have continued to read it. Now that it has finally gone out of print, I'm delighted to be able to make it more freely available under a Creative Commons license. In addition to the Afterword that I wrote for the 2006 paperback edition, I have included a postscript looking back briefly on what, if anything, we might have learned from the aftermath of the stories told in this book.Postscript is available at: 'https://ssrn.com/abstract=2968546' https://ssrn.com/abstract=2968546.
