Law, Text, Terror by Peter Goodrich,Lior Barshack,Anton Schutz Pdf

The essays collected here under the governing signs, Law, Text, Terror have their origins in a singular and topical desire. Their motive is most immediately that of acknowledging the massive and eccentric contribution of the philologist, psychoanalyst and Romanist jurist Pierre Legendre to the study of legal institutions and juridical practices. He has unceasingly asked the question 'why law?' and in endeavouring to answer that question, in the course of over twenty-five books published during the last forty years, he has traversed a unique and uniquely idiosyncratic body of disciplines and knowledges relevant to the symbolic forms and institutional functions of the Western legal order. These essays reflect that singularity of drive as well as that diversity of scholarly interests by taking up, playing with, varying and developing the themes of text and terror, law and territory, that Legendre either introduced or made peculiarly his own.

The War on Terror by James P. Terry Pdf

A former Marine judge advocate and legal counsel to General Colin Powell, James Terry explores the genesis of the United States approach to terror violence and the legal foundation for the nation’s response to the conflicts in Afghanistan and Iraq. Terry first reviews the entire spectrum of legal issues that arise before offering creative and practical legal and political solutions to counter terrorist activities. The author examines the development of rules of engagement and their application in the terrorist environment while differentiating the law of self-defense in this environment from more traditional conflicts. He also addresses the role of interrogation, and the line between harsh interrogation and torture, and the jurisdictional claims that arise. This volume examines a large number of topics related to the struggle and in a remarkably concise exploration, makes them understandable to experts in international law as well as those who do not have a strong background in the field. This text provides a serious but concise review of the legal issues in 20 interrelated chapters. All constitutional law scholars and political scientists will greatly benefit from reading this book. No other text offers such a comprehensive or detailed review of the issues arising from the war on terror.

Terrorism and the US Drone Attacks in Pakistan by Imdad Ullah Pdf

This book analyses the US drone attacks against terrorists in Pakistan to assess whether the ‘pre-emptive’ use of combat drones to kill terrorists is ever legally justified. Exploring the doctrinal discourse of pre-emption vis-à-vis the US drone attacks against terrorists in Pakistan, the book shows that the debate surrounding this discourse encapsulates crucial tensions between the permission and limits of the right of self-defence. Drawing from the long history of God-given and man-made laws of war, this book employs positivism as a legal frame to explore and explain the doctrine of pre-emption and analyses the doctrine of the state’s rights to self-defence as it stretches into pre-emptive or preventive use of force. The book investigates why the US chose the recourse to pre-emption through the use of combat drones in the ‘war on terror’ and whether there is a potential future for the pre-emption of terrorism through combat drones. The author argues that the policy to ‘kill first’ is easy to adopt; however, any disregard for the web of legal requirements surrounding the policy has the potential to undercut the legal claims of an armed act. The book enables the framing and analysis of such controversies in legal terms as opposed to a choice between law and policy. An examination of the legal dilemma concerning drone warfare, this book will be of interest to academics in the fields of international relations, Asian politics, South Asian studies, and security studies, in particular, global security law, new wars, and emerging technologies of warfare.

The 'War on Terror' and the Framework of International Law by Helen Duffy Pdf

The acts of lawlessness committed on September 11, 2001 were followed by a 'war on terror'. This book sets out the essential features of the international legal framework against which the '9/11' attacks and the lawfulness of measures taken in response thereto fall to be assessed. It addresses, in an accessible manner, relevant law in relation to: 'terrorism', questions as to 'responsibility' for it, the criminal law framework, lawful constraints on the use of force, the humanitarian law that governs in armed conflict, and international human rights law. It indicates the existence of a legal framework capable of addressing events such as '9/11' and governing responses thereto. The author examines the compatibility of the 'war on terror' with this legal framework, and questions the implications for states responsible for violations, for third states and for the international rule of law.

Texts After Terror by Rhiannon Graybill Pdf

"It is widely recognized that the Hebrew Bible is filled with rape and sexual violence. However, feminist approaches to the topic remain dominated by Phyllis Trible's 1984 Texts of Terror, which describes feminist criticism as a practice of "telling sad stories." Pushing beyond Trible, Texts after Terror offers a new framework for reading biblical sexual violence, one that draws on recent work in feminist, queer, and affect theory and activism against sexual violence and rape culture. In the Hebrew Bible as in the contemporary world, sexual violence is frequently fuzzy, messy, and icky. Fuzzy names the ambiguity and confusion that often surround experiences of sexual violence. Messy identifies the consequences of rape, while also describing messy sex and bodies. Icky points out the ways that sexual violence fails to fit into neat patterns of evil perpetrators and innocent victims. Building on these concepts, Texts after Terror offers a number of new feminist strategies and approaches to sexual violence: critiquing the framework of consent, offering new models of sexual harm, emphasizing the importance of relationships between women (even in the context of stories of heterosexual rape), reading biblical rape texts with and through contemporary texts written by survivors, advocating for "unhappy reading" that makes unhappiness and open-endedness into key feminist sites of possibility. Texts after Terror also discusses a wide range of biblical rape stories, including Dinah (Gen. 43), Tamar (2 Sam. 13), Lot's daughters (Gen. 19), Bathsheba (2 Sam. 11), Hagar (Gen. 16 and 21), Daughter Zion (Lam. 1 and 2), and the Levite's concubine (Judg. 19)"--
